HomeMy WebLinkAbout03-15-1989 Regular Meeting1008 STATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Wednesday, 15 March 1989. Present were Mayor James P. Nix; Councilmembers Roy C. White, Jeanette Puckett, David E. Bishop, and Barney L. Shull; City Attorney Marion Wynne and City Clerk Evelyn Phillips. Councilman Michael A. Ford was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 27 February 1989 regular session were duly approved. Council reviewed a Beer On/Off Premises License and a Wine On/Off Premises License application by Andree K. Burton, dba ANDREE'S WINE, CHEESE & THINGS, located on Fairhope Avenue in the former Gaston Ford Company building. No one present was opposed to the application. There was police approval. Council- man Shull moved to approve the issuance of both licenses. Seconded by Councilwoman Puckett, motion passed unanimously. Council reviewed a Beer On/Off Premises License and a Wine On/Off Premises License application by L. C. Merrell, dba GABBY PLACE, located at 650 Fairlane Avenue. After discussion, Councilman White moved to table the application until the next regular Council session as he had some questions to ask and Mr. Merrell was not present. Motion to table seconded by Councilman Bishop. Motion carried by the following vote: AYE - White, Bishop, Ford, Nix. NAY - Shull. Councilman Bishop introduced Ordinance No. 830, an ordinance to annex the Fairhope Avenue Baptist Church property on Fairhope Avenue extension. In order to take immediate action, Councilman Shull moved to suspend the rules. Seconded by Councilman Bishop, motion to suspend passed unanimously by the following vote: AYE -White, Puckett, Nix, Bishop, and Shull. NAY -none. Councilman Bishop then moved for final adoption of Ordinance No. 830. Seconded by Councilman Shull, motion to final adopt passed unanimously by the following vote: AYE - White, Puckett, Nix, Bishop, and Shull. NAY - none. Councilwoman Puckett introduced Ordinance No. 831, an ordinance to annex the Fairhope Single Tax Corporation property on Fairhope Avenue extension. In order to take immediate action, Councilman Shull moved to suspend the rules. Seconded by Councilman Bishop, motion to suspend passed unanimously by the following vote: AYE -White, Puckett, Nix, Bishop, and Shull. NAY - none. Councilman Bishop then moved for final adoption of Ordinance No. 831. Seconded by Councilman Shull, motion to 15 March 1989 1009 final adopt passed unanimously by the following vote: AYE - White, Puckett, Nix, Bishop, and Shull. NAY - none. A report on bids received by the Purchasing Agent for ten gasoline -powered Golf Carts was read and discussed. It was recommended by the Agent, Supt. Rutherford, and Golf Director Bobby Hall that all bids be rejected and new bids be requested on all -electric Carts. So moved by Councilman Shull. Seconded by Councilwoman 'Puckett, motion passed unanimously. A delegation from the Eastern Shore Chamber of Commerce; Barry Gaston, Kolleen Krandal, and Rae Jackson; came before the Council to report on a problem having to do with the upcoming annual Arts & Crafts Festival (March 17-19). A group of crafters have formed an association called the Southern Crafters Association and have announced that they will be exhibiting their crafts at a downtown vacant lot in Fairhope during the Festival. The mailout or application form, copies of which were given to the Council, for crafters to use to rent exhibition booths from Southern Crafers Association stated that the City of Fairhope would be responsible for loss or damage of any kind. Mr. Gaston asked the Council to research the possibility of an ordinance that would stop this type of situation from occuring in the future and would place control of the Arts & Crafts Festival under the Chamber as it has been for many years. Council concurred with the request and research will be done for future action. The present situation was of the most concern to the Council as, as Mayor Nix said: "The City will certainly not be liable for loss or damage of any kind." After some discussion as to what type of license the Southern Crafters had or would request, Councilman Shull moved to authorize the Mayor to take whatever legal steps are available, if any, to control the activities of the Southern Crafters Association on March 17 to 19, 1989. Seconded by Councilwoman Puckett, motion passed unanimously. Councilman White moved to pay bills as presented. Seconded by Councilman Shull, motion passed unanimously.
