COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber;
161 North Section Street; Fairhope, Alabama 36532; on
Monday, 22 August 1988.
Present were Mayor James P. Nix; Councilmembers Roy C.
White, Jeanette Puckett, David E. Bishop, Michael A. Ford,
and Barney L. Shull; Attorney James Smith substituted for
City Attorney James Reid; and City Clerk Evelyn Phillips.
No one was absent except Attorney Reid.
There being a quorum present, Mayor Nix called the
meeting to order. Minutes of the 8 August 1988 regular
session were duly approved.
Special recognition of Mr. Leo Keller was made before con-
tinuing with. the agenda. Mayor Nix presented a framed copy
of a proclamation to Air. Keller honoring him for some thirty-
four years service to the City and to the Fairhope Volunteer
Fire Department, and naming August 21st to 27th "Leo Keller
Week" in the City of Fairhope. VFD Chief Bill Bulman also
presented a beauti"ul1_•r inscribed plaque to Mr. Keller from
the Department. Nem ,,_,s of the audience and the Council gave
Mr. Keller a standing ovation.
Council reviewed a petition for annexation by B. Tommy
Springer, Jr. and Lucy Marie Springer; and by Emil Sandell
and Idella S. Sandell; both properties located on Bishop
Road north of Fairhope Avenue extension (County Road 48).
Each parcel is contiguous to the corporate limits, does not
lie in any other incorporated municipality or its police
jurisdiction, and will be zoned R-1 and used for a single
family residence. Councilman Bishop introduced Ordinance
No. 811, annexing the Springer parcel consisting of approx-
imately 1/2 acre; and Ordinance No. 812, annexing the Sandell
parcel consisting of approximately 1-1/4 acre. In order to
take immediate action, Councilman Shull moved to suspend the
rules. Seconded by Councilman Bishop, motion to suspend
passed unanimously by the following vote: AYE - Nix, White,
Puckett, Bishop, Ford, and Shull. NAY none. Councilman
Bishop then moved for final adoption of Ordinance No. 811
and Ordinance No. 812. Seconded by Councilman Shull, motion
to adopt passed unanimously by the following vote: AYE -
Nix, White, Puckett, Bishop, Ford, and Shull. NAY - none.
Council studied proposed protective covenants for the
Fairhope Industrial Park as requested by the Fairhope Industrial
Board. Councilwoman Puckett moved to agree to Article 4,
Paragraph A (2) which says the Mayor and Council will appoint
one member to the Architectural Review Committee. Seconded
by Councilman Ford, motion passed unanimously.

With all specifications being met, it is recommended to accept the
lowest evaluated cost bid by Stuart Irby Company.- W. Smith, Purch.Agt.
So moved by Councilman Bishop. Seconded by Councilman Shull,
motion passed unanimously.
Councilman White moved, for insurance purposes, to add
Randy H. Bishop and Mark S. Tunstall to the Police Reserve
roster. Seconded by Councilwoman Puckett, motion passed unanimously.
Councilman Shull moved to approve the transfer of $3,500.00
from Recreation Improvement funds to the Recreation Operating
account to cover extensive work on the tennis courts. Seconded
by Councilman Ford, motion passed unanimously.

Councilman White moved to reappoint Dean Post and Mary
Miley, each for a five-year term, to the Library Board.
There being no other nominations, Councilman Bishop seconded
the motion, which passed unanimously.
Councilwoman Puckett moved to reappoint Dave Smith,
Byron Calhoun, and Gary Moore; each for a six -year term;.
to the Fairhope Industrial Board. There being no other
nominations, Councilman Shull seconded the motion which
passed unanimously.
Mayor Nix advised the recent notice about "VOC Tests
Available" appearing on utility bills concerned chemical
testing of our water, required by a state agency. Any persons
interested in the tests are welcome to look over a copy at the
City Water Department office on South Section Street.
There will be a City Auction on Saturday, August 27th, at
9:00 am, at the City Warehouse. Cars, bicycles, bulldozers
and other miscellaneous equipment will be offered to the
highest bidder for cash only, as is, where is. The City
reserves the right to refuse any and all bids.
Councilman White and the Council expressed their appreciation
for a good job to the City Clerk who recently completed a
survey of the 80-year minutes of the City to determine if
a Mayor and full Council had been returned to office without
opposition at any time in the past. 1988 proved to be an
historic first.
Mr. Layton Overstreet came before the Council to congratulate
all of them on their re-election by acclamation and to say
they are doing a good job.
Meeting was duly adjourned at 5:52 pm.
