The City Council, City of Fairhope, met in regular session
at 5:30 p.m. City Administration Building, 387 Fairhope Avenue
Fairhope, Alabama 36532, on Monday, 25 January 1982.
Present were Mayor James P..Nix; Counci]members C.O. McCawley,
Sam E. Box, Roy C. White, and David Ed Bishop; City Attorney
Jim Reid and City Clerk Evelyn Phillips. Councilwoman Nelson was
absent due to a death in her family.
Minutes of the 11 January regular session and the 19 January
1982 special session were duly approved.
Council reviewed an application for a Beer On/Off Premises
License by Roland Norton and Mike Sealy, dba FAIRHOPE BOWLING CENTER,
located on Greeno Road. A group of citizens were present and were
allowed to voice their opposition to, or their approval of, the
license. Mr..Norton and Mr. Sealy were denied approval for this
license in November 1980, and they offered a pledge, in writing,
that they would not sell the beer "to go", would only sell to
adults, and would not sell beer at all during the times the
Junior Leagues would be bowling. After some discussion, Council-
man Bishop moved to deny approval. Seconded by Councilman Box,
the vote was: AYE - Bishop, Box. NAY - White McCawely. The
Mayor ABSTAINED due to personal interest. The application failed
to win Council approval due to the tie vote.
Mayor Nix advised Council that Mr. Geoff Cain had resigned from
the Organic School Board, and opened the floor for nominations to
complete this unexpired term. Councilman White nominated Mr.
William Butterworth. There being no other nominations, Councilman
Bishop moved to close the nominations. Seconded by Councilman Box,
motion passed unanimously. Mr. Butterworth is appointed.
Councilman White moved to appoint Marion E. Wynne, Jr. as Mn-
icap Judge for a normal 2-year term upon the expiration of his present
termporary appointment, due to expire January 27th. Seconded by
Councilman McCawley, motion passed unanimously.
Councilman Box moved to approve the Spring Fever Chase, provided
the route and the time of the race is coordinated with the Arts &
Crafts Festival Chairman and the Police Department. Seconded by
Councilman Bishop, motion passed unanimously.
Councilman McCawley moved to approve the transfer of securities
from Birmingham Trust National Bank to Central Bancshares of the
South, Inc., as requested by First National Bank of Baldwin County.
Seconded by Councilman Box, motion passed unanimously.

Coumcilmembers were given a copy of an agreement between the _
City and the Municipal Electric Management Authority for study and
action at the next regular session.
Meeting was recessed for 20 minutes until 6:30 p.m. at which
time the Council will hear a committee of businessmen on the subject
of Business Licenses.
Several local businessmen formed a committee to speak to the
Council on the subject of annual Business Licenses. The Committee
offered several objections to the present License Ordinance; stat-
ing the method of licensing was unfair, an invasion of privacy,
and asking that some other method be found instead of annual gross
receipts. Some suggested that licenses be based on profits, number
of employees, fixed fees, or square footage. The Council stated
they felt the gross receipts method had been proven to be the most
fair method and consequently is most widely used method. One member
of the committee kept insisting that more information should be
given to them, such as names of all Licensees. Council stated such
information is privileged and would not be given out in any form.
Council offered a compromise - gross receipts method but reduced
rate schedules to favor those businesses grossing less that $500,000.
The Committee kept insisting on more information. The discussion
became heated. Councilman White moved to adjourn.
Meeting was duly adjourned.
