Pfiester for the purchase of natural gas; and for considering the request by Alabama Trash Service, Inc., to transfer their contract with the City to Browning -Ferris Industries. CONSENT TO HOLDING OF MEETING The undersigned members of the City Council of the City of Fairhope, Alabama, do hereby acknowledge service of the Notice and Call of Special Meeting hereinabove set forth and do hereby consent to the holding of such meeting at such time and in such place and for the purposes set forth therein. Bishop out-of-town. ••: STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council, City of Fairhope, met in special Session at 5:00, p.m., Fairhope Municipal Complex Council Chamber, 161 North Section Street, Fairhope, Alabama 36532, on Tuesday, 5 November 1985. Present were Mayor James P. Nix; Councilmembers Roy C. White, Michael A. Ford, and Barney L. Shull; City Attorney James Reid and City Clerk Evelyn Phillips. Councilmembers Trisha Nelson and David E. Bishop were out-of-town. . The purpose of this meeting was to consider a contract to purchase Natural Gas from Sam L. Pfeister of Midland, Texas; and to consider a request from Alabama Trash Service, Inc., to transfer their existing contract, as is, to Browning -Ferris Industries. There being a quorum present, Mayor Nix called the meeting to order. Council discussed the Pfeister Contract to purchase 250 Mcf's of natural gas per day from Pheister's Ella Little 17-16 well located south of Fairhope at $2.50 Mcf, for a 5-year period. Councilman White introduced, and moved for the adoption of, the following resolution. Seconded by Councilman Shull, motion passed unanimously: RESOLUTION NO. 168-85 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that the Mayor is authorized to execute a contract for the purchase of Natural Gas by the CITY OF FAIRHOPE from SAM L. PFEISTER, dated 5 November 1985. ADOPTED THIS 5th DAY OF waffs, - �H NO ER, 1985. ame Nix, Mayor Council read a letter from Mr. James Vandiver, President of Alabama Trash Service, Inc., of Birmingham, which requested their approval of the transfer of ATS's present contract to remove trash to Browning -Ferris Industries. Mr. Vandiver explained that ATS, due to financial problems, could not provide the equipment to complete the contract with the City which does not expire until 31 July 1987. After some discussion, Councilman Ford introduced, and moved for the adoption of, the following resolution. Seconded by Councilman Shull, motion passed unanimously: 5 November 1985 RESOLUTION NO. 169-85 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that the Mayor is authorized to execute an approval of the transfer of that certain contract, as is, dated the 24th day of April, 1984, to cover the 3-year period from 1 August 1984 to 31 July 1987, between ALABAMA TRASH SERVICE, INC., and the CITY OF FAIRHOPE; to: BROWNING-FERRIS INDUSTRIES as per the written request by James Vandiver, President of ATS, Inc., dated 29 October 1985; said transfer to be effective on 1 November 1985.
