The City Council, City of Fairhope, Alabama, met in
regular session at 5:30, p.m., Fairhope Municipal Complex
Council Chamber, 161 North Section Street, Fairhope, Alabama
on Monday, 28 April 1986.
Present were Mayor James P. Nix; Councilmembers Roy C.
White, Trisha Lo Porto, Michael A. Ford, and Barney L. Shull;
City Attorney James Reid and City Clerk Evelyn Phillips.
Councilman David E. Bishop was absent.
There being a quorum present, Mayor Nix called the meet-
ing to order. Minutes of the 14 April 1986 regular session
were duly approved.
A public hearing on two ordinances; one to rezone certain
properties and one to make amendments and adjustments to
various sections of the Zoning Ordinance; was held as ad-
vertised. These two ordinances are the result of about a
year's work, having to do with the City's Comprehensive
Plan. Both were recommended for approval by the Planning
and Zoning Commission. No one present was opposed to either
ordinance, both of which were explained in full by Building
and Zoning Official Bob Lunsford. After discussion,
Councilman Ford introduced both ordinances. In order to
take immediate action, Councilman Shull moved to suspend
the rules. Seconded by Councilwoman Lo Porto, motion passed
unanimously by the following vote: AYE - Shull, Lo Porto,
White, Ford, and Nix. NAY - none. Councilman Ford then
moved for final adoption of Ordinance No. 764, an ordinance
to rezone certain properties; and Ordinance No. 765, an
ordinance amending and adjusting the Zoning Ordinance.
Seconded by Councilwoman Lo Porto, motion passed unanimously
by the following vote: AYE - Shull, Lo Porto, White, Ford,
and Nix. NAY - none.
Council reviewed an Off -Premises Beer and an Off -Premises
Wine License application by Leslye C. Broadus, dba D-MART,
located at intersection of US 98 and County 32 in Pt Clear.
There was police approval. No one present was opposed to
the licenses. The application is due to an ownership change.
After discussion, Councilman Shull moved to approve the
application for both licenses. Seconded by Councilman White,
motion passed unanimously.
Council reviewed an Off -Premises Beer and an Off -Premises
Wine License application by Michael J. Patrick, Mgr., dba
DELTA MART, located at 150 South Section Street. A lengthy
presentation in favor of license approval was made by several
officials and employees of the owner, Burwick Bay Oil Company,
Inc., of Morgan City, Louisiana; and legal representative

Ken Gibson. Opposing the licenseswere representatives of
the United Methodist Church and three citizens. There was
police approval. After discussion, Councilwoman Lo Porto
moved for approval of the licenses. Seconded by Councilman
Shull, motion failed by the following vote: AYE Shull
and Lo Porto. NAY - Ford, White, and Nix. Application
approval was denied.
Councilman White moved to authorize City Attorney Reid
to begin condemnation proceedings on a building located
at 666 Morphy Street; owners of record being Robert Allsman,
William Richmond, and John Bethea. Seconded by Councilman
Shull, motion passed unanimously.
Council discussed and took action as follows on the
following bids opened by the Purchasing Department as ad-
vertised: (Vehicles for the Electric Dept.)

Councilwoman Lo Porto moved to accept Gaston Ford's low bid,
provided all specifications are met, and *provided delivery
date not to exceed 90 days. Seconded by Councilman Ford,
motion passed unanimously.

The purchasing agent and the electrical department superin-
tendent asked that action on this bid be delayed until the
next regular Council session.

Councilwoman Lo Porto moved to accept the Truck Equipment
Company low bid, provided all specifications are met.
Seconded by Councilman White, motion passed unanimously.
The Baldwin County Board of Education request for
annexation was withdrawn.
Councilman White moved to hear the following items of
business not on the Agenda. Seconded by Councilwoman Lo
Porto, motion passed unanimously:
Councilman Shull reported on the status of the proposed
Municipal Golf Course project by explaining there were three
items pending .... (1) the City -Corte memorandum of Agreement,
(2) Estimated costs, and (3) the outcome of the Corte's
application for zoning now before the Planning $ Zoning
Commission. Councilman Shull said as soon as the Recreation
Board had the Estimated Costs, which were on the way from
the architect, they would meet and prepare a recommendation
for the Council. He mentioned that the Zoning Board had
received and approved the Corte's application in a special
meeting earlier this date (April 28th). After discussion,
Councilwoman Lo Porto moved to schedule a special meeting
as soon as possible after the Recreation Board prepared
their recommendations. Seconded by Councilman Shull, motion
passed unanimously.
Mayor Nix reported Mr. Brown Milligan, recently appointed
to a 2-year term on the Fairhope Downtown Redevelopment
Authority, had resigned due to his relocation outside of
Fairhope. Councilman Ford moved to appoint Mr. Geoff Cain
to this term. Seconded by Councilman Shull, motion passed
unanimously.
Meeting was duly adjourned.
