HomeMy WebLinkAbout08-09-1993 Regular MeetingEe"lll:� STATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday, 9 August 1993. Present were Mayor James P. Nix; Councilmembers John V. Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton Overstreet; City Attorney Marion E. Wynne and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 26 July 1993 regular session were duly approved. Special guests were members of the "Sharks", young boys and girls, who just won top honors, for the third year straight, at the Greater Mobile Swim & Dive Meet. Mayor Nix proclaimed August 9-15 as Eastern Shore Swim Association Week in Fairhope. Councilman Duck introduced in writing Ordinance No. 942, an ordinance to annex the property of George E. and Annie Lee Mitchell at 19683 Greeno Road. In order to take immediate action, Councilman Bishop moved to suspend the rules. Seconded by Council- man Ford, motion to suspend passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilman Duck then moved for final adoption of Ordinance No. 942. Seconded by Councilman Overstreet, motion passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilman Duck introduced in writing Ordinance No. 943, an ordinance to annex the property of Alice H. Bos y at 19669 Greeno Road. In order to take immediate action, Council- man Bishop moved to suspend the rules. Seconded by Councilman Ford, motion to suspend passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilman Duck then moved for final adoption of Ordinance No. 943. Seconded by Councilman Overstreet, motion passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilman Bishop introduced, and moved for the adoption of, the following resolution in writing. Seconded by Councilwoman Puckett, motion passed unanimously: (Res. No. 420-93 on next page....) 9 August 1993 1477 RESOLUTION NO. 420-93 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that Mayor James P. Nix is hereby authorized to execute a contract between the City and ELCON, INC., for the relocation of the City's electrical wires on the US98 widening project (Alabama Highway Depart- ment Project DE-0019(802)) from AL104 to CR44, for the sum of Two hundred forty-eight thousand, three hundred ninety and no/100 Dollars ($248,390.00). BE IT FURTHER RESOLVED that this contract with ELCON, INC., be increased by Fourteen thousand, nine hundred fifty and no/100 Dollars ($14,950.00) to cover the installation of forty-six (46) concrete utility poles at $325.00 per pole. ADOPTED THIS 9TH DAY OF AUG Councilwoman Puckett introduced, and moved for the adoption of, the following resolution in writing; provided drainage repair is completed and approved by Building Official Robert Lunsford and Engineering consultant Ack Moore. Seconded by Councilman Overstreet, motion passed unanimously: (Res. No. 421-93 on next page....) 9 August 1993 1478 RESOLUTION NO. �v I 3 WHEREAS, the Owners of Ingleside Terrace Subdivision are desirous of having the street and the utilities therein accepted for maintenance by the City Council in order that building permits may lawfully issue, and; WHEREAS, the General Superintendent of the City represents that the physical improvements in the nature of streets, drainage and utilities have been installed in substantial conformity with City requirements, and; WHEREAS, the Building/Zoning Officer of the City represents that he has received Engineer's Certified As - built Plans, test reports and lateral locations substantially as required by Chapter 19 of the Code of Ordinances, and; WHEREAS, the owners have provided to the City Clerk a bond for maintenance of the improvements as required by the City's codes and regulations, and; WHEREAS, the Plat of said Ingleside Terrace having been recorded in th Probate Records of Baldwin County, Alabama at Slide No. / �(0-(3, delineates thereon the subject street therein as a public way; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA that the said street and the utilities within said Ingleside Terrace Subdivision be and the same hereby are accepted for public maintenance subject to the bond posted. This resolution of acceptance shall not obligate the City of Fairhope to maintain any utility or drainage facilities outside the limits of the right-of-way of the public street, whether or not such may be located within dedipated easements. Seconded by Council man Ford, motion passed unanimously: RESOLUTION NO. 423-93 WHEREAS, Act No. 80-497, 1980 Acts of Alabama authorized Baldwin County, Alabama, to adopt ordinances to protect the historic architectural char- acter of Baldwin County, and said act did authorize the creation of the Baldwin County Historic Development Commission, the creation of Historic and Preservation Districts within Baldwin County, and the establishment of an Architectural Review Board within said historic districts; and WHEREAS, the Baldwin County Commission did pursuant to said act create the Baldwin County Historic Development Commission and Architectural Review Boards for such historic and preservation districts; and WHEREAS, the Village of Montrose has been so designated by the Baldwin County Historic Development Commission as a Historic and Preservation District, and that all construction within said Historic and Preservation District require, prior to obtaining a building permit, approval of the Architectural Review Board for the Montrose Historic and Preservation District, and areas within the Montrose Historic and Preservation District have recently been annexed into the City of Fairhope; and WHEREAS, it is the intent of the City of Fairhope to preserve the historic area of Montrose and it is desirous for such construction lying within those areas of the Montrose Historic and Preservation District which are within the City of Fairhope to obtain approval of the Architectural Review Board prior to the issuance of building permits; NOW, THEREFORE, be it resolved that no building permits shall be issued by the Building Inspector for the City of Fairhope on any construction lying within the boundaries of the Montrose Historic and Preservation District until such time as the Architectural Review Board for such district has certified to the Building Inspector that it has approved the construction plans.
