City of Fairhope, met in regular session at 7:00 p.m., City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama 36532, on Monday, 24 November 1980. Present were Mayor James P. Nix; Councilmembers C.O. McCawley, Sam E. Box, Trisha Nelson, Roy C. White and David Ed Bishop; City Attorney John Duck and City Clerk Evelyn P. Phillips. Minutes of 10 November 1980 regular session and 21 November 1980 special session were duly approved. Councilman Box moved for final adoption of Ordinance No. 659 an amendment to Ordinance No. 252 increasing Harbor Board membership from three to five. Seconded by Councilwoman Nelson, motion passed unanimously. Mayor Nix opened the floor for nominations to the new Harbor Board positions. Councilwoman Nelson nominated Art- thur J. Koppersmith. Councilman Box nominated Robert D. Colling. There being no other nominations, Councilman Bishop moved the nominations be closed. Seconded by Coun- cilman White, motion passed unanimously.Mr. Koppersmith and Mr. Colling are appointed to the Harbor Board for two- year terms. Councilman Bishop moved for final adoption of Ordinance No. 660, annexation of Ingersoll Property. Seconded by Councilman Box, motion passed unanimously. Councilwoman Nelson moved for approval of an Off -Premises Retail Wine License application by John S. Davis, dba OBJECTS, 25 So. Section St. Seconded by Councilman Box, motion passed unanimously. Councilman McCawley moved to deny approval of an On -Off Premises Retail Beer License application by Roland C. Norton dba FAIRHOPE BOWLING CENTER, on Greeno Road, citing the use of the facility by Church groups and a large portion of Fairhope-youth as his reasons for denial. Mr. Norton stated he would not sell to minors, said the Adult Leagues had requested beer be available, and that he needed the business advantage. Councilman Bishop seconded the motion to deny approval. Motion carried by the following vote: AYE - McCawley, Box Bishop and White. NAY - Nelson. Fire Marshal Herman Taylor reported to Council there had been remarkable progress toward correcting the problems (11/24/80) 237 at Ingram Electric Company on Fairhope Avenue. He reported all priority items, fire hazards, had been corrected and the company was working with Building Official Lunsford on the structural problems. Mr. Taylor will report to Council when all problems are solved or if the company fails to completely comply with the necessary corrections. Councilman McCawley moved for final adoption of the Community Appearance Committee Resolution. Seconded by Councilman Bishop, motion passed unanimously. The City Clerk was asked to contact the groups from which the membership will be composed, requesting names for consid- eration by the Mayor and Council for appointment to the Committee at the first January regular session. Councilman Bishop introduced Ordinance No. 661, an Ordinance amending the Zoning Ordinance changing from R2 to B4 lands belonging to the Fairhope Single Tax Corp- oration lying in Blocks 2, 3, and 15 of Division 4 (Section 17, T6S, R2E), leaseholders being D. Turnbull, E. Roberts, D. Stapleton, E. Creamer, F. Houtkamp, I. Pierce, G. Fuqua, A. Hughes, and E.-Pedneau. This Ordinance is a housekeeping item as this rezoning was duly carried out in July, 1978, but an Ordinance was not adopted at that time. (See 7/10/78 Council Minutes.) In order to take final action on this Ordinance, Councilwoman Nelson moved to suspend the rules. Seconded by Councilman White, motion passed by the following unanimous vote: AYE - Bishop, Nelson, Box, White, and McCawley. NAY - none. Councilman Bishop then moved for final adoption of Ordinance No. 661. Seconded by Council- woman Nelson, motion passed unanimously. Councilman White introduced Ordinance No. 662, an Ordinance providing for a license and for bookkeeping and reporting purposes for Itimerant Buyers of Gold and Silver, including but not limited to second precious metals, gems, etc., and providing for violations and penalties therefor. In order to take final action on this Ordinance, Councilman Box moved to suspend the rules. Seconded by Councilman McCawley, motion passed by the following unanimous vote: AYE - Box, McCawley, Nelson, White, and Bishop. NAY- none. Councilman White then moved for.final adoption of Ordinance No. 662. Seconded by Councilman Bishop, motion passed unanimously. Judge Phyllis Nesbit asked Council to support the National Safety Council, Mobile Chapter, by a donation of $150.00. Judge Nesbit was asked to present this plea due to her residing in Fairhope. She stated the Council was responsible for the safe driving school used by the Fairhope Municipal Court. Councilman McCawley moved to approve payment. Seconded by Councilman Box, motion passed unanimously. Councilman Box moved to hear the following items not on the Agenda. Seconded by Councilman White, motion passed unanimously: 11/24/80) 238 Councilman White moved to approve payment of a final invoice from Valta Construction Company and from Fairhope Title & Survey Company on the Morphy Street Project. Seconded by Councilman McCawley, motion passed unanimously. Councilman Box moved to present certificates for a Christmas Turkey to all members of City Boards and to award each employee a $50.00 Christmas Bonus as was done last year. Councilman White asked that the minutes show that Councilmembers who serve on Boards would not receive the Turkey certificate. Motion was seconded by Councilman Bishop and carried by the following vote: AYE - Box, Bishop, Nelson, and McCawley. NAY - none. ABSTAIN - White. City Attorney Duck reported he was prepared to start court proceedings against the Fairhope Health Care Center the first of December if their overdue utility bill remained unpaid. Councilman Bishop moved to authorize Attorney Duck to file suit against the City's former retirement plan carrier, New England Life Insurance Company, if a satis- factory transfer of assets is not made by December 1, 1980. Seconded by Councilwoman Nelson, motion passed unanimously. Meeting was duly adjourned. City C19rk
