The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 8 October 1990.
Present were Mayor James P. Nix; Councilmembers Roy C.
White, Jeanette Puckett, David E. Bishop, Michael A. Ford,
and John V. Duck; City Attorney Marion E. Wynne and City Clerk
Evelyn Phillips. No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 24 September 1990 regular session
were duly approved.
A public hearing, as requested by property owner Robert
P. Janssen, was held to hear Mr. Janssen's request regarding
his situation under Ordinance No. 860 (Dangerous Buildings).
Mr. Janssen has two buildings, a main building and an accessory
building, at 458 Equality Street which have been declared dan-
gerous by Building Official Bob Lunsford. The citation gave
Mr. Janssen 60 days to demolish the buildings, which time will
expire in approximately 15 more days. Before presenting his
request to the Council, both Mr. Janssen and Mr. Lunsford took
oath to tell the truth, administered by City Attorney Wynne.
Mr. Janssen said he would like permission to demolish only
the main building and leave the accessory building as a mat-
erials storage building until he could rebuild the main building.
He also advised that he was donating the main building to the
Volunteer Fire Department for destruction (by burning) on the
13th of October. When questioned as to when he planned to
have the new building complete (and the accessory building
removed), Mr. Janssen admitted he did not yet have plans drawn
for the new building. Concern about the safety of the neighbor-
hood and the surrounding trees, during the destruction by fire
of the main building, was immediately brought forth by members
of the council and audience. After further discussion, Council-
man White moved to deny Mr. Janssen's request, to refuse to allow
any burning of a building, and to proceed with the removal
of the buildings as per Ordinance No. 860 as cited by the Building
Official. Seconded by Councilwoman Puckett, motion carried
by the following vote: AYE -White, Puckett, and Bishop. NAY -
Ford. ABSTAIN -Duck.
A public hearing on the following CDBG resolution was held
as advertised. No one present objected or commented on the
resolution, which was requested by ADECA as a formal closing
of 1988 Community Development Block Grant used to partially
pay for utility service to the Fairhope Industrial Park. The
Resolution was introduced, with a motion to adopt, by Councilman
Ford. Seconded by Councilman Duck, motion passed unanimously:

WHEREAS, the City of Fairhope made application for and received a
Community Development Economic Infrastructure Grant (Project No.
LR-ED-PF-88-024) from the Alabama Department of Economic and Com-
munity Affairs for the partial financing of sanitary sewer and
other utilities to serve Fairhope Industrial Park and principally
Rohr Aero; and
WHEREAS, the project has been completed as planned and is ready
to be closed out, except for a technical modification concerning
employee beneficiaries at Rohr Aero and R.U.S.; and
WHEREAS, regulations and policies of the Alabama Department of
Economic and Community Affairs require that a formal amendment be
made and approved when there is reduction in the number of bene-
ficiaries for a Community Development Block Grant Program.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairhope as follows:
Section 1. That the City of Fairhope formally amend Community
Development Economic Development Infrastructure Project No. LR-
ED-PF-88-024, a summary of such amendment follows:

FORMAL AMENDMENT NO. 1
The above referenced project was funded to provide partial
financing for the installation of needed utilities at the
Fairhope Industrial Park (Fairhope Municipal Airport) to princi-
pally acccommodate the new expansion building for Rohr Aero. The
project was funded and deemed appropriate by the Alabama Depart-
ment of Economic and Community Affairs as it would result in re-
taining the 45 employees that were employed as of July, 1988, and
result in the creation of 32 new positions.
Project eligibility was based on knowledge and predictions
that a minimum of 51 percent of retained and new jobs would be
occupied by persons from households of low -and -moderate income.
However, the majority of the 45 employees that were employed as
of July, 1988, were paid salary levels at that time by Rohr Aero
that took them out of the low -and -moderate income categories by
household size. These employees were hired originally under the
Alabama Development Office Job Training Program, and would have
been eligible at that time, and, without the expansion program
addressed by this project, would have been unemployed again.
Rohr Aero requested each employee to complete household in-
come certifications. These were completed by category of employ-
ees hired prior to July, 1988 and employees hired subsequently.

