COUNTY OF BALDWIN X
The City Council, City of Fairhope, met in regular session
at 7:00 p.m. at the City Administration Building, 387 Fairhope
Avenue, Fairhope, Alabama 36532, on Monday, 9 June 1980.
Present were Mayor James P. Nix; Councilmembers C.O.
McCawley, Sam E. Box, aor., Trisha Nelson, Jack A. Stipes,
and David Ed Bishop; City Attorney John Duck and City Clerk
Evelyn Phillips.
Minutes of the 26 May 1980 meeting were duly approved
after some discussion as to whether a motion setting a "No
Parking between Signs" zone was to have included a vacant
lot on Mershon Street.
Councilman Stipes said he would like to hold his report
on the widening of Ingleside Street until the next meeting
as he was still discussing the situation with Dr. Diegmann.
A Public Hearing was held at last regular session on
the Off -Premises Beer License application by Mariette Conkin,
dba Greeno Road Self Service Station. No action was taken
at that time due to the fact that the Police Department gave
a "not approved" recommendation. Chief Gilheart reported
to Council that the Police recommendation is based on the
fact that Ms. Conklin's City of Daphne license had been sus-
pended for the -selling of beer to minors; however, this matter
has now been cleared up. Councilman Stipes moved to approve
the application. Seconded by Councilman Box, motion passed
unanimously.
City Engineering Consultant Ack Moore's report on the status
of the Waterline Extension South(FHA) Project was not -ready but
he will report at the next regular session.
Councilman McCawley will report on the Health Office matter
at the next regular session.
Councilman Box reported that new bids had been requested
on the sewer pump, to be opened at this meeting Two bids were
received:
Templeton Engineering Sales, Atlanta $29,000.00
20-22 weeks delivery
Jim House & Associates, Birmingham $27,537.00
6-8 weeks delivery, $250 for supervision
Councilman Box moved to accept the low bid provided all speci-
fications are met. Seconded by Councilman McCawley, motion
passed unanimously.

Mayor Nix reported that Dr. St. Amant, County Health
Officer, stated the County could not help purchase equipment for
a mosquito -control spraying program in Fairhope but they would
be able to provide the City with the insecticide if the City
can purchase the necessary equipment. Councilman Box moved
to advertise for bids. Seconded by Councilman Stipes, motion
passed unanimously.
Councilman Box introduced, and moved for the adoption of
the following Resolution. Seconded by Councilman Bishop,
motion passed unanimously:
RESOLUTION
WHEREAS, Section 11-46-25 as amended states the receipt
of Statements of Candidacy shall be closed
at 5:00 p.m. on the first Tuesday in June preceeding
the Election Day of 8 July 1980, and
WHEREAS, Section 11-46-43 as amended, states no elector shall
write in the name of any person on the ballot, and
WHEREAS, the Mayor of the City of Fairhope has filed a written
statement with the City Council, attested by the
City Clerk, certifying the fact that only one person
filed a Statement of Candidacy for the office of
Council, Place No. 4, and the name of that person
is C.O. (Mac) McCawley, Sr.,
NOW THEREFORE BE IT RESOLVED by the Council of the City of
Fairhope taht C.O. (Mac) McCawley, Sr., be and he is
hereby declared duly elected to the office of Council-
murber, Place No. 4, City of Fairhope, for the term
of office commencing on the first Monday in October,
1980; and
BE IT FURTHER RESOLVED that the Mayor of the City of Fairhope
be and he hereby is directed to issue a Certificate of
Election to C.O.(Mac) McCawley, Sr. for the office
of Cou ncilmember, Place No. 4.

A Public Hearing was held an an Off -Premises Beer License Application
by Jimmy Harrington, Jr., dba HARCO DRUG, INC., for two locations;
Del -Fair Shopping Center and Baldwin Square Shopping Center. No one
was present opposed to the application. Proof of publication was
presented. Councilman Stipes moved the application be approved.
Seconded by Councilman McCawley, motion passed unanimously.
Mayor Nix reported the break -down of the air-conditioning unit at
City Hall and asked permission to open bids on a replacement unit;
bids having been requested prior to meeting date in order to expedite
correcting the air-conditioning. Councilman McCawley moved to open the
bids. Seconded by Councilman Box, motion passed unanimously:

Councilman Bishop moved to accept the low bid provided specifications
are met. Seconded by Councilman Box, motion passed unanimously.

