The City Council, City of Fairhope, met in regular session at 7:00 p.m.
City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama,
on Nbnday, 13 October 1980.
Present were Mayor James P. Nix; Councilmembers David Ed Bishop,
Roy C. White, Trisha Nelson, Sam E. Box, and C.O. McCawley; City
Attorney John Duck and City Clerk Evelyn Phillips.
The Oath of Office was administered to Councilman Sam E. Box by
City Attorney John Duck, Notary Public.
The minutes of the 22 September special and regular sessions, and.
the 6 October organization session, were.duly approved.
Councilman McCawley moved for approval of the Retail Beer application
by Allen Johnson, dba NEW CLUB DELISA; final action having been held
over from the public hearing on September 22nd. Councilman Box seconded
the motion which passed unanimously.
Councilman Bishop moved for final adoption of Ordinance No. 655, an
Ordinance giving the Time, Place and Rules of Procedure for the new
Council Meetings. Seconded by Qxmcilwvman Nelson, motion passed unan-
imously.
A Public Hearing was held on a Restaurant liquor License application
by Grover M. Johnson, dba GAMBINO'S, South Nbbile Street. No one present
was opposed to the application. Proof of Publication was presented.
Police report was for approval. Councilman Box moved to approve the
application. Seconded by Councilman. White, motion passed unanimously.
A Public Hearing was held on a Wine Retailer's License application
by the 7-Eleven Food Stores, Store No. 19846 on Section Street. No one
present was opposed to the application. Proof of Publication was presented.
Police report was for approval. Councilman Bishop moved for approval.
Seconded by Councilwoman Nelson, motion passed unanimously.
A Public Hearing was held on a Retail Beer License application by
Harold I. Bracy, dba the PINK PANTHER POOL HALL, Section Street and
Twin Beech Road. No one present was opposed to the application. Proof
of Publication was presented. Police report was "not approved" due to the
establishment's location near the Intermediate School..Mr. Bracy pointed
out that a convenience store near him had an Off -premises Beer License
and that his patrons were burying beer there and bringing it on his property
and leaving the empty cans, thus making it appear that he was selling beer
without a license. Mr. Bracy stated he would sell beer at the Pink Panther
Pool Hall after school hours at 6:00 p.m. Councilwoman Nelson moved to approve
the application. Seconded by Councilman McCawley, the vote was: AYE-
-Nelson, McCawley, and Box. NAY - Councilmen Bishop and White. Nbtion to
approve carried.

A Petition for Annexation was received from John V. Duck and Betty Duck
for a Lot of approximately 1.5 acres contiguous to the corporate limits
south of Fairhope on U.S. 98 East. Councilman Box introduced an Ordinance
to annex said property.
Councilman Bishop moved to combine the Office of City Clerk and the
office of City Treasurer. Seconded by Councilman McCawley, motion passed
umanimously.
Mayor Nix nominated the following persons for appointment to the
designated positions:
City Clerk -Treasurer . . . Evelyn P. Phillips
Chief of Police........... Leo Gilheart
Municipal Judge........... James Reid
City Attorney ............. John V. Duck
There being no other nominations, Councilman Box moved to close the
nominations, appointing the slate as nominated. Seconded by Councilman
McCawley, motion passed unanimously.
Councilman Box moved to continue using First National Bank of
Baldwin County in Fairhope and Merchants National Bank in Mobile as
City Depositories; and to continue Councilman McCawley's authorization
to sign checks in the absence of the Mayor or the City Clerk. Seconded
by Councilwoman Nelson, motion passed unanimously.
Councilman Bishop moved to authorize bid requests an additional
transformers for the Electric Department. Seconded by Councilman Box,
motion passed unanimously.
Councilman Box moved to approve acceptance of $7,000 from Mr. Bob
Pope for the Yardarm Restaurant to be removed and rebuilt by Mr. Pope
on the Municipal Pier provided the appraisal done by Mannich Realtors
is in the same amount ($7,000); and to authorize the Mayor and City Clerk
to sign a bill of sale. Seconded by Councilwoman Nelson, motion passed
unanimously.
Councilwoman Nelson moved to approve Mr.Pope's request to install
an 8-foot chainlink fence on the Pier from one end of the Marina to the
other, at no cost to the City, for the protection of the boatowners'
property who are using the Marina. Seconded by Councilman McCawley,
motion carried over one NAY vote by Councilman. Bishop.
Councilman Box moved to take under advisement a proposal by Mr. Joe
Miller to prepare City Street Maps for $4,500.00. Mr. Miller and City
Department Heads are to meet and report to Council at the next meeting
on whether or not the maps would be useful to the City. Seconded by
Councilman Bishop, motion passed unanimously.
Councilman McCawley moved to request a 90-day renewal on the FEMA
Temporary Loan at First National Bank and to authorize the Mayor and Clerk
to sign the renewal forms. The Loan is due October 14th. Seconded by
Councilman Box, motion passed unanimously.
Councilman McCawley introduced Ordinance No. 656, an Ordinance
establishing new Licenses and Fees for the sale of Liquor, Wine and Beer,

