STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30 pm; Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532; on
Monday, 25 April 1988.
Present were Mayor James P. Nix; Councilmembers Jeanette
Puckett, David E. Bishop, Michael A. Ford, and Barney L.
Shull; City Attorney James Reid and City Clerk Evelyn Phillips.
Councilman Roy C. White was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 11 April 1988 regular session were
duly approved.

Councilman Shull moved to accept the low bid from Fletcher
Oil Company, provided all specification are met. Seconded
by Councilwoman Puckett, motion passed unanimously.

The City reserved the right to cancel contract, and go to next
lowest bidder, if low bidder fails 3 times to deliver in time
required. Recommend accept low bid from Sherman. W. Smith, Purch.Agt.
Councilwoman Puckett moved to accept low bid from Sherman
Industries, provided all specifications are met. Seconded
by Councilman Shull, motion passed unanimously.

Due to the increasing use of underground utilities,
Councilman Bishop moved to authorize a request for bids
on a Fault Locator machine for the Electric Department.
Seconded by Councilman Shull, motion passed unanimously.
Councilman Bishop moved to authorize the City Attorney
to begin legal procedure to condemn unsafe portion of a
building (Colonial Inn) located at 101 South Mobile Street
if the owners have not begun removal in the next three
weeks. Seconded by Councilman Shull, motion passed
unanimously.
Councilman Ford introduced, and moved for the adoption
of, the following resolution. Seconded by Councilwoman
Puckett, motion passed unanimously:

RE SOLUT I ON NO. _ 4L90
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, THAT SAID GOVERNING BODY WILL HEAR AND RULE ON ANY
WRITTEN OBJECTIONS PRESENTED AGAINST THE ASSESSMENTS TO BE
ASSESSED FOR THE 1987-1988 PUBLIC IMPROVEMENTS PROJECT BY THE
FOLLOWING RULES & REGULATIONS:
1. Each property owner of record will be sent a notice, by
Certified Mail, advising of the date, time, and place
of the Public Hearing, -in addition to the required notice
placed in a newspaper of general circulation in the City.
2. Said notice -by -letter shall be mailed not less than 20
days prior to the date of the Hearing.
3. At the Public Hearing, the Governing Body will read and
rule upon any and all objections to the proposed assessments
which have been filed in writing prior to the Hearing.
4. The Governing Body will determine whether or not the objection
presents proof as to whether or not property value has not
been increased to the value of the assessment and will rule
as to any decreased assessment amount.

6. Once the Governing Body rules upon any and all objections,
they will set the assessments by duly adopting the proper
resolution setting forth the assessment for each lot or
parcel of assessed property (by reference to the Assessments
Roll Book) and no lot or parcel will be afterward sub -divided
in any way without the full or remaining balance of its
assessment, plus any accrued interest, being first paid in full.

RESOLUTION NO. 250-88
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY
OF FAIRHOPE, ALABAMA, That those streets located
in CORTE PARK SUBDIVISION are hereby accepted for
maintenance by the City of Fairhope as per rec-
commendation by Moore Engineering Associates, and
as per Section 19-2, Fairhope Code of Ordinances.

Councilwoman Puckett introduced, and moved for the adoption
of, the following resolution. Seconded by Councilman Ford,
motion passed unanimously:
RESOLUTION NO. 251-88
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY
OF FAIRHOPE, ALABAMA, That the sewer lift station,
lines, and appurtenances in LAKEWOOD CLUB ESTATES,
also known as AZALEA RIDGE, Point Clear, Alabama,
are hereby accepted for maintenance as per the
recommendation of the Fairhope Water and Sewer
Department Superintendent.

A petition for annexation of the property on Nichols
Street extension by the Gaston -Lee VFW Post No. 5660 was
discussed. An ordinance to annex was introduced by
Councilman Shull. This ordinance will be given final
consideration at the next regular session.
Council briefly discussed the refinancing of the FmHA
waterline debt. Mayor Nix said additional information
would be coming in on next Thursday and action should be
delayed until thenevT? a special session is needed.

For insurance purposes, Councilman Ford moved to approve
the following additions and deletions to the Volunteer
Fire Department roster: ADD - Scott Clemens, Jr.
DELETE - Kenneth Babb, Ted Gautney, Ed Harding, and Ted
Marik. Seconded by Councilman Shull, motion passed
unanimously.
Due to the annual Alabama League of Municipalities
Convention May 21 - 25, Councilman Ford moved to approve
the rescheduling of the second regular May meeting, on
May 23rd, to Wednesday, May 25th, same time, same place.
Seconded by Councilman Shull, motion passed unanimously.
Meeting was duly adjourned at 5:45 pm.
