HomeMy WebLinkAbout04-09-1990 Regular Meeting1090 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday, 9 April 1990. Present were Councilmembers Roy C. White, Jeanette Puckett, David E. Bishop, Michael A. Ford, and Barney L. Shull; City Attorney Marion Wynne and City Clerk Evelyn Phillips. Mayor James P. Nix was absent. Mayor Pro Temp Roy C. White presided in the absence of Mayor Nix. There being a quorum present, Mayor Pro Temp White called the meeting to order. Minutes of the 26 March 1990 regular session were duly approved. Councilman Bishop moved for final adoption of ORDINANCE NO. 854, an ordinance introduced at the last session, amending Fairhope Code Sections 12-11, 12-12, and 12-13 having to do with abandoned vehicles. Seconded by Councilman Shull, motion passed unanimously. Councilwoman Puckett introduced, and moved for the adoption of, the following resolution. Seconded by Councilman Shull, motion passed unanimously: RESOLUTION NO. 306-90 DESIGNATION OF APPLICANT'S LOCAL AGENT BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, That PHILLIP RUTHERFORD, General Superintendent, PO Drawer 429, (205) 928-2136, Fairhope, Alabama 36533, is hereby authorized to execute for and in behalf of the City of Fairhope, Alabama, a public entity established under the laws of the State of Alabama, this application and to file it in the appropriate State office for the purpose of ob- taining certain Federal financial assistance under the Disaster Relief Act (Public Law 100-707) or otherwise available from the President's Disaster Relief Fund. That the City of Fairhope, Alabama, a public entity established under the laws of the State of Alabama, hereby authorized its Agent to provide to the State and to the Federal Emergency Management Agency (FEMA) for all matters pertaining to such Federal disaster assistance the assurances and agreements as required. Seconded by Councilman Shull, motion passed unanimously: RESOLUTION -NO. 307-90 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE ALABAMA, AS FOLLOWS: That it is the intention of the CITY OF FAIRHOPE to partic- ipate with the County Commission of BALDWIN COUNTY, ALABAMA, in the area of solid wastes; due to the ever increasing dictates and requirements of ADEM and EPA and the especially demanding requirements of ACT NO. 89-824 which will impact not only the County but every municipality therein. ADOPTED THIS 9TH DAY OF APRIL, 1990. " - • 1% Ja s P. Nix, Mayor l/J City yperk Council reviewed a Beer Off -Premises License application by Gary Cox, dba THE GAS-N-GO station at 303 North Section Street. No one present was opposed to the license. There was police approval of the applicant. Councilman Shull moved to approve the issuance of the license. Seconded by Councilwoman Puckett, motion passed unanimously. Chief Tim Kant, Volunteer Fire Department, requested approval of approximately $3,000.00 for expenses of sending men to the annual Fire School. Councilman Bishop moved for approval. Seconded by Councilman Ford, motion passed unanimously. Councilwoman Puckett moved to approve the transfer of $14,000 from the Recreation Improvement Fund to the Recreation Operating Fund as requested by the Recreation Board. Seconded by Councilman Ford, motion passed unanimously. Councilman Ford moved to pay bills as presented. Seconded by Councilman Shull, motion passed unanimously. Ack Moore, Harmon -Moore Engineering Associates, reported that the smoke testing of sewer lines is going well. Meeting duly adjourned
