The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday. 24 April 1989.
Present were Mayor James P. Nix; Councilmembers Roy C.
White, Jeanette Puckett, David E. Bishop, Michael A. Ford,
and Barney L. Shull; City Attorney Marion Wynne and City
Clerk Evelyn Phillips. No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 10 April 1989 regular session were
duly approved.
A public hearing was held as advertised on a request to
vacate a right-of-way between Fairhope Avenue and Edwards
Avenue by property owners Fred L. and Angelo A. Corte. No
one present was opposed to the vacation. Councilman Ford
introduced, and moved for the adoption of, the following
resolution. Seconded by Councilman Shull, motion passed
unanimously:
RESOLUTION NO. 283-89
FRED L. CORTE AND ANGELO A. CORTE are the owners of all
of the property abutting on that portion of the following
described property:
PARCEL "A": From the Northwest corner of the West 1/2
of the SE 1/4 of the NW 1/4 of Section 16, T6S, R2E,
Baldwin County, Alabama; run south a distance of 30 ft,
more or less, to the Point of Beginning; thence run
east a distance of 30 t, more or less, to a point; thence
run south a distance of 1263 ft, more or less, to a point
lying on the North right-of-way line of Fairhope Avenue;
thence run west along said North right-of-way line a distance
of 60 ft; thence run north a distance of 1263 ft, more or
less; thence run east a distance of 30 ft, more or less;
to the Point of Beginning.
PARCEL "B": From the Northeast corner of the West 1/2 of
the SE 1/4 of the NW 1/4 of Section 16, T6S, R2E, Baldwin
County, Alabama; run south a distance of 30 ft to the
Point of Beginning; thence run east a distance of 30 ft,
more or less, to a point; thence run south a distance of
1263 ft, more or less, to a point lying in the North
right-of-way line of Fairhope Avenue; thence run west along
said North right-of-way line a distance of 60 ft; thence run
north a distance of 1263 ft, more or less, thence rum east a
distance of 30 ft to the Point of Beginning.

And the said owners have filed a Petition with the City
of Fairhope, Alabama, requesting that an assent to the
vacation of the public right-of-way described above, if
it in fact exists, be given.
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY
OF THE CITY OF FAIRHOPE, ALABAMA, THAT it is in the public
interest that the hereinabove described property be vacated
as a public right-of-way. That the City Council of the City
of Fairhope, Alabama, does assent to the vacation of the
public right-of-way described as Parcel A and Parcel B above;
which said right-of-way is situated in the City of Fairhope;
that a certified copy of this Resolution be furnished to said
Petitioners in order that same can be attached to the Declaration
of Vacation to be filed in this matter as provided for by
Section 23-4-20, Code of Alabama, 1975.
ADOPTED THIS 24th DAY OF APRIL, 1989.

Councilman Bishop introduced, and moved for the adoption
of, the following resolution to be sent to the Alabama Highway
Department. Seconded by Councilwoman Puckett, motion passed
unanimously:
RESOLUTION NO. 284-89
WHEREAS, the old Mobile Bay Causeway (US 90) has been
reduced to a two-lane highway in many areas; and
WHEREAS, Pensacola is now experiencing terrible traffic
problems due to one of the lanes of one of their bridges
being knocked out; and
WHEREAS, we on the Eastern Shore would experience similar
problems if one of the lanes on the new Bayway (I-10) was
knocked out; THEN, THEREFORE
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE
that the bridges on the old Mobile Bay Causeway be replaced
as soon as possible, and all four lanes be re -opened to
traffic.

It is recommended to accept the low bid of $3,537.86 from
Lamar Treated Materials of Hattiesberg, Mississippi, all
specifications being met.

Councilman Bishop moved to accept the low bid from. Lamar
Treated Materials, provided all specifications are met.
Seconded by Councilman Shull, motion passed unanimously.
A Restaurant Liquor License application by Leah Robinson,
dba JOHN'S FAMILY RESTAURANT, at #1 North Greeno Road, was
considered. No one present was opposed to the license. There
was police approval. Councilwoman Puckett moved to approve the
license. Seconded by Councilman White, motion passed unanimously.
Councilman Ford reported that he had received several com-
plaints about loud music at the Municipal Pier and along the
Beach. Councilman Ford said he had reviewed the Noise Ordinance
sections of our Municipal Code and found them to be adequate.
His suggestion was for stricter enforcement and for the public
to respect each other's rights .... one has a right to play music
but others also have the right not to have to listen to it.
Councilman White moved to hear the following three items
of business not on the Agenda. Seconded by Councilman Shull,
motion passed unanimously:

and moved for
Councilman Shull requested/approval to transfer $8,000.00
from the Recreation Improvement Fund to the Recreation Operating
Fund to cover some capitol improvements. Seconded by
Councilwoman Puckett, motion passed unanimously.
Councilwoman Puckett moved to authorize the Mayor to
sell an old police car. Seconded by Councilman Shull, motion
passed unanimously.
Councilman Ford introduced, and moved for the adoption of,
the following resolution. Seconded by Councilman Bishop,
motion passed unanimously:
RESOLUTION NO. 285-89
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE
That: MCCUE CIRCLE located in EAST GATE SUBDIVISION is
hereby accepted for maintenance by the City of Fairhope as
per recommendation by Moore Engineering Associates, Inc.,
and as per Section 19-2 of the Fairhope Code of Ordinances.
ADOPTED THIS 24th DAY OF APRIL, 1989.
Councilman Shull moved to remove from the table consideration
of a request by the Baldwin County Commission that the City
take over the building inspection in our police jurisdiction.
Seconded by Councilman Ford, motion passed unanimously.
Council went over several points in discussion, such as the
amount of revenue to be expected, the cost of additional
personnel, the question as to how to enforce building regulations
in an area where we have no zoning authority, and possible
flood -plain area problems. Councilman White moved to respectfully
decline the request. Seconded by Councilman Shull, motion
passed unanimously.