As a result of the project implementation Rental Uniform
Services built a plant at the Fairhope Industrial Park that cre-
ated 11 new full time positions. At the request of the City of
Fairhope, RUS requested income certifications from its employees.
The results follow:

Since RUS was not a part of the grant agreement and did not
sign the letter of understanding, their cooperation and the coop-
eration of their employees was strictly voluntary.
Therefore, the project resulted in a net gain in employment
from Rohr Aero and RUS combined of 41 new positions. Of this
number certifications from a sample of 36 employees (87.8%) re-
sulted in the following income computations:

Therefore, this amendment results in the deduction of the 45
retained positions from consideration, and bases project eligi-
bility on new employment that has been documented. Thus the pro-
ject meets the DHUD national objective of principally benefitting
low -and -moderate income persons.
Had the City of Fairhope known the income of employees of
Rohr who were to be retained the project would not have consid-
ered them as beneficiaries, but rather, relied on the new employ-
ment benefit that it was to produce. Current policy requires in-
come documentation of employees to be retained prior to project
approval, which was not the case in 1988.

Section 2. That James P. Nix, in his capacity as Mayor, is
hereby authorized and directed to submit said amendment and other
required supporting data to the Alabama Department of Economic
and Community Affairs for review and consideration.
Section 3. That upon approval of said amendment, actions be un-
dertaken to close out said project.

Councilman White introduced, and moved for the adoption
of, the following resolution. Seconded by Councilman Duck,
motion passed unanimously:
RESOLUTION NO. 323-90
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, That
The proposed Budget presented and reviewed this
8th day of October, 1990, be hereby approved and
adopted for FY 1990-1991; and
BE IT FURTHER RESOLVED that the Annual Salaries of
City Personnel shall be as shown on a list entitled
"Annual Salaries of All City Personnel - Res.No. 323-90";
said list filed in the Office of the City Clerk, and
of the Personnel Director; and
BE IT FURTHER RESOLVED that the Mayor be authorized to
enter into a contract with the Eastern Shore Chamber of
Commerce to promote the City of Fairhope. The contract
shall be for one (1) years, 1 October 1990 to 30 September 1991,
but may be cancelled at any time. Contract shall call for
a payment to the Eastern Shore Chamber of Commerce of $100.00
per month from the General Fund and $100.00 per month from
each of the Utility Funds; or $4,800 for the one year term.

Council reviewed a petition for annexation by Mrs. Marjorie
K. Thames. Her property, 1.39 acres more or less, is located
south of the City on the east side of US 98 (Greeno Road).
The property will be zoned as currently zoned by the County,
R6 Trailer Park. Councilman Bishop introduced an ordinance(867)
to annex as requested. In order to take immediate action,
Councilman Ford moved to suspend the rules. Seconded by
Councilman White, motion to suspend passed unanimously
by the following vote: AYE -White, Puckett, Nix, Ford, Bishop,
and Duck. NAY - none. Councilman Bishop then moved for
final adoption of Ordinance No. 867. Seconded by Councilman
Ford, motion to final adopt passed unanimously by the following
vote: AYE -White, Puckett, Nix, Bishop, Ford, and Duck.
NAY - none.
Mayor Nix announced that next week will be observed as
Fire Prevention Week in Fairhope. The Volunteer Firemen
will be visiting area schools to give fire safety talks and
demonstrations.

Councilwoman Puckett moved to hear the following business
not on the Agenda. Seconded by Councilman Duck, motion passed
unanimously:
The water well that is part of the project nearing completion
(well, water tank, and sewer lines) has tested out as a
700,000 gals/minute well instead of the 750,000 gals/minute well
as planned. The Alabama Department of Environmental Management(ADEM)
has approved this lower -rated well for our project. Our
consulting engineers, Moore Engineering, recommends acceptance
of the lower -rated -flow well. So moved by Councilman White.
Seconded by Councilman Bishop, motion passed unanimously.
Mayor Nix advised a truck had been obtained from the state
surplus agency and is being renovated for use in the Recyclable
Program which will get underway in the near future.
Councilwoman Puckett moved to pay bills as presented. Seconded
by Councilman Duck, motion passed unanimously.
There being no other business, meeting was duly adjourned
at 6:00 pm.
