HomeMy WebLinkAbout09-24-1990 Regular Meeting1129 STATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 N. Section Street; Fairhope, Alabama 36532; on Monday, 24 September 1990. Present were Mayor James P. Nix; Councilmembers Roy C. White, Jeanette Puckett, Michael A. Ford, John Duck and David E. Bishop; City Attorney Marion,Wynne and Acting City Clerk Betty Rivenbark There being a quorum present, Mayor Nix called the meeting to order. Minutes of the September 10 1990 reg- ular session were duly approved. Councilman Duck moved for final adoption of Ordinance No. 863, an ordinance to rezone block of parcels from Residential to Local Shopping. Block located south of Delamare Street, East of Church Street and north of Fels Avenue. Seconded by Jeanette Puckett, motion passed unanimously. Councilman David E. Bishop moved for final adoption of Ordinance No.864 an ordinance to annex property of R.B. Bagley, approximately 1.58 acres, southwest of the City on the west side of south Mobile Avenue. John Duck seconded the motion, and it passed unanimously. Councilmember Jeanette Puckett moved to finally adopt Ordinance No. 865, an ordinance to annex property of CET Enterprises, Inc., approximately 13.11 acres, south of the City on the east side of Greeno Road. Councilman Mike Ford seconded the motion and it passed unanimously. Councilman John Duck introduced Ordinance No. 866, an ordinance which will annex Fairhope Memory Gardens, Inc. approximately 17.139 acres, south of the city on the east side of Greeno Road. In order to take immediate action, Councilman. Bishop moved to suspend the rules. Seconded by Councilmember Puckett motion to suspend passed unanimously by the following vote: AYE - White, Puckett, Bishop, Duck, and Ford. NAY - none. Councilman Duck then moved for final adoption of Ordinance No. 866. Seconded by Jeanette Puckett, motion to finally adopt passed unanimously by the following vote: AYE - White, Puckett, Bishop, Ford and Duck. NAY - none. At this time the Mayor mentioned that we needed to make an amendment to the budget, that we had made major purchases one being when we bought new trucks. Councilman Bishop moved to amend as needed. Councilman Duck seconded and motion carried unanimously. 24 September 1990 1130 Council reviewed bids on resurfacing of Section Street. They had one bid from Hosea Weaver & Sons, Inc. for a total of $62,455.00 which included bituminous treatment, setting manholes, painting and clipping road and putting on a tack coat(all services needed to complete project) The mayor remarked that there are few companies which can perform all these services, provide everything but asphalt. This project would run from Hwy 104 to Fels Ave. Councilman Roy White moved to accept the bid presented. Councilmember Puckett seconded and motion carried unani- mously. Along with this project, the Mayor mentioned that he needed authorization to purchase under the state bid price 750 tons of asphalt at $19.00 a ton. Councilman Bishop moved this authorization be given. Councilman Duck seconded and motion carried unanimously. The mayor mention- ed that this project would run approximately $137,455 for the work and asphalt. The Mayor also reassured the council and merchants that this work would be finished by the end of October and that they would try to keep one lane on Section Street open at all times. Councilman Ford moved to hear the following business not on the agenda. Seconded by Councilman Duck, motion passed unanimously: Bids had been opened on Perennial Ryegrass Seed for the Golf Course(for yearly overseeding of golf course) and were as follows: Vendor Amount Delivery Terra International $5,950.00 4 Days Alt. Bid 5,845.00 LESCO 5,740.00 Beard Equipment Co. No Bid Green Seed Co. 6,440.00 30 Days Turf Seed, Inc. 8,050.00 9 Days Gulf Shore Turf 6,300.00 20 Days Tieco 5,600.00 7 Days It was the recommendation of the purchasing agent to accept Tieco(low bid) with all specifications being met. Council- man Duck moved to accept low bid as recommended. Council - member Puckett seconded and motion carried unanimously. Airport Board Chairman Sue Mason reported to Council that at the last two meetings of the Board they had been considering a request from Coastal Air Transport/Pete Douglas for a second fixed base operation at the Fairhope Municipal Airport and he would be offering several services that are not presently available that after review and con- sideration that the Board recommends to the Council approval of his request as second general fixed base operator subject to him meeting all the minimum standards, verification of certain information and establishment of mutual ground rent. 24 September 1990 1131 Councilman Duck questioned whether or not buildings were already there. They are not there now but there is plenty of room to build on. Councilman White moved to accept the recommendation as made subject to any informa- tion that the City Attorney might receive from the FAA and subject to all conditions mentioned by Mrs. Mason. Councilman Duck seconded and motion carried unanimously. Councilman Ford asked if he would be exclusive and the Mayor pointed out that no, it was intent of .FAA by having a second FBO to not have an exclusive operation at municipal airports. Robert Gilpin addressed the Council, stating he has been a resident for 15 years and that he has heard a rumor that there is a prospect for possible development in Stack's Gully. That he would like to know if this is true and what information is available regarding this. Mayor Nix told him that there has been a tentative proposal from someone who might be interested in developing a portion of the gulley, but that it has not been considered as we do not know what we can do regarding the use of the gully. Mr. Gilpin said that these gullys were dedicated parkland property, would development be possible. Mayor Nix said we do not have an official request, but if and when a proposal received by the city it would be fully discussed and the public made aware of it. Mr. Gilpin asked if the Single Tax had the ability to change this from parkland. Mayor Nix said he did not know at this point but he could assure him that he will have the opportunity to voice opinion and know of the information if/when available. The Mayor mentioned that he had several calls regarding fishermen using the big nets in the bay and that they were hurting the mullet fishermen on the piers. That in contact with the conservation department there is nothing that can be done. It was pointed out that if they have licenses that they can operate as they are. The conservation de- partment would be the place to register a complaint. The Mayor also mentioned that there might be a mis- understanding on the disposal of leaves and limbs, that they do not have to be placed in containers. He was asking the media's support in running this information again. The mention of October 7-13 being Public Power Week with over 200 agencies observing this was made by the Mayor and•that he will be proclaiming this in Fairhope as well.
