COUNTY OF BALDWIN X
The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 8 February 1993.
Present were Mayor James P. Nix; Councilmembers John V. Duck,
Michael A. Ford, David E. Bishop, Jeanette Puckett, and
Layton Overstreet; and City Clerk Evelyn P. Phillips.
Ms. Helen Walton substituted for the absent City Attorney
Marion E. Wynne.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 25 January 1993 regular session
were duly approved.
Councilwoman Puckett moved for final adoption of Ordinance
No. 919, an ordinance introduced in writing at the last
regular session to amend Chapter 5, Animal Control, Fairhope
Code of Ordinances. Seconded by Councilman Duck, motion
to final adopt passed unanimously.
Councilman Overstreet moved for final adoption of
Ordinance No. 920, an ordinance introduced in writing at
the last regular session to amend the following Boards by
authorizing the appointment of two additional members each:
Harbor Board, Library Board, Recreation Board, and Airport
Board. Seconded by Councilman Bishop, motion to final adopt
passed unanimously.
Council reviewed Annexation Petition #10, by H/M Partners
and Magnolia Trace, Inc., on the Rock Creek project. After
discussion, Councilman Ford introduced Ordinance No. 921,
in writing, an ordinance to annex the within described property.
In order to take immediate action, Councilman Duck moved
to suspend the rules. Seconded by Councilman Bishop, motion
to suspend passed unanimously by the following vote: AYE -
Duck, Ford, Bishop, Nix, Puckett, and Overstreet. NAY -none.
Councilman Bishop then moved for final adoption of Ordinance
No. 921. Seconded by Councilman Ford, motion to final adopt
passed unanimously by the following vote: AYE -Duck, Ford,
Bishop, Nix, Puckett, and Overstreet. NAY -none.
Councilman Duck introduced in writing, and moved for
the adoption of,the following resolution. Seconded by Council-
man Ford, motion passed unanimously:

RESOLUTION NO. 394-93
WHEREAS, the owners of certain lands have requested the City of
Fairhope to initiate a public assessments improvement program for
the purpose of providing streets, drainage and/or water/sewer/gas
facilities to the benefit of those lands; and
WHEREAS, the general laws of the State of Alabama authorize the
municipalities to make improvements or reimprovements to streets,
install sanitary sewer systems, construct stormwater drainage
systems, and install water and gas mains and services and to pro-
vide for payment of same by levy of special assessments; and
WHEREAS, the City proposes to adopt an initial ordinance for the
proposed assessments program; and
WHEREAS, Moore Engineering Company, Inc., (an Alabama corporation)
proposes to furnish the City with plans, cost estimates, and other
specialized data as required; and
WHEREAS, Moore Engineering Company, Inc., understands and agrees
that no payment will be rendered for such services until the Con-
struction Contract for the assessments program has been executed; and
WHEREAS, Moore Engineering Company, Inc., understands and agrees
that, should the land owners abandon the program as permitted by law,
then there shall be no financial obligation of the City to Moore
Engineering Company, Inc.; NOW, THEREFORE
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA,
that Mayor James P. Nix be, and hereby is, authorized to negotiate
and enter into a contract for engineering services for the assessments
program with the said Moore Engineering Company, Inc., with the pro-
vision that first payment for services rendered shall be upon execution
of the Construction Contract and payments thereafter be based upon
percentage of project work complete to date.

RESOLUTION NO. 395-93
BE IT RESOLVED, by the City Council of the City of Fairhope,
Alabama, that the City enter into an agreement with the
State of Alabama, acting by and through its Highway Department,
by the Highway Director, for:
Roadway lighting on U.S. 98, Project DE-0019(802)
which agreement is before this Council, and that the agreement
be executed in the name of the City, by its Mayor, for and on
its behalf and that it be attested by the City Clerk and the
seal of the City be affixed thereto.
BE IT FURTHER RESOLVED that upon the completion of the
execution of the agreement by all parties, that a copy of
such agreement be kept on file by the City Clerk. -
PASSED, ADOPTED, AND APPROVED THIS 8th DAY OF
FEBRUARY, 1993.

RESOLUTION NO. 396-93
BE IT RESOLVED, by the City Council of the City of Fairhope,
Alabama, that the City enter into an agreement with the
State of Alabama, acting by and through the Alabama Highway
Department for:
Preliminary Engineering and Construction Agreement
for Improvements to Morphy Avenue from U. S. 98
East to Thompson Hall Road
which agreement is before this Council, and that the agree-
ment be executed in the name of the City, by its Mayor, for
and on its behalf and that it be attested by the City Clerk
and the seal of the City affixed thereto.
BE IT FURTHER RESOLVED, that upon the completion of the
execution of the agreement by all parties, that a copy of
such agreement be kept on file by the City Clerk.

Councilman Ford moved to proclaim Wednesday, 24 February,
as Arbor Day in the City of Fairhope. Seconded by Council-
man Duck, motion passed unanimously. There will be a special
ceremony that day at the Civic Center, beginning at 10:00 a.m.
The Beautification Committee will give out annual awards and
free tree seedlings will be given to Fairhope residents.

Councilman Bishop moved to close traffic off Section
Street from Oak Avenue to Magnolia Avenue, and to allow
use of the City lot next door to First Alabama Bank, as
requested by Eastern Shore Art Center for their Annual
Outdoor Art Show during the Arts & Crafts Festival on
March 18-21. Seconded by Councilman Ford, motion passed
unanimously.
A delegation from American Legion Post #199 came before
the Council to request a vacation of a portion of Mobile
Street. This request is to clear up the Post's title to
land deeded to them by the City in the late 1940's. In
discussion, Councilman Duck explained that a proper Declaration
of Vacation form must be prepared for presentation to the
Council, and an advertised Public Hearing held, before the
Council can properly consider their request.

Councilman Bishop moved to authorize the/sale of one
1986 Chevrolet Caprice by sealed bids to the highest offer.
Seconded by Councilman Duck, motion passed unanimously.
Councilman Overstreet, reporting for his committee(himself,
Councilman Ford & Zoning Officer Lunsford), advised that
their recommendation is to deny Mr. Scott Carrier's request
for a 4-way Stop Sign on Pecan Avenue & Satsuma Street,
due to the fact that a one-way Stop Sign is already there
and they consider this to be sufficient. Councilman Overstreet
so moved. Seconded by Councilwoman Puckett, motion passed
unanimously.
Councilman Duck moved to pay bills as presented. Seconded
by Councilwoman Puckett, motion passed unanimously.
Councilman Bishop moved to hear the following business
not on the Agenda. Seconded by Councilman Ford, motion
passed unanimously:
Councilman Overstreet moved to approve the addition
of Wendell Thomas to the Police Reserve roster. Seconded
by Councilwoman Puckett, motion passed unanimously.
Meeting was duly adjourned at 5:55 pm.
