HomeMy WebLinkAbout06-09-1986 Regular Meeting751 STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, Alabama, met in regular session at 5:30, p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Monday. 9 June 1986. Present were Mayor James P. Nix; Councilmembers Roy C. White, Trisha Lo Porto, David E. Bishop, and Michael A. Ford; City Attorney James Reid and City Clerk Evelyn Phillips. Councilman Barney L. Shull was absent. There being a quorum present, Mayor Nix called the meeting to order. Minutes of the 26 May 1986 regular session were duly approved. Ms. Freida Garcia was not present to present a request to the Council to set up a portrait booth in the Beach area. Council reviewed an application for a Restaurant Liquor Li- cense by Van Tran, dba TWIN OAKS STEAKS & SEAFOOD, 805 South Mobile Street. There was police approval. No one present was opposed to the license. Councilman Ford moved for approval. Seconded by Councilman White, motion passed unanimously. Council reviewed an application for a Club Liquor License by Harry P. Johnson, dba CACTUS CAFE, 69 South Greeno Road. There was police approval. Mr. Johnson presented proof of the required advertising in the May 21st and May 28th issues of the EASTERN SHORE COURIER. A small group of people were present to oppose the license. Mr. Johnson said he was applying for the license only in order to serve liquor, wine, and beer with meals on Sundays and was not interested in a Club License per se. Under current state laws, the Club License is the only way to do this. Mayor Nix said he thought there had been some recent licensing changes and perhaps there was a type license that would better suit Mr. Johnson's need. Councilman Ford moved to hold over the application until the next regular session so this could be checked out. Seconded by Councilwoman Lo Porto,motion carried by the following vote: AYE - Ford, Lo Porto, White, and Nix. NAY - Bishop. Councilman Bishop introduced Ordinance No. 766, an ordinance to amend the Zoning Ordinance by rezoning the Chester Hunt pro- perty at 415 Young Street, as requested by Mr. Hunt, from R1 Low Density Single Family Residential to R5 High Density Dwelling Residential. No one was present to oppose the rezoning. The Planning $ Zoning Commission recommended approval of the request. Councilwoman Lo Porto moved to suspend the rules and act immedi- ately on the proposed ordinance. Seconded by Councilman Ford, motion passed unanimously by the following vote: AYE - Bishop, Lo Porto, White, Ford, and Nix. NAY - none. Councilman Bishop then moved for final adoption of Ordinance No. 766. Seconded by 9 June 1986 7S2 Councilwoman Lo Porto, motion to adopt Ordinance No. 766 passed unanimously by the following vote: AYE - Bishop, Lo Porto, White, Ford, and Nix. NAY - none. Councilman White introduced Ordinance No. 767, an ordinance to annex a small parcel of land,as requested by Auburn University a land-grant university of the State of Alabama, lying on the eastern corporate limits just north of Dyer Road. No one present opposed this annexation. Councilman Ford moved to suspend the rules and act immediately on the proposed ordinance. Seconded by Councilman Bishop, motion passed unanimously by the following vote: AYE - Bishop, Lo Porto, White, Ford, and Nix. NAY - none. Councilman White then moved for the final adoption of Ordinance No. 767. Seconded by Councilman Bishop, motion to adopt Ordi- nance No. 767 passed unanimously by the following vote: AYE - Bishop, Lo Porto, White, Ford, and Nix. NAY - none. Councilwoman Lo Porto introduced Ordinance No. 768, an ordi- nance to annex and zone property owne by John C. Glover, Inc., known as Rolling Oaks South subdivision. No one present opposed this annexation or the requested R-2 zoning current with annex- ation. The zoning request had the approval of the Planning $ Zoning Commission. Councilman Bishop moved to suspend the rules and act immediately on the proposed ordinance. Seconded by Councilwoman Lo Porto, motion passed unanimously by the following vote: AYE - Bishop, Lo Porto, White, Ford, and Nix. NAY - none. Councilman Bishop then moved for final adoption of Ordinance No. 768. Seconded by Councilman Ford, motion to adopt Ordinance No. 768 passed unanimously by the following vote: AYE - Bishop, Lo Porto, White, Ford, and Nix. NAY - none. Councilman Bishop introduced Ordinance No. 769, an ordinance to annex property owned by the Baldwin County Board of Education, known as the Middle School property. No one present opposed this annexation. Councilwoman Lo Porto moved to suspend the rules and act immediately on the proposed ordinance. Seconded by Councilman Ford, motion passed unanimously by the following vote: AYE - Bishop, Lo Porto, White, Ford, and Nix. NAY - none. Councilwoman Lo Porto then moved for final adoption of Ordinance No. 769. Seconded by Councilman Ford, motion passed unanimously by the following vote: AYE Bishop, Lo Porto, White, Ford, and Nix. NAY - none. Councilwoman Lo Porto moved to pay bills as presented. Seconded by Councilman White, motion passed unanimously. Councilwoman Lo Porto was given the floor to read the following prepared statement: 9 June 1986 75S "I would like to take this opportunity to announce my resignation from the Council, effective June loth. I am indebted to the citizens of Fairhope for seven years of support. The vote of confidence given to me in two overwhelming election victories will always give me pride. I have enjoyed my service on the Council and hope that in a small way I have contributed to the wonderful quality of life in Fairhope. My decision to resign has been a very difficult one. I am pleased with the development of Fairhope and interested in the future of the various projects before us; however, I feel the time has come for me to step down.
