The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Tuesday, 29 May 1990.
Present were Mayor James P. Nix; Councilmembers Roy C.
White, David E. Bishop, and Michael A. Ford; and City Clerk
Evelyn P. Phillips. Absent were Councilmembers Jeanette
Puckett and Barney L. Shull; and City Attorney Marion Wynne.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 14 May 1990 regular session were
duly approved.
Before beginning agenda business, Mayor Nix asked Mr.
Les Bung to come forward for a special presentation. The
Mayor then presented Mr. Bung with a plaque expressing the
City's appreciation for his service as a Volunteer Fireman.
Mr. Bung has retired from the Volunteers after twenty-eight
years. Fire Chief Tim Kant also made a presentation to Mr.
Bung from the Volunteers of a second plaque and a certificate
for dinner for two. Approximately 17 Firemen were present
for this special recognition.
Council took the following action on bids opened by the
purchasing department:
FIBER OPTICS BID:
Since only one bid was received, Councilman Bishop moved
to reject the bid and ask for rebids. Seconded by Councilman
Ford, motion passed unanimously.

Councilman Bishop moved to accept the bid by Ditch Witch
ofMobile. Seconded by Councilman White, motion passed
unanimously.

As recommended, Councilman Ford introduced, and moved for the
adoption of, the following resolution. Seconded by Councilman
Bishop, motion passed unanimously:
RESOLUTION NO. 309-90
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, That Mayor James P. Nix is here-
by authorized to execute a contract between the CITY
and KEMKO, INC., DAPHNE, ALABAMA, for a 601x60' steel
building with a 201x60' lean-to, as per bid specifi-
cations, for the amount of $47,979.00.
ADOPTED THIS 29th DAY OF MAY, 1990.

As Council began their review, it became apparent that the
specifications for this bid did not match what the Council
wanted. Councilman Bishop pointed out that the first alter-
nate bid should have been for two garbage pickups per week
with recyclables being picked up on the second run. There
was some confusion about "bins" and one bidder had inserted
an escalation clause on the second and third years. After
discussion, Mayor Nix suggested taking the bids under advise-
ment for study before taking any action. So moved by Council-
man White. Seconded by Councilman Ford, motion passed
unanimously.
Meeting was duly adjourned at 5:45 pm.
