The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 28 June 1993.
Present were Mayor James P. Nix; Councilmembers John V. Duck,
Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton
Overstreet; City Attorney Marion E. Wynne and City Clerk Evelyn
Phillips. No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 7 June 1993 regular session
were duly approved.
Councilman Ford introduced, in writing, Ordinance No. 939,
an ordinance to annex various properties located generally
between and along South Ingleside Street and South Greeno Road,
south of Twin Beech Road, as per petitions for annexation by
the following property owners: John & Ella Mae Robinson; Vandy
Dale, Jr. & Rosa L. Dale; Walter & Hattie M. Johnson; Anthony
L. & Santyonia F. Stephenson; Booker T. & Marion D. Waters;
Louis C., & Barbara A., Agee, Sr.; Hannah Goubile; Lee D., &
Clara, McGrue, Sr.; Carolyn J. Safford; Clyde F. Mitchell; and
Margaret N. Buchanan. There are 11 parcels of various size,
all totaling 30.9 acres, more or less. In order to take immed-
iate action, Councilman Duck moved to suspend the rules. Seconded
by Councilman Bishop, motion to suspend passed unanimously by
the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and
Overstreet. NAY- none. Councilwoman Puckett then moved for
final adoption of Ordinance No. 939. Seconded by Councilman
Overstreet, motion to final adopt passed unanimously by the
following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and
Overstreet.
Council discussed a written request from the Oscar L. Smith
family, 112 Pier Street, concerning the placing of a cross in
front of the Fairhope Middle School. The family's son, Everett
Lloyd (Benji) Smith, Jr., was killed here on 11 May 1990, in
an accident involving a drunken driver. Mayor Nix appointed
a committee (Councilmen Overstreet, Duck, Ford, and Gen. Supt.
Rutherford) to study the request and make a recommendation for
action for the Council's consideration.
Council discussed a written request from Ms. Bessie Mont-
gomery, Town & Country Dress Shop, to erect a balcony,supported
upon the public right-of-way, on her shop's front at 40 South
Section Street. The supports would be located similar to and
in alignment with those at the Page and Palette, 32 South

Section Street. Building Official Lunsford reported his approval
of this plan. Councilman Duck moved to approve the request.
Seconded by Councilwoman Puckett, motion passed unanimously.
An application for a Restaurant Liquor License by Rick
Gambino as President of the ADANO CORPORATION, dba GAMBINO'S
RESTAURANT, 18 Laurel Avenue, was reviewed. Gambino's is a
long-established business, this application a result of the
owners incorporation. There was police approval of the applicant.
No one present was opposed to the continuation of the license.
Councilwoman Puckett moved to accept the license. Seconded
by Councilman Overstreet, motion passed unanimously.
Mayor Nix announced a 5-year term position was open on the
Personnel Board, and he nominated Charles T. Johnson. There
being no other nominations, Councilman Overstreet moved the
nominations be closed and Mr. Johnson appointed by acclamation.
Seconded by Councilman Bishop, motion passed unanimously. -
Council took the following action on bids:

Since only one bid met specifications, it is suggested to reject
all bids and rebid after specifications are reworked.
Councilman Bishop moved to reject all bids, and have the speci-
fications reworked for a rebid. Seconded by Councilman
Overstreet, motion passed unanimously.

It is recommended to replace utility poles, after the widening project
is complete, with ONLY concrete poles; and to accept the low bid by
Baldwin Pole & Piling Company at $36,662.00.--W.Smith, Purch. Agt.
--A.Norris, Elec Dept.
Councilman Bishop moved to reject all bids on Wooden Poles and
to accept the low bid on the Concrete Poles by Baldwin Pole
and Piling Company, provided all specifications are met. Seconded
by Councilman Duck, motion passed unanimously.
Councilman Overstreet reported his committee had reviewed
the request by Eastern Shore Medical Specialists for a traffic
signal at the intersection of Morphy and Ingleside. Due to
several modifications at the site, the committee recommends,
and Councilman Overstreet moved for, denial of the request.
Seconded by Councilman Ford, motion passed unanimously.
Mayor Nix proclaimed Silver Queen Corn Day in Fairhope this
Saturday, 3 July 1993. Fairhope First is sponsoring a Silver
Queen Corn Festival on that day honoring local farmers. The
Festival will feature a Farmers Market, Food Booths, exhibits
and entertainment; and the location is the city park on Greeno
Road and Volanta Avenue.
Councilman Ford reported he had received a number of calls
and comments from citizens concerned aboutthe removal of trees
and plantings from the entrance to Fairhope, the "Y" on US 98
north of the city, and questioned if anything is to be done
about it when the developers along the highway complete their
projects. He was assured that these developers, and the State
Highway Department, have told us that the beautification will
be restored, if not bettered, in this area.

Councilman Ford also reported concern about the recent
announcement by the Cable Television people that they were
going to remove a religious channel from our local program.
This channel is apparently a favorite of elderly and invalid
persons who are unable to attend church services. Council-
man Ford asked if anything could be done to get the Cable
people to reconsider eliminating this religious channel. Mayor
Nix reminded Council that the city cannot govern the cable's
program decisions, however, he will write them and ask if this
decision can be reconsidered.
Councilman Bishop moved to hear the following business not
on the Agenda. Seconded by Councilman Ford, motion passed
unanimously:
Councilwoman Puckett moved to authorize the sale by sealed
bid, and the placing of ads soliciting bids, of an obsolete
1978 Dodge pickup. Seconded by Councilman Overstreet, motion
passed unanimously.
Councilman Duck moved to pay bills as presented. Seconded
by Councilman Ford, motion passed unanimously.
A number of Volunteer Firemen attended the meeting. They
have just received the new Fire Rescue Truck, purchased by
Council authorization on 14 December 1992, and wanted everyone
to come outside and see it.
Meeting was duly adjourned at 6:02 pm.
