COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular
session at 5:30 pm; Fairhope Municipal Complex Council
Chamber; 161 N. Section ; Fairhope, Alabama 36532; on
Monday, 22 October 1990.
Present were Mayor James P. Nix; Councilmembers Roy
C. White, Jeanette Puckett, David E. Bishop, John Duck,
and Michael A. Ford. City Attorney Marion E. Wynne and
Acting City Clerk Betty Rivenbark.
There being a quorum present, Mayor Nix called the
meeting to order. Minutes of 8 October 1990 regular session
were duly approved.
A public hearing, was held regarding a dangerous
building at 207 Magnolia Avenue, property owned by the
FSTC leased to James Toler. Mr. Toler had been notified
that under Ordinance 860 he had a dangerous building and
it would be condemned by the City and he would have to
have it removed or the city would remove it and bill
him for this. Bob Lunsford told the Council that he had
written Mr. Toler on August 22nd and tonight's hearing
is to hear Mr. Toler. Before presenting his explanation
to the Council Mr.Toler,Mr.Gordon & Mr..Lunsford took .an oath
to tell the truth, administered by the City Attorney.
Mr. Toler related his intention to sell the property
but if the building is removed as far as the FSTC is con-
cerned he will have no improvements on the property.
The electrical part of the house has been corrected. Curtis
Gordon who was present with Mr. Toler spoke to the Council
saying he is working with Mr. Toler to buy the property and
build his personal home there. That he has another person
interested in one-half of the property who also wishes to
build a residence there. The Mayor asked how much more
time is needed to get their deal worked out with the FSTC.
Councilman Ford asked Mr. Gordon if he had a sale pending
and he said yes, him. Councilwoman Puckett asked.Mr. Gordon
about the electric problem and he said it had been taken care.of.
Councilman White said he had talked with Mr. Gordon for at
least two years now asking him to at least cut the grass or
trim back the cudzu and so far he has done nothing, the roof
is falling in and the windows have been broken out; why
should we delay condemnation now? Mr. Gordon went over the
deals he had tried to work out over the past two years with
Mr. Toler, but nothing had worked out. It was suggested
going ahead with the condemnation procedure, which will
give them another 30 days to work things out, and at the
end of that time see where they stand. Councilman Bishop
moved that the condemnation procedure proceed as planned,
John Duck seconded and motion carried unanimously.

Council reviewed an application for a Restaurant Liquor
License by Van Tran dba Twin Oaks Restaurant. Mr. Tran
is moving his restaurant to a new location best described
as between Mike Ford Realty and the Grand Hotel on Hwy 98.
No one present was opposed to his license and there was
police approval of the applicant. Councilman Ford said
he will probably be the most affected by this and he
sees nothing wrong with it, he further moved for approval
of application, John Duck seconded and motion carried unan-
imously.
Councilman Duck introduced and moved for the adoption of
the following resolution. Seconded by Councilwoman Puckett
motion passed unanimously:

BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE
ALABAMA, That Judge Phyllis Nesbit is hereby appointed to
serve as MUNICIPAL JUDGE, in the absence of Judge James
Smith, only for Court Session on 7 November 1990.

Councilman White introduced and moved for the adoption of
the following resolution. Seconded by Councilwoman Puckett
motion passed unanimously:

by all city personnel except emergency employees:

Councilman Ford discussed with the Council a request from
the Recreation Board to go out on bids using funds in the
Recreation Improvement Account for a gang mower. Council-
man Ford asked Gen Supt. Rutherford how old the present
mower is and he replied 13-14 years. Mr. Rutherford further
said that depending on what funds were available, he
would like to get either a 3 or 5 gang mower, the difference
being about 4,000 in cost. Councilwoman Puckett moved that
authorization be given to go out on bids for a 3 and 5 gang
mower to be bought out of Recreation Improvement Funds.
Councilman Ford seconded and motion passed unanimously.
Councilman Ford stating that he knew the Council was wait-
ing for results on the survey, was asking if the Council
is now ready to take some action regarding the re -cycling
report that the re -cycling committee submitted August 27,
1990 with their recommendations, get a target date to get
the program going. Mayor Nix reported the survey results
said that people wanted curbside service and voluntary
not mandatory, at inception. But that when the state re-
quires it we will have to make it mandatory but that we
hope the response will be such that the program will
carry itself. That we will not charge, but pickup will
be once a week on trash day. After a couple of months
we will know whether or not we will have to charge.
Councilman Ford read the committee recommendations(copy
on file). Mayor Nix said that a letter will be sent to
all households explaining how they should collect the
items to be re -cycled and we need the assistance of the
media. Mayor Nix also mentioned that we will be running
an ad in the newspaper with bins for sale, that this is
optional. Councilman Ford mentioned that he wished to
stress that he was not trying to get people to stop taking
paper and cans to churches and schools, that they still
need them too, and that the City has been re -cycling with
their mulch program. The middle of November was mentioned
as when we hope to get started. That we already have bought

a truck but we are having to add the bins to it. That
we will be taking paper, aluminum, glass and plastics
and be using one end of a storage shed at the warehouse
where we will store everything until we get enough to
take over. Mayor Nix said that the citizens could use
garbage cans and we will furnish them a sticker to be
put on them if they do not want to purchase the bins.
That the bins will be for sale at our cost $16.50 for
a set of 3, or if you only wish to purchase 1 or even
2 the cost will be $5.50 each. Councilman Bishop moved
to proceed with the project, to include the purchase of
1,000 containers and the cost of advertising. Council-
woman Puckett seconded and motion carried unanimously.
Councilman Ford mentioned to the Mayor and Council that
he would like them to be thinking about a City museum.
That it has been discussed briefly from time to time,
and was talked about when the City bought old Organic
campus. That we will have our 100th celebration in 1994
and that the town is still young enough to draw from
local historians. That he has the 1st ball driven at
the golf course, although it doesn't mean anthing now,
in 20-25 years it will be history. That Fairhope is a
unique town and it is a shame if we don't organize and
gather information, let people come forth with ideas.
Mayor Nix said he thought we should get some people
who would like to work on it, get it out to the public
for some ideas and input, he said that the citizens
could either call him or Mike Ford if they have something
to offer.
Council took the following action on bids:

Mayor Nix mentioned that we will get 700 on this from FEMA
as this was storm damage that we are repairing. It is the
recommendation of the Gen. Supt. Rutherford that we go with
J.E. Harris Co, Inc. of Mobile, the apparent low bidder.
Councilman White questioned why we couldn't go with local
bidder. Mayor Nix said we could but FEMA will only pay on
low bidder. Councilman Bishop moved to accept low bid
provided it meets specifications. Councilwoman Puckett
seconded and motion carried unanimously.

Mayor Nix gave the results of the survey, saying that
out of 3400 mailed out we got 1710 back or 50.3% returned
which he feels was real good response:

Mayor Nix thanked the citizens for responding so well and
remarked about the areas that we will be working on as
suggested by the survey, one big one being dogs and also cats.
Shep Shepard spoke from the floor complimenting the city on
the fast paving job and the wonderful way it was handled,
that it looks real good.
Councilman Ford reminded the Council and public that Wednesday
there would be a program at the pier sponsored by the Ministerial
Association.
Councilman Bishop mentioned that he would like the Council
to consider Project Share a program by Ecumenical Ministries
that he has information on and he will get a copy to Council
for consideration at the next Council meeting.
There being no further business, meeting was duly adjourned.
