HomeMy WebLinkAbout11-13-1990 Regular Meeting1145 STATE OF ALABAMA Z COUNTY OF BALDWIN Z The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Tuesday, 13 November 1990. Present were Mayor James P. Nix; Councilmembers Jeanette Puckett, Michael A. Ford, and John V. Duck; City Attorney Marion E. Wynne and City Clerk Evelyn P. Phillips. Council - members Roy C. White and David E. Bishop were absent. (All unanimous votes = Puckett, Ford, Duck, and Nix.) There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 22 October 1990 regular session were duly approved. Visitors from the Webelos Boy Scout Troop, Den 4, were recognized and welcomed to the meeting. As advertised, a public hearing on the final close out of the CDBG Economic Development Infrastructure Grant, (Rohr -Airport, Water, Gas & Sewer) was held. No one present had any claims to present or comments to make. No written claims or comments had been received prior to the meeting. With no further action to be taken, this grant is now con- sidered finally closed. Council discussed an application for a Restaurant Liquor License by Reginald J. Bryant, dba OAKWOOD-A BAYSHORE BISTRO, 800 North Section Street, (former location of Magnolia Bar $ Grill.) No one present was opposed to the license. There was police approval of the applicant. Councilman Ford moved to approve the application. Seconded by Councilman Duck, motion passed unanimously. Councilwoman Puckett moved to approve the following changes to the Police Reserve and Volunteer Firemen rosters: Reserve - delete Albert Cotten Volunteers - add John Saraceno, Tom Shield, and Bart Stewart Seconded by Councilman Duck, motion passed unanimously. Mayor Nix explained the need to update our IBM Utility Computer System - lack of memory capacity and addition of another printer. This will increase monthly lease payments from approximately $550.00 per month to approximately $841.00 per month. Councilman Duck moved to authorize the system update. Seconded by Councilman Ford, motion passed unanimously. 13 November 1990 Councilman Ford introduced an Ordinance No. 862 (Municipal Offenses) by adding two therefor to the list set out in Ordinance N ordinance will be given final consideration 1146 to amend Ordinance offenses and fines o. 862. This amending at the next session. Councilman Ford moved to approve the Optimist Club's request to use the City's lot between Robertson Insurance Agency and First Alabama Bank, on North Section Street, for two weeks, for their Christmas Tree sales. The Club has the necessary liability insurance to protect the City. Seconded by Councilman Duck, motion passed unanimously. Councilwoman Puckett introduced, and moved for the adoption of, the following resolution. Seconded by Councilman Duck, motion passed unanimously: RESOLUTION NO. 326-90 BE IT RESOLVED That Mayor James P. Nix is hereby authorized to negotiate and execute a contract between the CITY AND SOUTH CENTRAL BELL allowing SCB to place a radio antenna on the City's water tank, Fairhope Avenue Extension, on terms favorable to the City. ADOPTED THIS 13th DAY OF NOVEMBER, 199 n � � J mes P. Nix, Mayor City C rk Councilman Ford asked all persons interested in a City Museum to please contact him. A planning meeting will be held soon. Council was reminded they had accepted a flume repair bid at the last meeting subject to FEMA approval. The FEMA agency did not approve the bid. New bid requests were sent out; Council now needs to take corrective action: Councilman Duck moved to revoke the flume bid action taken on October 22nd. Seconded by Councilman Ford, motion passed unanimously. Council discussed the new bids received: Fairhope Paving Company, Fairhope, at $13,098.00; and J. E. Harris Company, Mobile, at $13,713.00. Councilman Ford then introduced, and moved for the approval of, the following resolution. Seconded by Councilman Duck, motion passed unanimously: RESOLUTION NO. 327-90 BE IT RESOLVED That Mayor James P. Nix is hereby authorized to execute a contract between the CITY and FAIRHOPE PAVING COMPANY, INC., Fairhope, Alabama, for the "flume" work as per specifications, for the sum of $13,098.00; and BE IT FURTHER RESOLVED That this award of contract is subject to the approval of the Federal Emergency Management Agency (FEMA). Nix, Mayo City C1 k 13 November 1990 1147 Council took the following action on bids on a Van for the Electric Department: Vendor Price Deliver Gaston Ford Daphne 14,619.50 56 days Moyer Ford Foley 14,390.50 45/60 days It is recommended to accept the low bid by Moyer Ford as all specifications are met. --Aaron Norris --Wayne Smith Electrical Supt. Purchasing Agt Councilwoman Puckett moved to accept the low bid by Moyer Ford, provided all specifications are met. Seconded by Councilman Duck, motion passed unanimously. Mrs. Martha Hill, a local resident, came before the Council to talk about the protection and use of public lands. She and a group of other concerned citizens had passed around a petition stating their position and asking for several specific actions. Mrs. Hill presented the petition, which she said had some 200 signatures, and asked the Council to take action on its requests. The petition stated: "We the undersigned residents of Fairhope request that the Council of Fairhope take immediate action to see that all public park land and beach access areas are clearly and permanently marked so that all citizens will know where these areas are and be able to use them. We further request that the Council take whatever action is necessary to protect the natural bluffs and gullies and other fragile areas from damage by private property owners. It is urged that any request for a variance be considered only after a public hearing which has been duly publicized." The Mayor thanked Mrs. Hill and her group but the Council took no action. Mrs. Hill was promised that the requests will come up for action at the next regular session. Mayor Nix announced that a Town Clock fund has been established and donations are being accepted. This fund was established by Mrs. Lawrence Curtis Tuck to honor the memory of her late husband, Laurie, who's wish was to see a tall clock at the corner of Fairhope Avenue and Section Street. The clock will be an eleven -foot tall, double-faced, courtyard clock that will strike on the hour and also have a Westminister chime. It is hoped to have the clock installed on the Fairhope/Section corner by Christmas. 13 November 1990 1148 The recycling bins have not yet arrived, but they are expected by December. The recycling pick-up is planned to begin on November 26th. Mayor Nix mentioned November 13th is Retired Teachers Day in Fairhope. Councilwoman Puckett moved to pay bills as presented. Seconded by Councilman Ford, motion passed unanimously. There being no other business, meeting was duly adjourned at 6:03 pm. Nix, Mayor ity C 0 r
