The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 9 October 1989.
Present were Mayor James P. Nix; Councilmembers Roy C.
White, Jeanette Puckett, David E. Bishop, Michael A. Ford,
and Barney L. Shull; City Attorney Marion Wynne and City
Clerk Evelyn Phillips. No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 25 September 1989 regular session
were duly approved.
Councilman White moved for final adoption of Ordinance
No. 844, an ordinance exchanging a small strip of land on
NortTT Section Street/Gayfer Court with George and Iola
DuBrock. Seconded by Councilman Bishop, motion passed
unanimously.
Councilman Ford introduced Ordinance No. 8455, an ordinance
increasing monthly Garbage Rates by .40 per residential and
commercial accounts and establishing a provision that future
increases in landfill charges would automatically be passed
on to the customers on a prorata basis. (Sec. 21-75 of the
Fairhope Code.) In order to take immediate action, Councilman
Shull moved to suspend the rules. Seconded by Councilman White,
motion to suspend passed unanimously by the following vote:
AYE - White, Puckett, Nix, Bishop, Ford, and Shull. NAY - none.
Councilman Ford then moved for final adoption of Ordinance
No. 845. Seconded by Councilman Bishop, motion to final adopt
passed unanimously by the following vote: AYE - White, Puckett,
Nix, Bishop, Ford, and Shull. NAY - none.
Councilman Shull advised that written confirmation of the
work to be done in Quail Creek Estates had been done according
to Building Official Lunsford; as requested at the last regular
session. Councilman Shull introduced, and moved for the
adoption of, the following resolution. Seconded by Councilman
Ford, motion passed unanimously:
RESOLUTION NO. 294-89
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, That those streets located in UNIT ONE, QUAIL CREEK
ESTATES, are hereby accepted for maintenance by the City of
Fairhope as per recommendation by Moore Engineering Associates
as verified by the City Building Official, and as per Section
19-2 of the Fairhope Code of Ordinances.

Councilman Ford introduced, and moved for the adoption of,
the following resolution. Seconded by Councilman Shull,
motion passed unanimously:
RESOLUTION NO. 295-89
WHEREAS, we, the citizens of Fairhope, are proud of our choice
to operate a community -owned, not -for -profit electric utility; and
WHEREAS, we, the citizens of Fairhope, are both consumers and
owners of our public power system and have a direct say in
utility operations and policies; and
WHEREAS, the Fairhope Electric Utility provides our homes,
businesses, farms, social service and local government agencies
with reliable, efficient, and cost-effective electricity employing
sound business practices designed to ensure the best possible
service at the lowest possible rates; and
WHEREAS, the Fairhope Electric Utility is an important part of the
nation's public service infrastructure, and its employees serve
our community in the best tradition of public service; and
WHEREAS, the Fairhope Electric Utility is part of a community of
2,000 publicly owned electric utilities in the United States
that through consumer -ownership ensure cost-cutting competition
in the electric utility industry to the benefit of electric customers
everywhere; NOW, THEREFORE
BE IT RESOLVED: that the week of October 8-14 be designated
Public Power Week in Fairhope, in order to honor the utility,
its consumer -owners, and its employees, who work together to
provide the best possible electric service; and
BE IT FURTHER RESOLVED: that our community join hands with other
public power communities across the nation and celebrate the
benefits of public power to our local and national progress.

Mayor Nix advised that he had completed a proposed budget
for F/Y 1989-1990 and copies had been distributed to the Council
for review and revision at this time. Projected revenues are
$12,749,564; expeditures $12,129,133; and excess revenues
$620,431. After discussion, Councilman Shull introduced, and

moved for the adoption of, the following resolution. Seconded
by Councilman White, motion passed unanimously:
RESOLUTION NO. 296-89
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA: that the proposed Budget presented and reviewed this
9th day of October, 1989, be hereby approved and adopted for
F/Y 1989-1990; and
BE IT FURTHER RESOLVED that the Annual Salaries of City Per-
sonnel shall be as shown on a list entitled "Annual Salaries
of All City Personnel - Resolution No. 296-89"; said list to
be filed in the Office of the Mayor, of the City Clerk, and
of the Personnel Officer; and
BE IT FURTHER RESOLVED that the Mayor be authorized to enter
into a contract with the Eastern Shore Chamber of Commerce
to promote the City of Fairhope. The contract shall be for
one (1) year, 1 October 1989 to 30 September 1990, but may
be canceled at any time. Contract shall call for a payment
to the Eastern Shore Chamber of Commerce of $100.00 per
month from the General Fund and $100.00 per month from each
of the Utility Funds; or $4,800 for the one-year term.

Council reviewed an application for a Beer On/Off Premises
License and a Wine On/Off Premises License by Robert Litzkow
who plans to open the GERMAN INN at 183 Baldwin Square if
he receives approval. No one present was opposed to the li-
censes. There was police approval of the applicant.
Councilman Shull moved to approve the licenses provided Mr.
Litzkow opens his business at the location indicated. Seconded
by Councilwoman Puckett, motion passed unanimously.
Councilman Ford moved to hear the following business not on
the Agenda. Seconded by Councilman Shull, motion passed
unanimously:
Councilman Ford moved to update the Police Reserve roster
by adding John Davidson and deleting Sherman Smith and Randy
Bishop. Seconded by Councilman Bishop, motion passed unanimously.

Councilman White moved to pay bills as presented. Seconded
by Councilman Shull, motion passed unanimously.
Assistant Fire Chief Tim Kant announced that October 8-14
is also Fire Prevention Week in Fairhope.
Harbor Board Chairman Koppersmith invited the Council to
come view harbor activities by taking a boatride this Saturday,
October 14th, at 9:00 am at the Yacht Club. The Board feels
a futher discussion of the jetties installation is needed.
Meeting was duly adjourned at 5:.50 pm.
