HomeMy WebLinkAbout07-26-1993 Regular Meeting1471 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday, 26 July 1993. Present were Mayor James P. Nix; Councilmembers John V. Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton Overstreet; City Attorney Marion E. Wynne and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 12 July 1993 regular session were duly approved. Mayor Nix made a special presentation of a plaque honoring Marriott Grand Hotel's employee Alfred Agee. Mr. Agee was one of 16 Marriott employees, out of over 200,000, to win this year's Marriott Award of Excellence. Mr. Agee has been at the Grand Hotel for 34 years and Mayor Nix said he is also a Good Will Ambassador for the City. The general manager of the Grand, John Irvin, and several other representatives, were also present. Mayor Nix proclaimed July 25-31 as "Alfred Agee Week" as he presented the plaque. Councilman Overstreet introduced in writing, Ordinance No. 940, an ordinance to annex the property of Lilly Bell Dacus, 3 South Ingleside. Ms. Dacus petitioned for annexation as her lot is now contiguous. In order to take immediate action, Councilman Duck moved to suspend the rules. Seconded by Council- man Ford, motion to suspend passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilman Duck then moved for final adoption of Ordinance No. 940. Seconded by Councilman Bishop, motion to final adopt passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilman Duck introduced in writing, Ordinance No. 941, an ordinance to annex the property of Robert-M. and Rebecca Bowles, Lot #7, Flying Creek SD, Montrose. The Bowles peti- tioned for annexation as their vacant lot is now contiguous. In order to take immediate action, Councilman Bishop moved to suspend the rules. Seconded by Councilwoman Puckett, motion to suspend passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. Nay -none. C. Duck then moved for final adoption of Ordinance No. 941. Seconded by Councilman Ford, motion passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. 26 July 1993 1472 Council reviewed a Restaurant Liquor License application by Bruce S. Snead, dba THE GRAND VICTORIAN, a restaurant in the Homestead Village, 924 Plantation Boulevard. No one present was opposed to the license. There was police approval of the applicant. After discussion, Councilman Overstreet moved for approval of the license. Seconded by Councilman Duck, motion passed unanimously. Councilman Bishop reported he had been contacted concerning boats and windsurfers on our Municipal beach, and introduced Mrs. Marilyn McKeown who addressed the Council. Mrs. McKeown stated she had seen windsurfers and boats coming in to our beach at high rates of speed and she is concerned about swimmers, particularly children, being struck. There were signs at one time designating the swimming area as off-limits for boats but these signs have disappeared. Mrs. McKeown was advised that the Marine Police was in charge of posting the signs, marking where boats could be launched and where they were not allowed, but no one knew why they are no longer there. Councilman Bishop moved to have the signs replaced as soon as possible. Seconded by Councilwoman Puckett, motion passed unanimously. Council took the following action on bids: IDENTIFICATION: "CORROSION CONTROL PROGRAM" Bids opened on: July 15, 1993 at: 10:30 AM. Pensacola, FL It is suggested to accept the low bid of BETZ ENTEC, Slidell, LA for the price of $11.23 per gallon with all specifications being met, _w,Smith Purch Agt Mr. Smith further explained that the low bidder could not guarantee containers would not be used for other materials. Bentz Entec gives this guarantee and they also have in town personnel to response to any hazardous material problem. This is required in bid specifications. Councilwoman Puckett moved to accept the Betz Entec bid, providing all specifications are met. Purchasing Agent Councilman Ford moved to accept the low bid by Reynolds Brothers Concrete, providing all specifications are met. Seconded by Councilman Bishop, motion passed unanimously. 26 July 1993 1474 Identification: "CHEMICAL WEED KILLER" Bids opened on: July 22. 1993 -, at: 10:30 AM. Annual Bid for Non Selective Herbicide to be used by City. BID SENT TO: BID AMOUNT- DELIVERY - TERRA INTERNATIONAL $41.40 per gallon 5-Days Summerdale, AL VECTEC, INC. We specified a pre -mix chemical to be used to avoid any type of mixing of chemicals. It is suggested to accept the bid of TERRY INTERNATIONAL, Summerdale, Alabama for the price of $41.40 a gallon with all specifications being met. --W.Smith, Purch. Agt. Councilman Bishop moved to accept the lowest bidder meeting specifications. Seconded by Councilman Duck, motion passed unanimously. Councilman Bishop moved to hear the following business not on the Agenda. Seconded by Councilman Duck, motion passed unanimously: Mayor Nix advised that the sewer project we have contracted out to Fairhope Paving Company (running lines down to the new Fairhope High School) needs an amendment. Moore Engineering Company has suggested we go ahead and place two bores under US 98 while this line is going in and save having to do this in future when US 98 will be four-laned. The bores now will also allow installations on the opposite side of US 98, not just on the School side. The cost to be added to the Fairhope Paving con- tract will be approximately $19,S2S.00 including engineering. (Contract is for $133,475.7S plus engineering fees, as per Resolution #415-93 adopted 24 May 1993.) After discussion, 26 July 1993 1475 Councilman Ford moved to approve the extra work and increase the Fairhope Paving Company contract by the estimated amount.
