COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session
at 7:00 p.m. City Administration Building, 387 Fairhope Avenue
Fairhope, Alabama 36532, 28 July 1980.
Present were Mayor James P. Nix; Councilmembers David Ed Bishop,
Jack A. Stipes, Trisha Nelson, Sam E. Box, and C.O. McCawley; City
Attorney John Duck and City Clerk Evelyn P. Phillips.
Minutes of the 14 July 1980 regular session were duly approved.
Action on the Off -Premises Beer License Application by Otis Quaites,
dba QUAITES PACKAGE STORE on 'Rain Beech Road, was held over from the
Public Hearing held July 14th due to Mr. Quaites failure to produce
Proof of Publication. Mr(Quaites was again present and presented his
Proof of Publication. Co cil was advised the Police Department recommended
a denial of approval. When questioned, Chief Gilheart reported the
recommendation was based on Mr. Quaites police record. Councilman Stipes
moved the application be tabled until next regular session.
Councilman Box moved for Final Adoption of Ordinance No. 651, an
Ordinance amending the Zoning Ordinance per rezoning request by Amos
Wagner. Seconded by Councilman McCawley, motion carried by the following
vote: AYE-Councilmembers Box, McCawley, Nelson, and Bishop. NAY -None.
ABSTAIN -Councilman Stipes.
A Public Hearing was held on the Off -Premises Beer License Application
by Delchamps, Inc,. for their Store No. 21 to be located in Baldwin
Square. No one present was opposed. The Police recommended approval.
A Delchamps representative was present but did not know he was to have
Proof of Publication with him. Final action was held until next regular
session, to allow time for the document to be obtained and presented.
Councilman McCawley moved to delay final adoption of the Ordinance
amending the Zoning "Ordinance relative to a Community Appearance Board,
which was introduced at the July 14th meeting, until a report is received
from the Attorney General's office. Seconded by Councilman Stipes,
motion passed unanimously.
Councilman Bishop introduced an Ordinance to amend License Ordinance
No. 544 to establish annual license fees for Table Wine Retailers,
Wholesalers, Importers, and Manufacturers.
Councilman McCawley introduced Ordinance No. 652, an Ordinance to remove
City Tax Stamps from cigarettes, to retain the tax, to establish the new
method of reporting and paying said tax to the City, to comply with the
new Cigarette Tax Law passed by the State Legislature effective August 1,
1980, In order to complete action at this time, Councilman Box moved to
suspend the rules, seconded by Councilman Bishop. The vote was: AYE-
Councihnembers Box, Bishop, McCawley, Nelson and Stipes. NAY - none..
Councilman Stipes then moved for Final Adoption of Ordinance No. 652, seconded
by Councilman McCawley. The vote was: AYE-Councihroibers Stipes, McCawley
Box, Bishop, and Nelson, NAY -none. Motion passed unanimously.

Mayor Nix suggested the following method of disposing of City Cigarette
Tax Stamps - Each distributor is to turn in all stamps on hand plus an inventory
of all stamped stock, said stock to be retained five days for verification, and
the dollar value of these stamps will be applied against future monthly tax
liability until used up. Councilwamm Nelson moved to approve this method
of disposition. Seconded by Councilman Bishop, motion passed unanimously.
Mayor Nix reported the Unofficial Census Report for the population of
Fairhope showed a total population of 6,959. This is a 21.7% increase over
1970. Councilman. Stipes moved to accept the report. Seconded by Councilman Bishop,
motion passed unanimously.
The Baldwin County Health Office requested financial aid from the
City in remodeling their new office on Delamare Street. Councilman Stipes
moved to donate $1,000.00. Motion died due to a lack of'a second..
Councilwoman Nelson is to look into the possibility of using the former
Riviera Utilities Building on the corner of Section and Johnson for downtown _-
parking.
Councilman Stipes asked if anything had been done in reply to a
letter from Ms. Barbara Gooden about a ditch in front of her home. Supt.
Rutherford explained Ms. Gooden had been advised twice that her problem
could be solved if she was willing to purchase pipe which the City would
install for her and so far she had not been willing to do this. Council-
man Stipes also asked for more careful checking of travel expenses and
telephone -bills.
Councilman Box moved to purchase for $3, 000.00 a 50 X 141' parcel of land
from Annie B. Williams for a lift station. Seconded by Councilman Stipes, motion.
passed unanimously.
Meeting was adjourned until 11:30 a.m., Wednesday, July 30th at which time
the Council will canvass the results of the Municipal Runoff Election to be
held July 29th.
Council reconvened Wednesday, July 30th, with the following members
present: Mayor James P. Nix, Councilmembers C.O. McCawley, Trisha Nelson,
and Sam E. Box. City Attorney John Duck and City Clerk Evelyn
Phillips were also present.
Mayor Nix opened the Runoff Election Statement of Canvass and read
out the results. After tabulation of the votes, Councilman McCawley
introduced, and moved for the adoption of, the following Resolution.
Seconded by Councilwoman Nelson, motion passed unanimously:
RESOLUTION
WHEREAS, the runoff election for the City of Fairhope, Alabama, was
duly and legally held on 29 July 1980, as provided by law, and
WHEREAS, the municipal governing body of the City of Fairhope, Alabama,
met on this 30th day of July, 1980, a quonn thereof being present, at 11:30
o'clock A.M., and has canvassed the returns, and has ascertained and determined
the number of votes received by each candidate, and

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairhope,
Alabama, as follows:
1. That Roy C. White received a majority of the votes cast for the
office of Councilmebber, Place No. 3, and is hereby declared duly elected
to that office for the term beginning 6 Oct(Yber, 1980
2. That Sam E. Box received a majority of the votes cast for the
office of Counci er, Place No. 5, and is hereby declared duly elected to
that office for the term beginning 6 October 1980.
ADOPTED THIS 30th DAY OF JULY, 1980.
