HomeMy WebLinkAbout11-13-1989 Regular Meeting1062 STATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in at 5:30 pm; Fairhope Municipal Complex Council 161 North Section Street; Fairhope, Alabama; on Monday, 13 November 1989. regular session Chamber; Present were Mayor James P. Nix; Councilmembers Roy C. White, Jeanette Puckett, David E. Bishop, Michael A. Ford, and Barney L. Shull; City Attorney Marion Wynne and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 23 October 1989 regular session and the 6 November 1989 special session were duly approved. As ad w rtised, a public hearing was opened on a proposed ordinance to annex and zone approximately 814 acres of land east of the present city limits as requested by the property owner, the Fairhope Single Tax Corporation. The Planning & Zoning Commission recommends approval. Councilman Shull introduced Ordinance No. 846 to annex and zone the property. In order to take immediate action, Councilwoman Pucke+t moved to suspend the rules. Seconded by Councilman Ford, motion to suspend rules passed unanimously by the following vote: AYE - White, Puckett, Nix, Bishop, Ford, and Shull. NAY - none. Councilman Shull then moved for final adoption of Ordinance No. 846. Seconded by Councilman Bishop, motion to final adopt passed unanimously by the following vote: AYE - White, Puckett, Nix, Bishop, Ford, and Shull. NAY none. The Volunteer Fire Department reported they have received three bids on an old 1962 Pumper (#921) Truck:- $10,000 by Pine Grove Volunteer Fire Department, $4,005 by the Marlowe Volunter Fire Department, and $2,013.98 by the Bel Forest Volun- teer Fire Department. They requested approval to sell the truck to the highest bidder. Councilman Ford moved to approve the sale to Pine Grove Volunteer Fire Department for $10,000. Seconded by Councilman Shull, motion passed unanimously:: 13 November 1989 1064 RESOLUTION NO. 297-89 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE THAT THE FOLLOWING 1989 HOLIDAYS WILL BE OBSERVED BY ALL CITY PERSONNEL EXCEPT EMERGENCY EMPLOYEES: THANKSGIVING - THURSDAY & FRIDAY, NOVEMBER 23 & 24 CHRISTMAS - MONDAY $ TUESDAY, DECEMBER 25 & 26 NEW YEARS DAY - MONDAY, JANUARY 1 BE IT FURTHER RESOLVED THAT THE SCHEDULED COUNCIL MEETINGS FOR THE REMAINDER OF NOVEMBER AND FOR DECEMBER, 1989, ARE HEREBY RESCHEDULED AS FOLLOWS:. Seconded by Councilwoman Puckett, motion passed unanimously:. 13 November 1989 1065 RESOLUTION NO. 298-89 WHEREAS, Baldwin County is in need of a licensed detention facility to service juveniles, a problem this county has been addressing since May of 1982; and WHEREAS, Federal law forbids any juvenile to be placed in adult jails, and law enforcement has no place to incarcerate juvenile offenders in Baldwin County; and WHEREAS, The Baldwin County budget includes $70,000.00 for detention in other places of the state for said juveniles, and additional cost is incurred in transportation and manpower;and WHEREAS, The Juvenile Judge must be accessible twenty-four hours a day in order to place a juvenile in custody because there is no local juvenile detention facility; and WHEREAS, Surrounding counties have similar problems and have in- dicated a desire to procure detention space from Baldwin County, thereby designating such a facility as a regional center for Southwest Alabama and qualifying said facility for state funding; THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, That the Mayor and Council of the City of Fairhope hereby urge that a Regional Juvenile Detention Facility be constructed in Baldwin County at the earliest possible date; and BE IT FURTHER RESOLVED That they support the introduction by the Baldwin County Legislative Delegation and adopt&on by the Alabama State Legislature of a local act which would increase court costs by ten ($10.00) dollars on the following cases: Baldwin County District or Circuit Court felony, misdemeanor, violation and traffic cases, Baldwin County Municipal Court misdemeanor, violation and traffic cases and Baldwin County Juvenile Delinquency and Children in Need of Supervision cases excluding routine parking tickets with said legislation to provide that proceeds of said additional court costs be used exclusively to provide for the operational expenses of the Juvenile Detention Facility and such other purposes which benefit the Baldwin County Juvenile Justice System. ADOPTED THIS 13th DAY OF NOVEMBER, 1989. Councilwoman Puckett moved to pay bills as presented. by Councilman Shull, motion passed unanimously. Meeting was duly adjourned at%S:50 pm.
