We, the undersigned members of the Fairhope City Council,
do hereby waive notice of a special called meeting to be held.
4 February 1982 at 5:30 pm, City Administration Building, 387
Fairhope Avenue, Fairhope, Alabama, for the purpose of hearing
property owners affected by the proposed Public Improvement
Project, Ordinance No. 687.

The City Council, City of Fairhope, met in special session
at 5:30 pm, City Administration Building, 387 Fairhope Avenue,
Fairhope, Alabama 36532, on Thursday, 4 February 1982.
Present were Mayor James P. Nix; Councilmembers Sam E. Box,
C. 0. McCawley, Roy C. White, and Trisha Nelson; City Attorney
Jim Reid and City Clerk Evelyn Phillips. Councilman David Ed
Bishop was absent.
The purpose of this meeting was to hold a Public Hearing on
a proposed public improvements assessment project as per Improve-
ment Ordinance No. 687, adopted 11 January 1982 and published in
the EASTERN SHORE COURIER, a newspaper of general circulation in
and published in the City of Fairhope, on 14 January and 21 Jan-
uary 1582. Notice of this Hearing and a copy of said Improvement
Ordinance No. 687 having been sent by certified mail, postage pre-
paid, to all property owners of record, on 14 January 1982.
Mr. Ack Moore of Moore Engineering Company, Fairhope, was
present to answer questions and to provide estimated costs.
The results of the hearing, by street, are:
(Approx. 70 acres)
SECTION - (Volanta View sewer project) Estimated/$1250.00 per acre.
Opposed were Dyas, Butterworth, Baughman, Frolick, Nesbitt, Postle,
Strauley, and Troup, representing approximately 36 acres.
In Favor were Baumhower, approximately .5 acre, and a Mr. Metcalf
who claimed to represent approximately 7.5 acres, however, Mr.
Metcalf'sclaim was seriously questioned by the property owners
present.
MIDDLE - Estimated $12.70 pf.
No one spoke in opposition. Matt Dial and Walter Woodrow were in
favor. Mr. Chester Hunt wasn't sure about his location, did not
state whether opposed or in favor.
LINCOLN - Estimated $21.50 pf.
No one spoke in opposition. Jansen and Ford, 10001, in favor.
VOLANTA AVENUE - Estimated $6.00 pf.
Mrs. Alice Lay, 1321, opposed. In Favor were Jobski, Goodletson,
Owens, Garner, Carpenter, Darnel, and Myers, each representing
approximately 661. Mr. Keene was opposed but said he would go
along with the majority.
FAIRLAND - Estimated $28.85 pf.
Miss Marii Ziegler, 1321, opposed. Fairhope Single Tax Corp.,
11821, in favor.
WISTERIA - Estimated $28.85 pf.
No one spoke in opposition. Gates in favor. Engineer Moore stated

a sewer line is included on this street, however, this was over-
looked when the information was prepared and given to the City
Clerk for preparation of Ordinance No. 687. City Attorney Reid
is to advise Council if this oversight can be corrected by an
amending Ordinance.
SCHOOL - Estimated $28.85 pf.
Ziegler and Minnich, 364' opposed. No one spoke in favor.
LIBERTY -Estimated $16.50 pf.
Duck, McCarty, McKeun, Sullivan, Eckman, and Gautney, 9381, opposed.
Fuqua, 1001, in favor.
TWIN ECHO COURT, SOUTHERN RUN,
Estimated $28.00 pf.
One property owner, Jack Pope,
another oversight had occurred
not mentioned in Ordinance No.
CORTE COURT, ECHO LANE EAST & WEST -
in favor. Engineer Moore stated
- a water line is included but
687.
COMMERCIAL PARK DRIVE - Estimated $18.50 pf.
One property owner, Matt Dial, in favor. Again, waterline was over-
looked when Ordinance No. 687 prepared.
Mayor Nix concluded the meeting by stating official action would
be taken at the regular Council session on Monday evening, 8 February,
after a proper Ordinance could be prepared to delete School Street,
Liberty Street, Section Street-Volanta View, and to amend Wisteria
Street for the overlooked sewer line and Twin Echo, Southern Run,
Corte Court, Echo Lane, and Commercial Park Drive for the overlooked
water line.
Meeting was duly adjourned.
