STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 5:30 P.M., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 12 August 1985.
Present were Mayor James P. Nix; Councilmembers Roy C. White,
Trisha Nelson, David E. Bishop, Michael A. Ford, and Barney L.
Shull; City Attorney James Reid and City Clerk Evelyn Phillips.
No one was absent.
There being a quorum present, Mayor Nix called the meeting
to order. Minutes of the 22 July 1985 regular session were
duly approved.
Interest in a public improvements assessments project has
been expressed as follows: Curb $ Gutter on Gayfer Avenue and
South School Street; Paving on Prospect Street, Bon Secour
Street, and an extension of South Church Street if a right-of-
way can be obtained; and full improvements in three developments,
Valley Creek Development, Adrain Johnson's 10 acres on Troyer
Road, and a cul-de-sac off Blue Island for Mrs. Jerome Kilgore.
Councilman White moved to go forward with a project and hold
a public hearing as soon as possible. Seconded by Councilwoman
Nelson, motion passed unanimously.
Councilman Bishop introduced, and moved for the adoption of,
the following Resolution. Seconded by Councilman Shull, motion
passed unanimously:
RESOLUTION NO. 162-85
WHEREAS, Utility easements are necessary for the
Community Development Block Grant,Project #LSPPF84034;
THEN, THEREFORE BE IT RESOLVED by the governing body
of the City of Fairhope that James P. Nix, in his
capacity as Mayor of the City, is hereby authorized
to obtain said easement from Drs. Ferd Dietze and
Thomas Yancy; and to locally amend the project
budget accordingly.
ADOPTED THIS 12th DAY OF AUGUST, 1985.

Councilwoman Nelson introduced an ordinance to prohibit
the parking of vehicles "For Sale" in the Municipal Complex
parking area, or any City parking area; and to prohibit the
parking of "Campaign Advertising" vehicles on Election Days
in the Municipal Complex parking area. This ordinance will
be considered for final adoption at the next regular session.
Council filled three unexpired terms on the following
Boards:
Councilman Bishop nominated Mrs. Mary Milley to complete
Dr. Shepherd's unexpired 5-year term (to 1988) on the Fairhope
Library Board. There being no other nominations, Councilman
Shull moved the nominations be closed and Mrs. Milley appointed.
Seconded by Councilwoman Nelson, motion passed unanimously.
Councilwoman Nelson nominated Mr. Gary Moore to complete
Mr. C. W. Coleman's unexpired 5-year term (to 1988) on the
Fairhope Industrial Board. There being no other nominations,
Councilman Ford moved to close the nominations and to appoint
Mr. Moore. Seconded by Councilman Bishop, motion passed
unanimously.
Mayor Nix nominated Mr. Maxwell Killough to complete
the late Mr. Harold Holder's unexpired 6-year term (to 1989)
on the Planning $ Zoning Commission. There being no other
nominations, Councilman Shull moved to close the nominations
and to appoint Mr. Killough. Seconded by Councilwoman Nelson,
motion passed unanimously.
Marriott's Grand Hotel has asked that a fund be estab-
lished for contributions toward a paved path from the City
to the Grand Hotel. The Hotel has named a Chairman of the
fund drive, Mr. Tim Simmonds, and suggested the path be named
"The Eastern Shore Pathway". Councilman Shull moved to
establish the fund. Seconded by Councilwoman Nelson, motion
passed unanimously.
Council discussed suggestions for litter control in the
City. Councilman Ford suggested the police could more rigidly
enforce current anti -litter ordinances, possibly use courtesy
tickets for first offenses, then use the Court to deter habitual
offenders. Councilman White said he felt litter was more a
"people" problem than a governmental one; suggested social and
civic clubs, and the Ministerial Association be contacted to
enlist their help. Councilwoman Nelson suggested help could
also be asked of school clubs and groups. Councilman Bishop
suggested a trash -day reminder could be placed on utility bills.
It was also suggested that more trash receptacles would help.
Councilmen Shull and Ford made a report on the beach
erosion problem at the end of White Avenue. After some dis-
cussion, Councilman Shull moved that the following three
