Nix, Mayor CONSENT TO HOLDING OF MEETING I The undersigned members of the City Council of the City of Fairhope, Alabama, do hereby acknowledge service of the Notice and Call of Special Meeting hereinabove set forth and do hereby consent to the holding of such meeting such time and in such place and for the purpose s t forth therein. 1421 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in special session at 5:00 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday, 29 March 1993. Present were Mayor James P. Nix; Councilmembers John V. Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett, and Layton Overstreet; City Attorney Marion E. Wynne and City Clerk Evelyn Phillips. No one was absent. The purpose of this Public Hearing was to hear, consider, and determine action on the 1993 Public Improvement Assessment Project. There being a quorum present, Mayor Nix called the meeting to order. Since the largest group of property owners were from Colonial Acres SubDivision, that part of the project was first considered: Mayor Nix gave the estimated costs at $7,775.00 per lot. (Estimates were prepared by Moore Engineering Company and Mr. Ack Moore was present to answer questions.) After dis- cussion, Mayor Nix asked for the Colonial Acres group to hand vote Aye or Nay as to being included in the project. There was an overwhelming "NAY" vote. There were also three written NAY votes. Councilman Bishop moved to modify Initial Improve- ment Ordinance No. 926 by deleting Colonial Acres SubDivision from the project. Seconded by Councilman Ford, motion passed unanimously. (There was a 5 minute recess while room cleared.) The following proposed areas were improvements as listed in Ordinance No. Area No. of Lots Greenbrier SD 16 Woodlands at Fhope 23 Rock Creek, a PUD 176 Estella Drive (FSTC) all in favor of the 926: Estimated Cost $ 9,556/lot $ 25,000/lots 1-22 $ 210,000 Lot 23 $2,495,684 overall $ 75.50/per front foot, each side. At the conclusion of this hearing, Councilman Bishop introduced Improvement Ordinance No. 930, in writing, which confirmed the Initial Ordinance (926) , with the single amendment for elimi- nating Colonial Acres SubDivision. In order to take immediate action on this Ordinance, Councilman Duck moved to suspend the 29 March 1993 1422 rules. Seconded by Councilwoman Puckett, motion to suspend passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilman Duck then moved for final adoption of Improvement Ordinance No. 930. Seconded by Councilman Bishop, motion to final adopt passed unanimously by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none. Councilwoman Puckett introduced in writing, and moved for the adoption of, the following resolution. Seconded by Council- man Overstreet, motion passed unanimously: RESOLUTION NO. 403-93 A RESOLUTION PROVIDING FOR NOTICE AND ADVERTISEMENT FOR BIDS FOR PUBLIC WORK WITH REFERENCE TO IMPROVEMENTS DE- SCRIBED IN IMPROVEMENT ORDINANCE NO. 926, ADOPTED ON THE 11TH DAY OF MARCH, 1993. BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, AS FOLLOWS: Section One. That notice shall be given, asking for bids for public work in making the improvements described in Initial Improvement Ordinance No. 926, as modified, amended and confirmed by Improvement Ordinance No. 930, adopted on the 29th day of March, 1993, as provided by the 1975 Code of Alabama, as amended. Section Two. That the following notice shall be published once a week for two consecutive weeks in the EASTERN SHORE COURIER, a newspaper of general circulation in the City of Fairhope, Alabama: (Ad reproduced on next page...) Seconded by Councilman Bishop, motion passed unanimously: RESOLUTION NO. 404-93 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, AS FOLLOWS: Mayor Nix is hereby authorized to negotiate for funding of the public improvements as per Ordinance No. 926, as confirmed by Ordinance No. 930.
