HomeMy WebLinkAbout08-11-1980 Regular Meetingp 201 STATE OF ALA&MA COUM OF BAL94IN � The City Council, City of Fairhope, met in regular session at 7:00 p.m., City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama on lionday, 11 August 1980. Present were Mayor James P. Nix; Councilmembers David Ed Bishop, Jack A. Stipes, Trisha Nelson, Sam E. Box, and C.O. 11cCawley; City Attorney John Duck and City Clerk Evelyn Phillips. fe Plinutes of July 28th and 30th regular session, and August 4th special session were duly approved. Councilman Bishop moved for Final Adoption of Ordinance No. 653, an Ordinance amending License Ordinance No. 544 to include Licenses for Wine Retailers, Wholesalers, Importers, and Manufacturers. Seconded by Councilman McCawley, motion passed unanimously. Councilman Stipes moved to issue Building Permits and Job Licenses for the Thomas Hospital expansion at no fee. Seconded by Councilman Bishop, motion passed unanimously. Mr. William MacGregor came before Council with questions as to the cost of the Claire Oaks suits. Mr. MacGregor was advised he is free to examine all the records. Councilman Stipes introduced, and moved for the adoption of, the following Resolution. Seconded by Councilman Box, motion passed unan- imously: RESOLUTION WHEREAS, the CITY OF FAIRHOPE has had a suit re -filed by CLAIRE OAKS against it, the Mayor, and all of the City Council Members individually; the present Members of the Library Board, the past Members of the Library Board and the Past Members of the City Council, and WHEREAS; it is necessary for the CITY OF FAIRHOPE to defend this suit, and each of its Councilmen, its Past Councilmen, each present Member of the Library Board and Past Members of the Library Board, and its Mayor; NOW•THEREFORE BE IT RESOLVED that the CITY OF FAIRHOPE shall employ attorneys to represent the Mayor; its Councilmen, past and present; its Library Board, past and present; and the CITY OF FAIRHOPE, a municipal corporation; jointly and severally and pay all fines, judgments, legal expenses, court costs or other expenses incurred as a consequence of the Claire Oaks law suit; BE IT FURTHER RESOLVED that if the Mayor or any Councilman, past or present; or any Member of the Library Board, past or present, desires to employ his own counsel, then he or she shall do so at their own personal expense. CAp&, 111.80) 202 ADOPTED THIS THE llth DAY OF August, 1980. Councilman Box moved to authorize the Mayor to execute a contract with S.A. Graham Company, Inc., Brundidge, Alabama, for Unit Price Base Bid of $451, 980. 28 on the Airport ADAP Jffl3 Project, as soon as a Cert- ificate of Insurance is received. Seconded by Councilwoman Nelson, motion passed unanimously. Councilman Stipes moved for approval of Off -Premises Beer License Application by Otis Quaites, dba QUAITES PACKAGE STORE, located on Turin Beech Road. Seconded by Councilwoman Nelson, motion failed by the following vote: AYE - Councilmembers Stipes and Nelson. NAY - Council- members'McCawley, Box, and Bishop. Councilman Stipes moved to pay bills as presented. Seconded by Councilman McCawley, motion passed unanimously. Meeting was duly adjourned. VIA ty f
