COUNTY OF BALDWIN
We, the undersigned members of the Fairhope City Council, do
hereby waive notice of a special -called meeting to be held
13 October 1982 at 5:30 o'clock, P.M., Fairhope Municipal
Complex, 161 North Section Street, Fairhope, Alabama, for
the purpose of business on the 1982 Public Improvements project.

The City Council, City of Fairhope, met in special session
at 5:30 o'clock, P.M., Fairhope Municipal Complex, 161 North
Section Street, Fairhope, Alabama 36532, on'Wednesday,
October 13, 1982.
Present were Mayor James P. Nix, Councilmembers C. 0. Mc -
Cawley, Sam E. Box, David E. Bishop, and Roy C. White; City
Attorney Jim'Reid and City Clerk Evelyn Phillips. Councilwoman
Trish Nelson was absent due to illness.
The purpose of this meeting was business relating to the
1982 Public Improvement Assessment project.
Local Attorney Dick Lacey was present to represent Mr. Jack
Pope, sole property owner of Twin Echo Court, and repeated Mr.
Pope's request that Twin Echo Court be deleted from the project.
City Attorney Reid reported that he had researched the legal
aspects of this deletion at this time and advised Council it
could be done provided that no costs were passed on to the re-
maining property owners in the project. Mr. Lacey was advised
that Mr. Pope would be responsible for $483.92 - $333.92 engineering
and $150.00 legal fees directly attributable to Twin Echo Court -
and Mr. Lacey agreed that his client would accept this respon-
sibility.
Councilman Bishop moved to delete the improvements described
in Section I, paragraph (f) Twin Echo Court of Improvement Or-
dinance No. 692. Seconded by Councilman McCawley, motion passed
unanimously.
Councilman White introduced, and moved for the adoption of,
the following Resolution. Seconded by Councilman Box, motion
passed unanimously:
RESOLUTION NO. 59-82
A RESOLUTION TO AWARD CONTRACTS ON THE 1982 PUBLIC
IMPROVEMENTS ASSESSMENTS PROJECT
BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA,
as follows:
SECTION ONE. That the bid of Temco, Incorporated, of Bay Minette, Alabama,
or the sum of $273, 263.70, for the construction of the streets and
drainage improvements; and the bid of Fairhope Paving Company, Inc., of
Fairhope, Alabama, for the sum of $120,247.50, for the construction of
the water and sewer improvements; as described in Improvement Ordinance
No. 6929 be and the same hereby is accepted, with adjustments as described
in the following Section; each being the lowest responsible bid submitted.

SECTION TWO. That contracts be awarded as follows for the improvements
described in -Improvement Ordinance No. 692, less Volanta Avenue deleted
by Council action 9/13/82, less credit for an engineering redesign of
an outfall line due to the Littleton easement, less Twin Echo Court
deleted by Council action 10/13/82:
(a) TEMCO, INC - $273,263.70 for streets and drainage with an
immediate Change Order to decrease bid amount
by $31,612.17 (Net - $241,651.53)
(b) FAIRHOPE PAVING COMPANY, INC - $120,247.50 for water and sewer
work with an immediate Change Order to decrease
bid amount by $28,204.45 (Net - $92,043.05)
(c) awarding of said contracts to be upon receipt of required perform-
ance bonds, labor and materials bonds, and certificates of
insurance.
SECTION THREE. That the Council has investigated and ascertained that
no costs involved with deleted items will be passed on to the remaining
proprety owners involved in the 1982 Public Improvements Assessment project.
SECTION FOUR. That the Council has investigated and ascertained and
hereby'finds that Temco, Inc., and Fairhope Paving Company, Inc., are
duly licensed and are qualified bidders under the terms of the Notice
to Contractors published in the EASTERN SHORE COURIER, a newspaper
published in, and of general circulation in, the City of Fairhope, in
the issues of August 12 and 19, 1982, and that each bid complied with
the Alabama Code of 1975, and each bid was accompanied by a certified
check or bid bond in a sum not less than 5% of the total bid price.
ADOPTED THIS 13th DAY OF OCTOBER, 1982.
