HomeMy WebLinkAbout08-25-1980 Regular Meeting203 STATE OF ALABAMA � COUNTY OF BALDM i The City Council, City of Fairhope, met in regular session at 7:00 p.m. City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama 36532, on Monday, 25 August 1980, Present were Mayor James P. Nix; Councilmembers Trisha Nelson, C.O. McCawley, David Ed Bishop, Sam E. Box, and Jack A. Stipes; City Attorney John Duck and City Clerk Evelyn Phillips. Minutes of 11 August 1980 regular session were duly approved. Councilman Stipes moved to authorize the City Clerk to correct the 1977-78 Assessment Roll Book to show Mr. William L. Richmond's assessment on Laurel Street at 230 total feet and Mr. Elden Harrington's assessment on Laurel Street at 90 total feet as per the corrected report from the Engineers; to refund Mr. Richmond's overpayment and to request payment from Mr. Harrington; and to bill Mr. Harrington at no interest up to this time. Seconded by Councilman. McCawley, motion passed umanimouisly. Mr. William MacGregor asked to discuss several civic matters. Mayor Nix advised Mr. MacGregor that any questions pertaining to the Library case could not be discussed at this time due to pending litigation. W. MacGregor asked about having a Civic Audit Committee. He was advised an independent firm audits all City records each year, as required by law; that monthly financial statements are available for public inspection, as well as copies of the yearly audits. A public hearing was held on the Off -Premises Beer License and Wine Retailer's License applications by Ms. Joan George, dba THE WINE MERCHANTS, 185 Baldwin Square. No one present was opposed to the licenses; proof of publication was presented. Councilman Stipes moved for approval of the applications. Seconded by Councilwoman Nelson, motion passed unanimously. Councilman Stipes moved to hear the following business not on the Agenda. Seconded by Councilman Bishop, motion passed unanimously: Councilman Stipes introduced Ordinance No. 654, an Ordinance to amend Ordinance No. 652 to provide for a 10% Penalty on late payamt(after the loth of each month) of Cigarette Tax. In order to act on this business, Councilman Box raved to suspend the rules. Seconded by Councilwoman Nelson the vote was: AYE -Mayor Nix, Councilmembers Box, Nelson, Stipes, McCawley, and Bishop. NAY -none. Councilman Bishop then moved for final adoption of Ordinance No. 654. Seconded by Councilman Stipes, motion passed unanimously. (Aug. 25'80) 204 Mayor Nix asked for nominations to fill an unexpired term and a new term on the Parking Authority. Councilman Bishop nominated Mr. Jack Lacey for the new term to end January, 1983, and Mr. Lloyd Vick to fill Mr. Ray Malone's unexpired term(ends January, 1981). There being no other nominations, Councilman Stipes moved the nominations be closed. Seconded by Councilman McCawley, motion passed unanimously. Mr. Lucey and'Mr, Vick are appointed. Councilman Bishop moved to offer $3,000.00 to Jerry and Jean Williams Allen for a parcel of land located adjacent to the Twin Beech Substation and to request then to provide Title insurance. Seconded by Councilman Box, motion passed unanimously. Mayor Nix announced a favorable decision had been reached in the case of the City vs Jack Thomas and, since this case had been ongoing since 1974, expressed thanks to City Attorney John Duck for a job well done.
