HomeMy WebLinkAbout02-27-1989 Regular Meeting1005 STATE OF ALABAMA X COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber; 161 North Section Street; Fairhope, Alabama 36532; on Monday, 27 February 1989. Present were Mayor James P. Nix; Councilmembers Roy C. ti°dhite, Jeanette Puckett, David E. Bishop, Michael A. Ford, and Barney L. Shull; and City Clerk Evelyn Phillips. City Attorney t!arion Wynne was absent. There being a quorum present, Mayor Nix called the meeting to orc'er. ' �_7.utes of the 13 February 1989 regular session were : ;.,.?.; a- ;roved. As ..-lu.y advertised, a joint public hearing by the Planning Zcr.?in!7 Commission and the City Council on amending the Zonir.F Ordinance (sections on "Signs" and "Landscaping") was held. Mayor Nix turned the meeting over to the Commission. Chairman Sanderson, with Commission members Kant, Killoch, McBrearty, Nix, Bishop, and Richmond assembled, asked for any public comment on the proposed amendments. There was none. Building Official Lunsford briefly described the changes in- corporated in the amending ordinances. After some discussion, Mr. Kant moved to approve the two amending ordinances with the addition of the words "and/or Registered Landscape Designer." to section 70.143 (2) of the Landscaping ordinance. Seconded and unanimously approved, Chairman Sanderson adjourned the Commission, and turned the two ordinances, as amended, over to the Council with a recommendation for approval. Mayor Nix asked again if anyone present wished to comment or ask a question on the proposed two ordinances. There were no commentsor questions. Councilman Bishop introduced Ordinance No. 8281 an ordinance to amend the Zoning Ordinance "Signs" section, and Ordinance No. 829, an ordinance to amend the Zoning Ordinance "Landscaping" section. In order to take immediate action, Councilman Shull moved to suspend the rules. Seconded by Councilman Bishop, motion to suspend passed unani- mously by the following vote: AYE - White, Puckett, Nix, Bishop, Ford, and Shull. NAY - none. Councilman Bishop then moved for final adoption of Ordinances No. 828 and 829. Seconded by Councilwoman Puckett, motion to final adopt both ordinances passed unanimously by the following vote: AYE - White, Puckett, Nix, Bishop, Ford, and Shull. NAY - none. Council discussed a request from Bay Cruises, Inc., for a letter to be sent to the Alabama Alcoholic Beverage Control Board stating the City's approval of a State Common Carrier ABC License to be issued to the SOUTHERN COMFORT, a 110-ft. mini -cruise ship to be docked at Marriott's Grand Hotel marina 27 February 1989 1006 and used for parties, dinner cruises, fishing trips, and the like, in Mobile Bay. The Grand Hotel will be catering the food as well as purchasing and serving all alcoholic beverages aboard the ship. Councilman White moved to provide the letter as requested by Bay Cruises, Inc. Seconded by Councilman Shull, motion passed unanimously. Mayor Nix asked the Council to authorize the sale of an automobile which has been awarded to our Police Department through a default judgement concerning a drugs case. Councilman Ford moved to authorize the sale by Public Auction of the 1978 Cadillac Coupe de Ville, VIN #6D4758Q306035, on Saturday, 11 March 1989. Seconded by Councilwoman Puckett, motion passed unanimously. The car will be available for inspection by the public at the Police Station from 7:00 am to 3:00 pm, Friday, 10 March 1989. Councilwoman Puckett moved to authorize the Mayor to exe- cute an amendment to the Southeastern Power Administration (SEPA) contract concerning a rate adjustment. Seconded by Councilman Bishop, motion passed unanimously. Councilman White moved to accept the City's Audit Report, prepared by S.F. Parker & Company, for fiscal year ended 30 September 1988. Seconded by Councilman Shull, motion passed unanimously. Mayar Nix recognized Parker $ Company's local representatives Ms. Arla Kern and Mr. Earl Blackman. The following action was taken on bid items: FOR 10.000 FT. OF 2-1/2" PVC CONDUIT - Electric Dept. Vendor Total Cost Magnolia Lighting Fairhope $ 7,100.00 Mathes Electric of Ala Foley $ 6,759.00 Baldwin Electric Fairhope $ 7,150.00 It is recommended to accept the low bid of $6,759.00 from Mathes Electric of Alabama. ---W. Smith, Purch. Agt. Councilwoman Puckett moved to accept the low bid by Mathes Electric provided all.specifications are met. Norris, Electric Supt. Councilman Bishop moved to accept the low bid by Mack Electric Company provided all specifications are met. Seconded by Councilman Shull, motion passed unanimously. Councilman Shull moved to reschedule the next regular Council session from Monday, March 13th, to Wednesday, March 15th, same time and place. This is due to the planned attendance by Mayor Nix and Councilmembers Puckett & Ford of the National League of Cities convention. Seconded by Councilwoman Puckett, motion passed unanimously.
