HomeMy WebLinkAbout06-14-1982 Regular Meeting383 STATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 5:30 p.m. City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama 36532 on Monday, 14 June 1982. Present were Mayor James P. Nix; Councilmembers David Ed Bishop, Roy C. White, Trisha Nelson, Sam E. Box, and C.O. McCaw - ley; City Attorney Jim Reid and City Clerk Evelyn Phillips. Minutes of the May 24 regular session and the May 28 and June 10 special sessions were duly approved. Council reviewed an On/Off-Premises Wine License application by Leodis Mitchell, dba THE SUNSET LOUNGE located on the corner of Nichols Avenue and Young Street. No one present was opposed to the application. Mr. Mitchell's application was approved by the Police Department. Councilman Box moved to approve the applica- tion. Seconded by Councilman White, motion passed unanimously. A Public Hearing was held on the rezoning of an area along Middle Street and Young Street. It is the recommendation of the Planning & Zoning Board that this area be rezoned from R-2, Low Density Single Family Residential, to B-1, Local Shop- ping District. No one present was opposed. Councilman White introduced an Ordinance making this Zoning change. Final action on the Ordinance will take place at the next regular Council session. Mr. Franz Cornelius, dba PRIME TIME GAMES at 23 South Section Street, requested permission to place a bicycle rack in 2 parking spaces in front of his business. After discussion, Councilman McCawley moved to take this request under advisement for study for two weeks before taking action. Seconded by Councilman Bishop motion passed unanimously. Mayor Nix advised Council that he had received a request from the Pepsi Cola Company for permission to hold a "Pepsi Taste Test" at the Municipal Pier on June 25, 26, 27. Councilwoman Nelson moved to grant permission.. Seconded by Councilman Box, motion passed unanimously. Councilman White introduced Fire Chief Don Walker and said he had an announcement to make for the Fairhope Volunteer Fire Department. Chief Walker said he was pleased to announce that the Volunteer Fire Department had voted to furnish a complete Fire Alarm System to be installed in the new Municipal Civic Complex. Councilman White, Mayor Nix, and the Council expressed appreciation for the gift. 6/14/82 384 Councilman McCawley reported on the activities planned for the Fourth of July celebration, whose theme is to be "Back to Patriotism". He also announced that Central Bank, N.A., had generously offered to be the sole sponsor of the fireworks demonstration, a donation of $4,000.00. Councilman McCawley moved to have a Resolution of appreciation preparted and sent to Central Bank, N.A., in appreciation of this donation. Seconded by Councilman Box, motion passed unanimously. Mr. Pat Scott and Mr. Charlie Thomas, of Layne -Central Company of Pensacola; made an appeal to the Council regarding the liquidation damages charge on their contract with the City on the Waterline Extension project. Mr. Scott and Mr. Thomas were told that the decision to invoke the LD clause is still firm and the position of the Council remains as expressed and recorded in the minutes of the April 12, 1982, session. Mr. Mike Zoghby asked to address Council on the subject of safety at the Municipal Pier. Mr Zoghby said he felt the rails on the pier were not adequate on prevent a child's falling through the spaces and suggested additional rails or netting of some kind be added. After some discussion, Councilman Box moved to turn this matter over to Gen. Supt. Phil Rutherford and Building Official Bob Lunsford for study and to report back to Council with cost figures on Mr. Zoghby's suggestions. Seconded by Councilwoman Nelson, motion passed unanimously. Councilman McCawley moved to pay bills as presented. Seconded by Councilman Box, motion passed unanimously. Meeting was duly adjourned. Ma y uie
