The City Council, City of Fairhope, met in regular session
at 5:30 PM; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday. 27 March 1989.
Present were Councilmembers Roy C. White, Jeanette Puckett,
David E. Bishop, Michael A. Ford, and Barney L. Shull; City
Attorney Marion E. Wynne and City Clerk Evelyn Phillips.
Mayor James P. Nix was absent.
In the absence of Mayor Nix, Mayor Pro-Tempore David E.
Bishop presided.
There being a quorum present, Councilman Bishop called the
meeting to order. Meetings of the 15 March 1989 regular session
were duly approved.
Before continuing with the Agenda, Councilman Bishop
introduced a special visitor, Mr. Bill Burch, representing
the Mobile office of the United States Secret Service. Mr. Burch
presented a Certificate of Appreciation from the Secret Service
to the Fairhope Police Department for their outstanding co-
operation and courteous help in providing security for President -
Elect George Bush, and Mrs. Bush who visited the City earlier
during the campaign. The Certificate was presented to Chief
Jerry Anderson, Assistant Chief James Kinard, Officer Jean
White, and Officer James Cumbie.
Council reviewed a Beer On/Off Premises License and a Wine
On/Off Premises License application by L. C. Merrell, dba
GABBY PLACE, 6S0 Fairlane Avenue, which had been tabled until
this session at the March 15th session. Several members of
the Council stated they had been contacted by persons asking
them not to approve this application. Chief Anderson stated
the area was disorderly and the Police did not approve the
application. Mrs. Rosie Gill, 464 Young Street, asked that the
application not be approved. Mr. Bob Lunsford verified that
650 Fairlane Avenue was outside the city limits and in a County
residential zone. Mr. Merrell was present. After some dis-
cussion, Councilman White moved to deny approval of the application.
Seconded by Councilman Ford, motion to deny passed unanimously.
Council reviewed a Club Liquor License application by
Charlie Gibbs, Jr., dba CHARLIE'S LOUNGE, 572 Young Street.
Mr. Gibbs was present and did have proof of required publications.
Mrs. Rosie Gill again stated her opposition to this application
as the Club would be located even closer to her home. Mrs.
Emaleen Edmonds stated she was present to oppose the license
as a representative of her sister, Mrs. Maisie Young, who

lives at 578 Young Street and who was out of town this date.
Mr. James Gibbs, brother to applicant, was present to
speak for his brother. He stated that he, James, had operated
a lounge in Point Clear and gave no trouble to the police.
Chief Anderson verified that James had operated his business
in an orderly fashion but Charlie was applying for a Club
license. Chief Anderson further informed the Council that
police approval was not being given on the application due
to the number of neighborhood residents who had expressed
their disapproval. The location is also zoned residential by
the County. After some discussion, Councilwoman Puckett moved
to deny approval of the application. Seconded by Councilman
Shull, motion to deny passed unanimously.
Councilman White introduced Ordinance No. 832, an ordinance
to annex and zone the James E. and Margaret Smith -property
adjacent to the Quail Creek Golf Course. R2 Medium Density
Single Family Residential zoning was requested concurrent with
annexation. No one present was opposed. In order to take
immediate action, Councilman Shull moved to suspend the rules.
Seconded by Councilman Ford, motion to suspend passed unani-
mously by the following vote: AYE - White, Puckett, Bishop,
Ford, and Shull. NAY - none. Councilman White then moved for
final adoption of Ordinance No. 832. Seconded by Councilwoman
Puckett, motion to final adopt passed unanimously by the
following vote: AYE - White, Puckett, Bishop, Ford, and Shull.
NAY - none.
Councilman White introduced Ordinance No. 833, a house-
keeping ordinance amending Zoning Ordinance No. 557 as re-
commended by the Planning & Zoning Commission. Those Sections
amended or added to are 4.12, 4.417, 5.421, 5.4229 7.6154,
7.6155, 8.6, and 8.8. In order to take immediate action,
Councilman Shull moved to suspend the rules. Seconded by
Councilman Ford, motion to suspend passed unanimously by the
following vote: AYE - White, Puckett, Bishop, Ford, and Shull.
NAY - none. Councilman White then moved for final adoption of
Ordinance No. 833. Seconded by Councilwoman Puckett, motion
to final adopt passed unanimously by the following vote: AYE -
White, Puckett, Bishop, Ford, and Shull. NAY - none.

Councilman Puckett moved to accept the low bid by Hatfield
and Company at $22,080, provided all specifications are met.
Seconded by Councilman Shull, motion passed unanimously.
Councilman Shull moved to hear the following business not
on the Agenda. Seconded by Councilwoman Puckett, motion
passed unanimously:
Councilman White moved to provide $3,000 in expense funds
for six Volunteer Firemen to attend the Fire College. Seconded
by Councilman Ford, motion passed unanimously.
Councilman Ford announced a new scholastic awards program
by the Fairhope School Committee. An Academic Letter, similar
to an Athletic Letter, will be presented to students who
maintain a high grade average, do not have a high absence or
tardiness record, and have not been a disciplinarian problem.
Councilman Ford invited everyone to attend the first Awards
Ceremony on April llth at 7:30 pm in the Civic Center.
Meeting was duly adjourned at 5:56 pm.
