The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday. 27 August 1990.
Present were Mayor James P. Nix; Councilmembers Roy C.
White, Jeanette Puckett, David E. Bishop, Michael A. Ford,
and John V. Duck; City Attorney Marion E. Wynne and City Clerk
Evelyn Phillips. No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of 13 August 1990 regular session were duly
approved.
Councilman Duck moved for final adoption of ORDINANCE
NO. 861, introduced at the last regular session, to amend Zoning
OrTinance Sections 7.145.01 (landscaping) and 7.851(2) (tem-
porary signs). Seconded by Councilwoman Puckett, motion passed
unanimously.
Councilwoman Puckett moved for final adoption of ORDINANCE
NO 862, introduced at the last regular session, to establish
a Municipal Offense Ticket. Seconded by Councilman Duck,
motion passed unanimously.
Council reviewed the following bids FOR TWELVE 25KVA
TRANSFORMERS FOR THE ELECTRIC DEPARTMENT:

RESOLUTION NO. 318 - 90
Pursuant to action of the Council on 11 June 1990 accepting the
low bid of $122,513.66 for two sanitation trucks from Ward
International Trucks of Mobile, Alabama:
Resolution Relatinq to Lease with Option to Purchase
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE (the
Issuer), AS FOLLOWS:
SECTION 1. Recitals and Authorization. The Issuer, as Lessee, has
heretofore entered into a Lease with Option to Purchase Agreement
dated 26 June 1990 (the Lease), with GELCO FINANCE CORPORATION, as
Lessor. It is hereby determined that it is necessary and desirable
and in the best interests of the Issuer to enter into the Lease for
the purpose of obtaining the Equipment shown on the Lease as Equip-
ment A-, and the execution and delivery of the Lease by the Issuer
are the financing of the acquistion of such Equipment Group are hereby
approved, ratified and confirmed.
SECTION 2. Designation as Qualified Tax -Exempt Obligation. Pursuant to
the Internal Revenue Code of 1986 as amended the Code), the Issuer
hereby specifically designates the Lease and Equipment Group A- as a
"qualified tax-exempt obligation" for purposes of Section 265 of the
Code. The Issuer hereby represents that the Issuer will not designate
more than $10,000,000 of obligations issued by the Issuer in the cal-
endar year during which the lease is executed and delivered as such
"qualified tax-exempt obligations."
SECTION 3. Issuance Limitation. The Issuer hereby represents that the
Issuer reasonably anticipates not to issue in the calendar year during
which the Lease is executed and delivered, obligations bearing interest
exempt from federal income taxation under Section 103 of the Code (other
than "private activity bonds" as defined in Section 141 of the Code)
in an amount greater than $10,000,000.
ADOPTED THIS 27TH DAY OF AUGUST, 1990.

Building Official Bob Lunsford reported to Council on
actions taken under Ordinance No. 860, Dangerous Buildings.
Notices to vacate have been sent to the owners of buildings
located at 458 Equality, 207 Magnolia, 414 Volanta, and
618 Young Street unless dangerous conditions are corrected.
Mr. Lunsford requested Council to suspend business licenses
and utility services to two of these buildings: 618 Young
Street, Rachel Trent Lett dba THE STARLIGHT CAFE; and
458 Equality, Robert P. Janssen dba TRACKSTAR. So moved
by Councilman White. Seconded by Councilman Duck, motion
passed unanimously.
Councilwoman Puckett moved to update the Volunteer Firemen's
Roster, for insurance purposes, by DELETING Mike Bass, Les
Bung, Jerry Fulton, and Larry Odom; and by ADDING John Keller,Jr.
and Joey Henderson. Seconded by Councilman Bishop, motion
passed unanimously.
Councilman Ford, Chairman of the Fairhope Municipal
Waste Management Advisory Committee, made a report and pre-
sented a written list of recommendations to Council on a
recycling program. The recommendations will be taken under
advisement for possible future implementation. The Committee,
consisting of Mr. Ford, Councilman Bishop, Cindy McBrearty,
Bishop George Murray, Caroline Bates Hoffman, Phil Rutherford,
and Deborah Jessup, was commended and thanked for their
hard work and a good job.
Meeting was duly adjourned at 5:53 pm.
