COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular
session at 5:30 p.m.; Fairhope Municipal Complex Council
Chamber; 161 North Section Street; Fairhope, Alabama;
on Monday, 13 February, 1989.
Present were Mayor James P. Nix; Councilmembers
Roy C. White, Jeanette Puckett, Michael A. Ford, and
Barney L. Shull; City Attorney Marion Wynne and Acting
City Clerk Betty Rivenbark. David Ed Bishop and Evelyn
Phillips were out of town.
There being a quorum present, Mayor Nix called the
meeting to order. Minutes of the 23 January 1989 regular
session and- the -2= February _1989 special session were duly
approved.
At this time the Mayor recognized three Webelo
Scout troops who were visiting tonight and their leaders
R.C. Rezner, Seth Pedin and Bill and Judy Benson.
The group of boys and their leaders led the rest present
in.the pledge of allegiance. Mayor Nix explained the
working of the government of Fairhope to the group.
Sherry Hood was recognized from the American Red
Cross and presented a Certificate of Cooperation to
Cecil Rayborn for organizing and helping to put on a
City sponsored Blood Drive. She said their goal was 50 units
and 76 units was what was actually received at the end
of the drive. She •thanked the Mayor and the City for
their support.
An application for a Beer Off -Premises License and
a Wine Off -Premises License, DBA Deli Depot "N" Food Mart,
operated by Paul E. Moore, located at 355 South Greeno Rd.
was considered. No one present was opposed to the licenses.
There was police approval. Councilman Shull moved to
approve the licenses• Seconded by Councilwoman Puckett
motion passed unanimously.
Mr. Hal Parsons President of the Quail Creek Golfers
Association was recognized. He presented a check for $1,000
to Bobby Hall, Golf Pro at Quail Creek for rain shelters.
He said that the group is a support group for the golf course
and that they want to help at the course in any way.
A request had been received to name a short portion
of a street off of the end of East Pecan Street, Marietta
Drive. Marietta Johnson Organic School is being built
there and this street had never been named. Councilman
Ford moved to approve the request and Councilman White
seconded. Motion passed unanimously.

Mayor Nix explained that the City needed to swap
some property(less than 1/10 of an acre) with the Quail
Creek property owners to make some adjustments at the
golf course. He needs Council approval to execute the
deed. Councilman Shull moved to,authorize the Mayor
to execute the deed for the adjustments that are necessary.
Councilman Ford seconded saying that it is necessary
and in their best interest. Motion passed unanimously.
Council attention was drawn to the need to increase
the garbage rates in Fairhope to keep up with the charges
we are having to pay to transport it to the county landfill.
Discussion followed on what would be fair increase. Council-
man White introduced Ordinance No. 827, an ordinance
raising the garbage rates, for all users, 50� a month.
In order to immediately consider this ordinance for adoption,
Councilwoman Puckett moved to suspend the rules. Seconded
by Councilman Shull, motion to suspend was unanimously
carried by the following vote: AYE - White, Puckett, Nix,
Ford, Shull. NAY - none. Councilman White then moved for
final adoption of Ordinance No. 827. Seconded by Council-
man Shull motion to adopt was unanimously carried by the
following vote: AYE - White, Puckett, Nix, Ford, Shull.
NAY - none.

Councilman White moved to accept low bid meeting specifi-
cations. Councilman Shull seconded. Motion passed unani-
mously.

Councilman Ford moved to accept low bidder meeting
all specifications. Councilwoman Puckett seconded
and motion carried unanimously.

Discussion followed on what best to use, this is for
one mile paving project City does each year in budget
this year planned for S. Section Street. Barney pointed
out that the life of metal is about 20 years. Supt.
Rutherford and Kant had recommended the coated metal
which is cheaper. Councilman White said he had mixed
emotions about having to replace in 20 years w/sidewalk
being on top but moved to buy the metal coated pipe
at the lowest bid meeting specifications. Councilwoman
Puckett seconded and motion carried unanimously.
Mayor Nix announced that Arbor Day is being planned
for February 22, 1989 at 10:00 A.M. and there will be
a ceremony at the complex. He told what kind of trees
will be distributed, one to a resident, and that if any
left over then non-residents can get one.
Meeting was duly adjourned.
