The City Council, City of Fairhope, met in regular session at
7:00 p.m. City Administration Building, 387 Fairhope Avenue, Fairhope,
Alabama., on Monday, 8 September 1980.
Present were Counci]menbers Jack A. Stipes, David Ed Bishop,
Trisha Nelson, Sam E. Box and C.O. McCawley; City Attorney John Duck
and City Clerk Evelyn P. Phillips. Mayor Pro Ten Stipes presided
in the absence of vacationing Mayor James,Nix.
The minutes of 25 August 1980 regular session were duly
approved.
A public hearing was held on the Wine Retailer License application
by A.J. Darring, dba THE VILT-AGE STORE, located on Highway 98 and Parker
Road. No one present was opposed to the application. Proof of publication
was presented. Councilman Box moved to approve the application. Seconded
by Councilman McCawley, motion passed unanumusly.
(Note -Unanimous vote indicates 5 aye votes; including Mayor
Pro -Ten Stipes, presiding.)
A Public Hearing was held on the Wine Retailer License application
by DEL CHAMPS, INC., for Stores No. 21 and No. 34, located on Greeno Road
and Oak Street respectively. No one present was opposed to the application
Proof of Publication was presented. Councilman Box moved to approve the
application. Seconded by Councilman McCawley, motion passed unanimously.
A Public -Hearing was held on the Wine'Retailer License Application
by WINK -DI=, INC., for Store No. 1500, located on Greeno Road. No one
present was opposed to the application. Proof of publication was presented.
Councilman McCawley moved to approve the application. Seconded by
Councilman Box, motion passed unanimously.
A claim by Mr. Keith Poling, for damages he suffered while jogging
on Fairhope Avenue on the 8th day of April, 1980 was read. Councilman
Box moved to table the matter until an investigation by our insurance
carrier could be completed. Seconded by Councilman Bishop, motion
passed unanimously.
Mr. Bob Tolbert, Gulf(Fairhope)Cable TV, Inc., and Mr. Ray Clemnens,
Storer Cable Communications, Inc., made a brief report to Council concerning
the merger of Fairhope Cable into Storer Cable. Councilman Box introduced
the following Resolution. In order to act upon this resolution of a per-
manent nature, Councilman McCawley moved to suspend the rules. Seconded by
Councilwoman Nelson, motion passed by the following vote: AYE - Council -
members McCawley, Nelson, Stipes, Bishop and Box. NAY - none. Councilman
Box then moved for final adoption of the following Resolution. Seconded
by Councilman Bishop, motion passed unanimously:

WHEREAS, Fairhope Cable TV, Inc. franchised to provide cable
television service to the City of Fairhope, Alabama pursuant to
City of Fairhope Ordinance Numn er 616 adopted April 24, 1978; and
WHEREAS, Fairhope Cable TV, Inc. proposed to merge into Storer
Cable Communications, Inc., and to transfer its assets and business
to Storer Cable Communications, Inc; and
WHEREAS, Storer Cable Commmications, Inc., is willing to
assume and be bound by all the provisions and obligations of City
Of Fairhope Ordinance Number 616, adopted April 24, 1978
Nai THEREFORE BE IT RESOLVED,.that the City of Fairhope, Ala-
bama, approves the transfer of the franchise set forth in City of
Fairhope Ordinance Number 616, adopted April 24, 1978 from Fairhope
Cable TV, Inc. to Storer Cable Comrnmica.tions, Inc., conditioned
upon Storer Cable Comrnmications, Inc. filing with the City Clerk
its written acceptance of such assignment and its agreement to
assume and be bound by all the provisions of City of Fairhope
Ordinance Number 616, adopted April 24, 1978.
ADOPTED this the 8th day of September, 1980.

Councilman -Box moved to open bids on a replacement pick-up truck
for the Street Department. Seconded by Councilman. Bishop, motion
passed unanimously.
The bids were: Gaston Motor Co. - $6,488.77 for '81 Ford Pickup
Steber Chevrolet - $6,497.05 for `81 Chevrolet Pickup
Councilman Bishop moved to accept the low bid, provided all spec-
ifications are met..Seconded by Councilwoman Nelson, motion passed unan-
imously.
Mr. Jack Kirk reported that the person responsible for the accident
which totaled Mr. Mason's Street Department Pickup had no insurance
coverage but was willing to make restitution in the amount of $3,025.00
the fair value of the 1977 pickup. Councilman Bishop moved to accept
a Cashier's Check for this amount in settlement. Seconded by Councilman
Box, motion passed unanimously.
.Councilwoman Nelson moved to approve final retention payment due
Crittenden Enterprises, Inc., on the Volanta Park Concession Stand
contract. Seconded by Councilman Box, motion passed unanimously.

Councilman McCawley moved to have the Mayor write a letter of
commendation to Supt. Mike Rejczyk and the Water Department employees
on the recent news that Fairhope'-s Water System was voted No. 1 in
the State of all cities of comparable size, and that the letters be
placed in each employee's personnel file. All the Councilmembers
expressed their pleasure in and appreciation of this recognition.
Motion was seconded by Councilwoman Nelson and passed unanimously.
Councilwoman Nelson moved the following persons be given a
notice of recognition for their work on the now -complete Stimpson
Field Project. Seconded by Councilman McCowley, motion passed
unanimously:

Councilwoman Nelson said she would like to see a periodic notice
in the newspapers or on the Bulletin Board listing the dates of up -
coning vacancies on city boards with a request for interested citizens
to contact council members and/or board members.
Mayor Pro` -Ten Stipes asked about the traffic problem in the new
Baldwin Square Shopping Center where an entry was made between Baldwin
Square and the old Eastern Shore Shopping Center. Councilman Bishop
moved to have Building Official Lunsford and City Supt. Rutherford
investigate and make a report. Seconded by Councilmen. McCawley, motion
passed unanimously.
Mayor Pro-Tem Stipes asked that the Recreation Board look into having
separate steps for the band at football games and also some way to relieve
the congestion at the Cancession Stand.
Councilman Box moved to hear the following three items not on the
Agenda. Seconded by Councilwoman Nelson, motion passed unanimously:
Mrs. Henriette Oliver wants to know why she must run a waterline
from Johnson Street to her house located between Johnson Street and Fairhope
Avenue. Councilman Box will look into this.
The Planning & Zoning Board requested a joint meeting with the
Council on drainage problems as soon as possible.
Mayor Pro -Tern Stipes would like a position created for the hiring
of an Assistant Building Official.
Councilman Box moved to hear the following business not on the
Agenda. Seconded by Councilman Box, motion passed unanimously:

Councilwoman Nelson offered congratulations to the N clubs and
individuals whoworked'so hard to reach their goal of pursing
a Jaws of Life!; in only 8 months.
Supt. Rutherford was asked to check a pothole at the corner of
Simons Street and Edwards Avenue,
Bradford Estates needs an answer as to whether they are zoned
R-3 or R-4 and whether or not they need to request a rezoning amendment.
Mr. Lunsford will look into this.
Councilman Box moved to pay bills as presented. Seconded by
Councilman Bishop, motion passed unanimously.
