The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday. 26 March 1990.
Present were Mayor James P. Nix; Councilmembers Roy C. White,
Jeanette Puckett, David E. Bishop, Michael A. Ford, and
Barney L. Shull; City Attorney Marion Wynne and City Clerk
Evelyn P. Phillips. No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 12 March 1990 regular session were
duly approved.
Ms. Kolleen Crandall gave a report on the March 16th week-
end Arts & Crafts Festival. Although Friday's plans were
wiped out by heavy rains, Saturday and Sunday saw approximately
203,000-40,000 visitors. One of the special posters, suitably
framed, was presented to the City.
Council reviewed the 1988-1989 Annual Audit Report, prepared
by S. F. Parker & Company. The report shows an increase in the
City's assets to $34,563,131 over the previous year's $31,177,653.
The General Government's revenues were $3,080,670 over expenses
of $3,014,768. All enterprises revenues were $9,419,566 over
expenses of $8,890,204. The auditors gave our accounting
practices the highest rating possible, and offered no suggested
accounting practice changes. Councilwoman Puckett moved to accept
the audit. Seconded by Councilman White, motion passed unanimously.
Councilmen Ford and Shull presented a request from the City's
Recreation Board concerning the transfer of approximately eight
acres of land known as the Young Street Playground & Recreation
Center (owned by the City) to Baldwin County. The Board makes
this request based on information provided to them that a grant
is available for improving the property to Alabama Counties but
a County must own the property in order to apply. The property
is located outside the City Limits. After discussion, Councilman
Ford moved to authorize the City Attorney to check into the matter
and prepare the necessary legal paperwork involved in conveying
the property to the County, with a reversion clause returning
the property to the City should it cease to be used only as a
public park. Seconded by Councilman Shull, motion passed
unanimously.
Councilman Bishop introduced an ordinance to amend Sections
12-113, 12-12, and 12-13 of the Fairhope Code of Ordinances having
to do with definitions and enforcement duties concerning abandoned
vehicles. This ordinance will be given final consideration at
the next regular council session.

It is recommended to accept the low bid of $35,132.00 by
M$I Ford Tractor Company as all specifications are met.

Councilman Shull moved to accept the low bid by M&I Ford Tractor
Company, provided all specifications are met. Seconde by
Councilwoman Puckett, motion passed unanimously.

Approximately 11,670 pounds will be needed determined by
atmospheric conditions. It is recommended to accept the bid

Councilman White moved to accept the bid by Bentz Entec, Inc.,
provided all specifications are met. Seconded by Councilman Ford,
motion passed unanimously.
Mayor Nix advised Council that Don Smith had resigned from
the Recreation Board. A resolution of appreciation for Mr. Smith's
long service will be prepared and sent to him.

Councilman Shull moved to hear the following business not
on the Agenda. Seconded by Councilman Bishop, motion passed
unanimously:
The floor was opened for nominations to complete Mr. Smith's
unexpired term on the Recreation Board. Councilman Shull nom-
inated Charlie Langham. There being no other nominations, _.
Councilman Bishop moved to close the nominations and appoint
Mr. Langham. Seconded by Councilwoman Puckett, motion passed
unanimously.
Fire Chief Tim Kant asked that people answer their plea
for donations to the Volunteer Fire Department. The Department
is using mail requests instead of door-to-door calls this year.
Mayor Nix advised that the City is accepting donations of
clothing, non-perishable foodstuff, sanitary supplies, etc., at
the Civic Center parking lot this week for distribution to
flood victims in the Elba and East Brewton area.
Meeting was duly adjourned at 5:45 pm.
