COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session at
5:30 p.m. City Administration Building, 387 Fairhope Avenue
on Monday, 8 February 1982.
Present were Mayor James P. Nix; Councilmembers C.O. McCawley
Sam E. Box, Trisha Nelson, Roy C. White, and David Ed Bishop;
City Clerk Evelyn Phillips and City Attorney Jim Reid
Minutes of the 25 January regular session, 29 January special
session, and 4 February 1982 special session were duly approved.
Baldwin County Electric Membership Corporation made a
presentation to the Mayor and Council of their check to cover
1982 Business License, in amount of $2,628.50 which represents
1.5% of gross receipts from sales of electrical service in
the police jurisdiction of Fairhope.
A public hearing was held on the proposed ordinance to amend
Zoning Ordinance No. 557. Mr. Herbert Cummings had written in
a protest to amending Section 60.312 which would no longer allow
him to park his transfer truck at his home at 163 White Avenue.
This matter was discussed and it was decided that Mr. Cummings
needs could be handled on an individual basis. Mrs. Matthews had
a question on home occupations which was answered by reviewing
the amendments. After some discussion, the amending ordinance
was introduced, as proposed, by Councilman White.
A discussion was held on the February 4th public hearing
on the proposed Public Improvements project. Legal advice on
the fact that a sewer line and a water line were omitted from
Improvement Ordinance No. 687 was to (1) delete the lines from
the project and proceed, or (2) rescind Ordinance No. 687 and
begin the legal process with a new Ordinance including the lines.
Mr. Moore of Moore Engineering was present and participated in
the discussion. It was decided to rescind and begin again:
Councilman White introduced Ordinance No. 690, an Ordinance
to rescind Improvement Ordinance No. 687. In order to take
action on this ordinance at this time, Councilman Box moved to
suspend the rules. Seconded by Councilman Bishop, motion passed
unanimously by the following vote: AYE -Box, Bishop, White, Nel-
son,McCawley and Nix. NAY - none. Councilman White then moved,
for final adoption of Ordinance No. 690. Seconded by Councilman
Box, motion passed unanimously by the following vote: AYE -
White, Box, Bishop Nelson, McCawley and Nix. NAY - none. Council-
man White then moved to authorize Moore Engineering to prepare
a new improvements and materials descriptions list and a certified
list of property owners for the preparation of a new Improvements
Ordinance to cover the same project as covered in rescinded
Ordinance No. 687 --- omitting (a) Section Street(Volanta View

sewer line), (g) School Street, and (h) Liberty Street ---
and, also, authorize the City Clerk to prepare a bill for all
costs involved in the abandoned project for payment by Moore
Engineering. (Mr. Moore indicated his agreement to pay.)
Seconded by Councilman Bishop, motion passed unanimously.
Councilman Box moved to approve the closing of Fairhope
Avenue, from Church Street east to Section Street; of Section
Street, from Fairhope Avenue south to Delamare; and of Church
Street, from Magnolia Avenue south to Delamare, for the Arts
& Crafts Festival on March 26, 27, and 28th. Seconded by
Councilman McCawley; motion passed unanimously.
Councilwoman Nelson moved to allow Motor Home and Trailer
parking in the Municipal Pier area south of the Big Pier during
Arts & Crafts weekend, and to.allow the Eastern Shore Chamber
to charge a deposit for clean-up. Seconded by Councilman Box
motion carried by the following.vote: AYE: -Nelson, Box, McCawley
and Bishop. NAY -White.
Councilman Bishop moved to.allow the Spring Fever Chase to
pass through town on.Fairhope Avenue at 8:00-8:15 am during
Arts & Crafts Festival. Seconded by Councilwoman Nelson, motion
carried by the following vote: AYE -Bishop, Nelson and McCawley
NAY -Box and White.
Councilwoman Nelson moved to support the Kiwanis Club pro-
ject to landscape the triangle at Baldwin 98- Highway(4-lane) 98
intersection, the State Highway Department to approve type of
planting. Seconded by Councilman White, motion passed unanimously.
Councilman Box moved to hear the following business not on
the Agenda. Seconded by Councilman McCawley, motion passed unan-
imously:
Councilman McCawley moved to approve the transfer of a fire -
truck assigned to us by the Alabama Agency for Federal Property
Assistance to the Belforest Fire Department. Seconded by Council-
woman Nelson, motion passed unanimously.
Councilwoman Nelson moved to request the Corps of Engineers
prepare an Environmental Impact Statement and hold a public hear-
ing on a proposed sewage treatment plant to be located on Blakely
River. Seconded by Councilman McCawley, motion carried by the
following vote: AYE - Nelson, McCawley, Box and Bishop. NAY -
White.
Councilman White moved to pay bills as presented. Seconded
by Councilman McCawley, motion passed unanimously.
