The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 11 September 1989.
Present were Mayor James P. Nix; Councilmembers Roy C.
White, Jeanette Puckett, David E. Bishop, Michael A. Ford, and
Barney L. Shull; City Attorney Marion Wynne and City Clerk
Evelyn P. Phillips. No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 28 August 1989 regular session were
duly approved.
Mrs. Caroline Hoffman, representing "Citizens for Recycling",
presented a petition and a proposal for Council consideration.
Mrs. Hoffman said the petition contained about 1,191 signatures
of people who want a recycling program started. The group's
proposal was (1) combine the efforts of their group with the
Council's recycling committee by appointing them to serve on
the Council committee thereby expediting the start up of a
buy-back center; (2) add fifty cents to the monthly garbage rate
to help with expenses; (3) hire a part-time administrator;
(4) construct, or utilize space in a present building, a buy-
back center; and (5) allocate funds to educate the public on
the program. A long discussion with Mrs. Hoffman and other
members of her group ensued. Some points brought out were
(1) some buy-back recycling programs have already run into
problems with more product than market; (2) unfair to tax
Fairhope citizens only; and (3) petition signatures show many
addresses not in the City. Recycling Committee Chairman Shull
said his committee is gathering information but is not yet
ready to make a final recommendation other than an indication
that a simple program, consisting of establishing a buy-back
center only, would result in a $50,000 yearly deficit; and
a more complex program, getting into curbside pickup, would
result in a $150,000 yearly deficit. A gentleman in the
audience identified himself as John Walker, a resident of
Daphne, and reported that he works for a company located in
Mobile and they are thinking of establishing a recycling pro-
gram on the Eastern Shore. The discussion ended with Council
expressing unanimious interest in a recycling program,
appreciation for the efforts of the Citizens for Recycling group,
and the thought that private enterprise might be more suited
than a governmental unit for the operation of such a program.
The following bid report on a mower for the Recreation
Department was reviewed and ratified by Council as per the
last regular session:

All specifications being met, we recommend acceptance of
low bid from Gulf Shore Turf Supply at $8,845.00.

Councilman Shull moved to ratify the action taken at the August
28th session awarding the purchase to Gulf Shore Turf Supply.
Seconded by Councilwoman Puckett, motion passed unanimously.
Councilman White moved for final adoption of Ordinance
No. 842, an ordinance amending, deleting, and adding to
Article VI. Garbage and Trash Collection and Disposal, of
the Fairhope Code of Ordinances. Councilman White reported
that the changes suggested at the last regular session (Aug. 28th),
when he had introduced the ordinance, had been incorporated
in the final copy now before the Council. Motion to final
adopt was seconded by Councilman Shull and passed unanimously.
Council took the following action on bids:

Councilman Bishop moved to accept the low bid provided all
specifications are met. Seconded by Councilman Shull,
motion passed unanimously.
Councilman Ford introduced, and moved for the adoption of,
the following resolution. Seconded by Councilwoman Puckett,
motion passed unanimously:
RESOLUTION NO. 293-89
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, That Mayor Nix is hereby authorized to execute a
contract with TROJAN TECHNOLOGIES, INC., of London, Ontario,
Canada, whose service representative in Alabama is JIM HOUSE
AND ASSOCIATES, INC., of Birmingham, for the Ultra Violet
Sterilization System to be used in the wastewater treatment
plant as supervised by Perry Hand $ Associates, Inc., Project
Engineers, and the City. Contract is awarded at Bid Price of
Seventy-nine Thousand Dollars ($79,000.00) this date.
ADOPTED THIS 11th DAY OF SEPTEMBER, 1989.

There was one other bid on the Ultra Violet System, for
$99,875.00 by Fischer & Porter Company, Warminster, Pa.
Project engineers recommended acceptance of above bid as
all specifications were met.
Under committee reports, Councilman White advised that
he was ready to re -introduce an ordinance, to be commonly
known as the Bike Pathways Ordinance, which had been revised
after its original introduction by Councilman White on
10 July 1989, and its being tabled during discussion on
31 July 1989. Councilman Shull moved to remove the ordinance
from the table for further action. Seconded by Councilman
Bishop, motion passed unanimously. Councilman White then
introduced Ordinance No. 8439 an ordinance to delete and replace
Section 20-14, Fairhope Co e of Ordinances. In order to take
immediate action, Councilman Shull moved to suspend the rules.
Seconded by Councilwoman Puckett, motion to suspend passed
unanimously by the following vote: AYE - White, Puckett, Nix,
Bishop, Ford, and Shull. NAY - none. Councilman White then
moved for final adoption of Ordinance No. 843. Seconded by
Councilman Shull, motion to final adopt passed unanimously by
the following vote: AYE - White, Puckett, Nix, Bishop, Ford,
and Shull. NAY - none.

Mr. Gary Moore, Fairhope Yacht Club, and Mr. Tom Hutchins,
Eastern Shore Marine, stated they were present to see if the
Council was ready to take action on the rip -rap jetties in
Flying Creek Question. It was their understanding that the
Harbor Board had written to the Council and recommended that
an application for a permit to install the jetties be prepared
and sent to the Corps of Engineers. Council's reply was that
they had received the recommendation from the Harbor Board but
there were still many unanswered Questions about the proposal.
Councilman Bishop asked about liability for beach erosion of
private property if the City installed the jetties. Supt.
Rutherford said there was other needed work to be done at the
City's Dock area. Councilman White said he saw no need to
apply for a permit before a decision as to what and how much
work needs to be done. Mayor Nix asked Council if they wanted
the estimated $96,000 for the jetties included in next year's
budget which is now being prepared. Discussion was concluded
by Councilman Bishop's motion to authorize the Mayor to contact
the Corps of Engineers for advice and a possible recommendation
regarding the proposed jetty construction. Seconded by
Councilman White, motion passed unanimously.
Councilman White, as chairman of the Sister Cities Committee,
reported that his committee's investigation of the Sister
Cities Organization shows that participation will call for a
lot of citizen input and cooperation. The organization puts
cities of different countries in contact for cultural and
personal exchanges. Councilman White introduced Mrs. Pat Lee,
a local lady with knowledge of the Sister Cities Organization
and with the city asking to be our Sister City --El Alto, Bolivia.
Mrs. Lee explained membership in the organization would cost
the City about $12.50 per month and it would take citizen
enthusiasm and participation to work. Mrs. Lee was asked if
she would research the local amount of support and interest
and come back to the Council with her findings. She agreed
to do so.
Mayor Nix announced that September 17th will mark the 202nd
anniversary of the signing of the U.S. Constitution. On that
day, at 3:OOpm, all local church bells will ring for 202 seconds.
Councilman Ford moved to pay bills as presented. Seconded
by Councilwoman Puckett, motion passed unanimously.
Mr. Charles Waterson introduced himself to the Council. He
is the new director of the Baldwin County Health Office here in
Fairhope.
Meeting was duly adjourned at J:30 pm.