In order to take immediate action, Councilman Bishop moved to suspend
the rules. Seconded by Councilman White, the vote was: AYE-McCawley
Bishop, Box, White, and Nelson.NAY-none. Councilman McCawley then
moved for final adoption of Ordinance No. 656. Seconded by Council-
woman Nelson, motion passed unanimously.
Councilman Box moved to pay bills as presented. Seconded by
Councilwoman Nelson, motion passed unanimously.
Mayor Nix presented the 1980-81 City Budget to the Council.
Projected revenues are $6,940,120.00; projected expenses $6,842,729.00.
Councilman McCawley introduced and moved for the adoption of,
the following Salary Resolution. Seconded by Councilwoman Nelson, the
vote was: AYE - McCawley, Nelson, Box, and Bishop. NAY -none.
ABSTAIN - White. Motion carried:
RESOLUTION
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FAIRHOPE that Mayor James
P. Nix is appointed Superintendent of Utilities at an annual salary of $3,600.00;
payable $100.00 each month from the Electric Fund, $100.00 each month from
the Gas Fund, and $100.00 each month from the Water & Sewer Fund; and
BE IT FURTHER RESOLVED that the annual salaries of City Personnel shall
be as follows:

Councilman Box moved to hear the following business not on the
Agenda. Seconded by Councilman White, motion passed unanimously:
Councilman Box moved to allow the Styx River Fire -Department to rent
the City's 1946 Fire Truck for a nominal fee. Seconded by Councilman
Bishop, motion passed unanimously.
Councilman Box moved to hear the following business not on the
Agenda. Seconded by Councilman. McCawley, motion passed unanimously:
Mr. Ack Moore reported on the scaled -down version of the Waterline
Expansion project and stated the information had been forwarded to
FHA for approval. Mayor Nix stated again the main point to remenber
was for the expansion to pay for itself, no increased rates within the
City. Councilman Box moved to go ahead with the project if FHA gives
a favorable reply to the new plan. Seconded by Councilman Bishop, motion
passed unanimously.
Councilman Bishop moved to hear the following business not on the
Agenda. Seconded by Councilman White, motion passed unanimously:
City Attorney John Duck reported all suits against the City relative
the bankruptcy of Flood Project Contractor Delta Plumbing Company were
not settled but if any monies were due Delta at all, this must be deter-
mined and paid to the Internal Revenue Service as soon as possible. Mayor
Nix asked Councilman Box, Supt. Rhil Rutherford, and Engineering Consultant
Ack Moore to meet and make a definite recommendation to Council at the
next meeting without fail so this matter could be closed.

Councilwoman Nelson asked if there was any way to recoup the monies
spent on Cigarette Stamps when the State law voided their use. There
is none.
Councilwoman Nelson asked for some action on the Cam=ity Appear-
ance Board issue even if the Attorney General's opinion is not received
by the next meeting.
