COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular
session at 5:30 p.m., City Administration Building, 387
Fairhope Avenue, Fairhope, Alabama 36532, on Monday,
May 10, 1982.
Present were Mayor James P. Nix; Councilmembers C.O.
McCawley, David Ed Bishop, and Roy C. White; City Attorney
Jim Reid and City Clerk Evelyn Phillips. Councilmembers
Sam E. Box and Trisha Nelson were absent.
There being a quorum present, Mayor Nix called the
meeting to order. All unanimously votes here recorded
include a vote by the Mayor.
Minutes of the 29 April 1982 regular session were
duly approved.
Councilman White moved to authorize the advertisements
for a Public Hearing on the rezoning recommended by the
Planning & Zoning Board for a block of parcels on Young
and Middle Streets. Seconded by Councilmamber Bishop,
motion passed unanimously.
Councilman Bishop moved to approve the "Phase B"
portion of the Waterline (FmHA) Extension. Seconded
by Councilman McCawley, motion passed unanimously.
Mayor Nix advised Council that the City had received
a request from First National of Baldwin County relating
to the 1973 General Obligation Electric Warrants issue
and the 1975 General Obligation Refunding Warrants
issue. These two issues, held by the Bank, are in Regis-
tered Form, and the Bank requests that they be reissued
in Coupon Form in the principal amounts: 1973 - $290,000
and 1975 - $370,000. Upon receipt of a signed Indemnity
& Reimbursement Agreement stating that any and all costs
resulting from the accommodation of the Bank's request
would be paid by the Bank, the Council agreed to honor
the request. In order to do so, the following four
Resolutions were adopted:
Councilman McCawley introduced Resolution No.
35-82 authorizing borrowing of $290,000(1973 Electric
Warrants). In order to act at this time, Councilman
McCawley moved to suspend the rules. Seconded by
Councilman White, motion passed unanimously by the
following vote: AYE- McCawley, White, Bishop, and Nix.
NAY - none. Councilman McCawley then moved for the final
adoption of Resolution No. 35-82. Seconded by Councilman
Bishop, motion passed unanimously by the following vote:
AYE - McCawley, White, Bishop, and Nix. NAY - none.

Councilman McCawley introduced Resolution No. 36-82
approving the Official Statement of the City. In order
to act at this time, Councilman McCawley moved to suspend
the rules. Seconded by Councilman Bishop, motion
passed unanimously by the following vote: AYE - McCawley
White, Bishop, and Nix. NAY - none. Councilman McCawley
then moved for final adoption of Resolution No. 36-82
Seconded by Councilman White, motion passed unanimously
by the following vote: AYE - McCawley, White, Bishop,
and Nix. NAY - none.
Councilman White introduced Resolution No. 37-82
authorizing borrowing $370,000(1975 General Obligation
Warrants). In order to act at this time, Councilman
White moved to suspend the rules. Seconded by Councilman
Bishop, motion passed unanimously by the following vote:
AYE - McCawley, White, Bishop, and Nix. NAY - none.
Councilman Bishop then moved for final adoption of Resolu-
tion No. 37-82. Seconded by Councilman White, motion passed
unanimously by the following vote: AYE - McCawley, White ,
Bishop, and Nix. NAY - none.
Councilman Bishop introduced Resolution No. 38-82
approving the Official Statement of the City. In order
to act at this time, Councilman Bishop moved to suspend
the rules. Seconded by Councilman White, motion passed
unanimously by the following vote: AYE - McCawley, White,
Bishop, and Nix. NAY - none. Councilman White then moved
for final adoption of Resolution No. 38-82. Seconded by
Councilman Bishop, motion passed unanimously by the follow-
ing vote: AYE - McCawley, White, Bishop, and Nix. NAY -
none.
Mayor Nix advised Council that a local business had
requested a water rate be published for over 3,000,000
gallons per month. After some discussion, Councilman White
introduced an Ordinance to amend Section 21-38(b) "Other
(water) Customers Outside City"..(other than West Baldwin
customers).. of the City of Fairhope Code of Ordinances by
showing a water rate of $.70 per 1,000 gallons for all over
3,000,000 gallons per month.
Mayor Nix called for nominations to fill Mr. Robert
Mason's position on the Library Board. Mr. Mason preferred
not to be reappointed to another term. Councilman White
moved to appoint C.O. McCawley, Jr. There being no other
nominations, Councilman Bishop seconded the motion. Motion
passed by the following vote: AYE - White, Bishop, and
Nix. NAY - none. ABSTAIN - McCawley(Sr). Mr. McCawley,Jr.
is appointed.

Councilman McCawley moved the following fees be
collected for use of the Beach Area by other than Fairhope
residents, beginning weekends(Friday-Sunday) on May 15th
and going to 7-days-per-week on May 28th: $3.00 per
vehicle with up to 6 persons, an additional $1.00 per
person over 6; and $1.00 per Walk -In. Seconded by
Councilman Bishop, motion passed unanimously.
Councilman Bishop moved to hear the following business
not on the Agenda. Seconded by Councilman McCawley,
motion passed unanimously:
Ms. Jill Hall of the Eastern Shore Pacers explained
her group's plans for a track meet and 2 foot -races they
want to schedule this summer and requested the City's
cooperation with blocking -off streets, traffic, etc.
The track meet will be held in the Stadium and has been
approved by Mr. Ed Nelson. The July 17th race will begin
about 8:00 o'clock, A.M. at the Stadium and follow a backstreet
route along Volanta Avenue, through Colonial Acres, and end
back at the Stadium. Councilman McCawley moved to approve.
Seconded by Councilman Bishop, motion passed unanimously.
The August 21st race will begin late in the evening at
the Public Library, going along Summit, North Bay View,
and Magnolia down to the beach area and ending at the
Pier Oval. Councilman White moved to approve this plan
provided the race is scheduled so as to end before 8:00 P.M.
Seconded by Councilman McCawley, motion passed unanimously.
Councilman McCawley moved to pay bills as presented.
Seconded by Councilman White, motion passed unanimously.
