HomeMy WebLinkAbout02-22-1982 Regular Meeting352 STATE OF AIABAMA COUNTY OF BALDWIN The City Council, City of Fairhope met in regular session at 5:30 p.m. City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama, on Monday, 22 February 1982. Present were Mayor James P. Nix; Councilmembers David Ed Bishop, Sam E. Box, C.O. McCawley, Roy C. White; City Attorney Jim Reid and City Clerk Evelyn Phillips. Councilmember Trisha Nelson was absent due to illness. Minutes of the 8 February regular session and 15 February special session were duly approved. Councilman White moved for final adoption of Ordinance No. 691, an Ordinance to amend Zoning Ordinance No. 557. Seconded by Councilman Box, motion passed unanimously. In further discussion with Mr. Herbert Cummings, 163 White Avenue, regarding the affect upon him of the amended Zoning Ordinance which will no longer allow him to park his commercial vehicle in his front yard, Councilman White moved to allow Mr. Cummings 60 days to apply for a variance through the Board of Adjustments and Appeals without penalty for parking his truck as usual during this time. Seconded by Councilman Bishop, motion passed unanimously. Councilman Bishop introduced'Improve�it Ordihance'No: 692, an Ordinance to provide for certain improvements on Middle Street, Lincoln Street, Volanta Avenue, Fairland Avenue, Wisteria Street, Twin Echo Court, Southern Run, Corte Court, Echo Lane East & West, and Commercial Park Drive(including two alleys). In order to take action at this time, Councilman. White moved to suspend the rules. Seconded by Councilman Box, motion passed unanimously by the following vote: AYE - White, Box, Bishop, McCawley, and Nix. NAY -none. Councilman Bishop then moved for final adoption of Ordinance No. 692. Second- ed by Councilman Box, motion passed unanimously by the following vote: AYE - Box, White, Bishop, McCawley and Nix. NAY - none. Councilman McCawley introduced, and moved for the adoption of, the following resolution. Seconded by Councilman Box, motion passed unanimously: RESOLUTION NO. 31-82 WHEREAS, the City of Fairhope did collect $22,482 for Business Licenses from concerns located in the Police Jurisdiction of the City; and " WHEREAS, the Fairhope Police Department did expend the sum of $121,534 for police protection; and the Fire Depart- ment did expend the sum of $4,653 for fire protection in the Police. Jurisdiction of the City during the past year, (2/22/82) 353 THEN THEREFORE BE IT RESOLVED, that the expense of Fire and Police protection in the Police Jurisdiction of the City of Fairhope, Alabama, did exceed the revenue received from Business Licenses issued to locations in said Police Jurisdiction. ADOPTED THIS 22nd day of February, 1982. Mayor Nix opened the floor for three appointments to the Community Appearance Committee. Councilman McCawley nominated Andrew Lindsey. Councilman Bishop nominated Millie Shankle. Councilman Box nominated Lee Rencher. There being no furhher nominations, Councilman White moved the nominations be closed. Seconded by Councilman Bishop, motion passed unani- mously. Ms. Rencher is reappointed, Mr. Lindsey and Ms. Shankle will replace John Davis and Curtis Gordon on this committee. Mayor Nix advised that E.B. Gwin and Horace Stowe's terms were up on the Parking Authority. Councilman White moved to reappoint Mr. Gwin and Mr. Stowe. Seconded by Councilman Box, motion passed unanimously. Mayor Nix advised that Clarence McCoy's term was up on the Board of Adjustments & Appeals. Councilman Box moved to re- appoint Mr. McCoy. Seconded by Councilman McCawley, motion passed unanimously. Mayor Nix advised that Russell Kilgore's term was up on the Airport Board. Councilman McCawley nominated Gilbert Wesley for this position. There being no further nominations, Councilman Box moved the nominations be closed. Seconded by Councilman Bishop, motion passed unanimously. Mr Wesley is appointed. There was a discussion on the excavation work being done on the 16 acres near Big Head Gully. A small piece of land, .4 of an acre, is needed which belongs to Mrs. Sally Nelson. Mrs. Nelson has agreed to sell this parcel of land to the City for $500.00. Councilman McCawley moved to authorize the Mayor to purchase the parcel from Mrs. Nelson. Seconded by Councilman Box, motion passed unanimously. (2/22/82) 354 Councilman White reported to Council that Mr.Louis Agee had appeared before Planning & Zoning Commission with a rezoning re- quest on his property located at the corner of Young and Middle Streets. Mr. Agee wishes to construct a building to house a TV Sales & Service Shop, Beauty & Barber Shop, Coin laundry and Clothing Store. The property is zoned R-2 Residential and Mr. Agee requests a change to B-2 General Business. Councilman White reported the Planning & Zoning Commission recommended de- nial of the request. Mr. Agee was not present but had indicated that he wished to pursue the request before the Council. Council- man Bishop moved to hear Mr. Agee, setting March 22nd as the Public Hearing date to allow for publication requirements. Seconded by Councilman McCawley, motion passed unanimously. Building Official Bob Lunsford reported that only one bid was received on the second phase of the Civic Center canopy. J.B. Construction Company $18,714.00. Mr. Lunsford also reported that he had negotiated a price of $13,988.45 on the Phase IX Glass work with Eastern Shore Glass Company. After some discussion Councilman White moved to accept the two bids.- Seconded by Councilman Box, motion passed unanimously. Mayor Nix asked each Councilmember to please contact members of the State Legislature and voice our opposition to the Uniform Beer Tax Law now being considered. Meeting was duly adjourned.
