The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 22 March 1993.
Present were Mayor James P. Nix; Councilmembers John
V. Duck, Michael A. Ford, David E. Bishop, Jeanette Puckett,
and Layton Overstreet; City.Attorney Marion E. Wynne and
City Clerk Evelyn Phillips. No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 11 March 1993 regular session were
duly approved.

Councilman Ford introduced Ordinance No. 927,/an ordinance
amending Section 21-75, Code of Ordinances, by increasing
monthly Garbage Rates, effective first billing cycle after
1 April 1993. In order to take immediate action, Councilman
Duck moved to suspend the rules. Seconded by Councilwoman
Puckett, motion to suspend passed unanimously by the following
vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet.
NAY- none. Councilwoman Puckett then moved for final adoption
of Ordinance No. 927. Seconded by Councilman Duck, motion
to final adopt passed unanimously by the following vote:
AYE -Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -
none.
Councilman Duck introduced Ordinance No. 928, in writing,
an ordinance establishing grades (known as the Grade Ordinance)
for the 1993 Public Improvements Assessments Project. In
order to take immediate action, Councilman Bishop moved to
suspend the rules. Seconded by Councilwoman Puckett, motion
to suspend passed unanimously by the following vote: AYE -
Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none.
Councilman Duck then moved for final adoption of Ordinance
No. 928. Seconded by Councilman Bishop, motion to final
adopt passed unanimously by the following vote: AYE -Duck,
Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none.
Councilman Overstreet introduced Ordinance No. 929, in
writing, an ordinance annexing the property described on
approximately 91 Petitions for Annexation, properties located
north of city limits. In order to take immediate action,
Councilman Overstreet moved to suspend the rules. Seconded
by Councilman Bishop, motion to suspend passed unanimously
by the following vote: AYE -Duck, Ford, Bishop, Nix, Puckett,
and Overstreet. NAY -none. Councilman Overstreet then moved

for final adoption of Ordinance No. 929. Seconded by Council-
man Bishop, motion to final adopt passed unanimously by the
following vote: AYE -Duck, Ford, Bishop, Nix, Puckett, and
Overstreet. NAY -none.
Councilman Duck introduced in writing, and moved for
the adoption of, the following resolution. Seconded by Council-
man Ford, motion passed unanimously:
RESOLUTION NO. 402-93
BE IT RESOLVED, by the City Council of the City of Fairhope,
Alabama, that the City enter into -an Agreement with the State
of Alabama, acting by and through the Alabama Highway Department
for:
Traffic control signals on U.S. 98, Project DE-0019(802)
which agreement is before this Coucnil, and that the agreement
be executed in the name of the City, by the Mayor of the City,
for and on its behalf and that it be attested by the City Clerk
and the seal of the City affixed thereto.
BE IT FURTHER RESOLVED, that upon the completion of the execution
of the agreement, by all parties, that a copy of such agreement
be kept on file by the City Clerk.
Passed, adopted and approved this 22nd of March, 1993.

-Mayor Nix advised that the City is being asked to participate
in a joint sewer project proposal by the new Episcopal Church,
Cambridge Court SD, and the New Harbor Marina. The City
will pay $7500.00 on a pump station, $2,795.69 on the outfall,
$2,145.00 on a force main, and a portion of the $2,550.00
Engineering Fee. After discussion, Councilman Bishop moved
to participate in the project, provided all the Forester
Avenue property owners are sent a letter. Seconded by Council-
man Overstreet, motion passed unanimously.
Council decided to take under advisement a request from
the American Diabetes Association to use the Municipal Pier
area on Saturday, 2 October 1993, until more information
can be obtained on the matter.

Council took the following action on bids:

Mobile $ 11,819 60 days
Altec, Inc., and Truck Equipment Company bids did not meet
specifications; A No Bid came in from Baker Equipment Eng-
ineering, Ward International, and TECO; and there was No
Response from General Truck Equipment, Inc.
It is recommended to accept the low bid by Gulf City Body.

Councilwoman Puckett moved to accept the low bid by Gulf
City Body, provided all specifications are met. Seconded
by Councilman Duck, motion passed unanimously.
CHEMICAL REMOVAL - AIPORT
Only one bid came in to remove chemicals from one 8,000-
gal Tank and one 5,000-gal Tank, left at Airport by previous
tenant. Chemical Waste Management, Marietta, Ga., bid
$1.65 per gallon. After discussion, Councilman Bishop moved
to reject the bid and rebid the job for April 12 meeting.
Seconded by Councilman Ford, motion passed unanimously.

Councilman Bishop moved to accept the low bid by Florida
Transformers, provided all specifications are met. Seconded
by Councilman Duck, motion passed unanimously.
Councilman Ford asked if anything had been heard from
the Fairhope Single Tax Corporation and/or Faulkner State
Community College on the proposal from the City on Centennial
Hall. No response has yet come in.
There being no further bulpiness, meeting was duly adjourned
at 6:01 pm.
