HomeMy WebLinkAbout03-14-1988 Regular Meeting921 STATE OF ALABAMA Z COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 5:30 pm; Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532; on Monday, 14 March 1988. Present were Mayor James P. Nix; Councilmembers Roy C. White, Jeanette Puckett, David E. Bishop, Michael A. Ford, and Barney L. Shull; City Attorney James Reid and City Clerk Evelyn Phillips. No one was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 22 February 1988 regular session were duly approved. A public hearing on the destruction of obsolete records was held as duly advertised in the EASTERN SHORE COURIER, February 3rd and 10th issues. No one present had any ob- jection to the disposal of the records. Mayor Nix advised Council that the State Department of Archives had notified the City Clerk that the records disposal section of the Alabama Code had been repealed by the Alabama Legislature late in 1987 and the new regulations have not yet been formulated. After discussion, Councilman Ford moved to proceed with records disposal as planned as soon as it is possible to do so. Seconded by Councilwoman Puckett, motion passed unanimously. Mr. Bill Staff, Vice -President of the local Kiwanis Club, addressed the Council on the subject of a new Kiwanis project. The Kiwanis Club has established a scholarship fund to be used to help underprivileged Fairhope High School seniors further their education. A limited number of prints of a lithograph of Fairhope landmarks by a well-known Tennessee artist, Rusty Bradley, will be sold by the Club to finance this project. Mr. Staff was pleased to present to the City Print No. 100. The Mayor and Council expressed their appreciation for the print which will be placed in the City Hall. Councilman Bishop reported that he and Minister Max Boone have been working on a program to make local citizens more aware of local laws most frequently violated in the City as the Council asked them to do several meetings ago. Mr. Bishop said Chief Nolte is preparing a report on the most frequent violations; Assistant Chief Jerry Anderson is working on an awareness program to be presented to school students; and plans to recognize local law enforcement personnel are being coordinated with the VFW Club's "Lawman of the Year" program. Present plans are to designate the first week in May as "Law Week" in Fairhope. 14 March 1988 922 Mrs. Joy Word asked permission to place two tables in front of her plant shop, Joy's Patio on North Church Street, on which to display bedding plants in the spring and fall. The tables would be on the City's right-of-way. Councilman White expressed concern about the City's liability for personal injury or property damage if Mrs. Word's request is approved. Councilman White moved to paint hash marks through.a portion of the area in front of the shop which is off -set from the curb. This marked area would be a "no parking" space,even with the present curb, and Mrs. Word can place her tablesthere. Seconded by Councilman Shull, motion passed unanimously. Council reviewed an application by William Paul Cadenhead, dba SNEAKERS, for a Club Liquor License. The business is located at the intersection of US 98 and County 32 and is in the police jurisdiction. Mr. Cadenhead advised Council that he wanted to change his application from a Club License to a Loun e Liquor License since he has decided not to operate on Sunday. Mr'. Cadenhead was advised that such a license required that no one under the age of 21 could be on the premises. Mr. Cadenhead indicated that he understood this. No one present was opposed to the approval of a Lounge Liquor License. There was police approval. Required publications were made. Councilman Ford moved for approval of a Lounge Liquor License. Seconded by Councilman Shull, motion passed unanimously. Councilman White moved to approve funding up to $3,000.00 to send five Volunteer Fireman to Fire School. Seconded by Councilwoman Puckett, motion passed unanimously. Councilman. Shull moved to send a letter to the Alabama ABC Board stating the City has no objection to the transfer of the VFW Club #5660 liquor license from their present location.on North Mobile Avenue to their new location on East Nichols Street. Seconded by Councilman White, motion passed unanimously. Councilman Bishop introduced an ordinance to number the council places for the 1988 Municipal Election. This ordi- nance will be given final consideration at the next regular council session. Councilman White introduced, and moved for the adoption of, the following resolution. Seconded by Councilman Shull, motion passed unanimously: Resolution No. 248-88 on next page... 14 March 1988 923 RESOLUTION NO. 248-88 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE ALABAMA That the street or streets located in Volanta Pines Sub -Division in the City of Fairhope, Alabama, is hereby accepted for maintenance by the City of Fairhope on recommendation of the Design Engineer (Moore Engineering Associates) as per Section 19-2, Fairhope Code of Ordinances. ADOPTED THIS 14th DAY OF MARCH, 1988. ,James Nix, Mayor ty C rk Mayor Nix advised that, per letter by Stuart Stephenson, Jr., South Central Bell has changed the completion date for the updating of the Fairhope switching station from September, 1990, to September, 1989. The Council had requested this be done several months ago. Councilwoman Puckett moved to pay bills as presented. Seconded by Councilman Shull, motion passed unanimously.