Councilman Box moved to accept low bid provided all FEMA specifications
are met. Seconded by Councilman Bishop, motion passed unanimously.
Councilwoman Nelson stated a number of complaints had been received
about the aver -crowding at the Municipal Beach. Due to rising costs of
clean-up and police personnel, Councilwoman Nelson moved that the charges
be raised to $5.00 per car, $2.00 per walk-in, and the number of cars
be limited to 250. Councilman Bishop said he would second the motion
but only if the limitation as to a specific number of cars was not in-
cluded. After some discussion, Councilwoman Nelson withdrew her motion
and rude the following motion: Charges are to be $10.00 per car, $3.00
per ara.lk-in, and the number of cars allowed in before closing the beach
would be left to the discretion of the Policemen on duty, and this is to
be effective as soon as signs can be posted. Seconded by Councilman PZc-
Cawley, motion passed unanimously.
Councilwoman Nelson moved to request a "No Left Turn" sign be
place with State Highway Department approval at the intersection of
Mobile Street and Fairhope Avenue, for the direction of traffic going
north on Mobile Street. Seconded by Councilman Bishop, motion passed
unanimously.
Councilwoman Nelson moved to limit parking in the Municipal Pier
Oval area to two(2) hours. This motion died due to lack of a second.

Councilwoman Nelson moved to establish Tow -Away Zones on North
Bayview and in the North Beach property area,.on Magnolia from Summit
to Fairhope; North Mobile Street; South Mobile Street from Fairhope to
Laurel; Fairhope Ave. from Summit to Mobile; and the north side of
Cliff Drive from Short to Mobile St. Seconded by Councilman Box,
motion passed unanimously.
Councilwoman Nelson moved to reserve the north side of the Pier
Oval for Pier parking. This motion died due to lack of a second.
Councilman Box moved to advertise for a Public Hearing on the
rezoning request by Amps Wagner; to be held July 14th. Seconded by
Councilman McCawley, motion passed unanimously.
Councilwoman Nelson moved to approve Ms. Betty Jo Wolfe's request
to place a New Orleans -style canopy -aver the sidewalk at her place
of business, the Page & Pallette. Seconded by Councilman McCawley,
motion passed unanimously.
City Attorney John Duck asked that a meeting be held to determine
final action on the Delta Plumbing Company matter. Mayor Nix asked
Councilman Stipes if the Harbor Board could meet and have a recommendation
ready by next regular Council session. Councilman Stipes agreed to
have this done.
Mayor Nix reported an error had been discovered in the 1977-78
Public Improvements Assessments. Mr. Buddy Richmond has been assessed
for 20 feet too much and Mr. Elden Harrington for 20 feet too few.
Councilman Stipes is to work this out with the property owners so
Council can correct the record.
Councilman Box moved to approve an additional position in the
Mechanics Department, at an hourly rate of $4.50. Seconded by Council-
man McCawley, motion passed unanimously.
Councilman Stipes moved to give a copy of the -City Voters List
to any candidates who request a copy; all others will be charged the
regular copy charges. Seconded by Councilman Bishop, motion carried
over one Nay vote by Councilwoman Nelson.
Councilman Bishop moved to use eight(8) Voting Machines for the
July 8th Municipal Election. Seconded by Councilman McCawley, motion
passed unanimously.
Councilman Stipes moved to approve payment of retention on Evans
Construction Company's FEMA contract and to commend then for an excellent
job on the 5 wooden piers and boatramp at the Municipal Beach area. Second-
ed by Councilman Bishop, motion passed unanimously.
Councilman Box moved to hear the following items not on the Agenda.
Seconded by Councilman Bishop, motion passed unanimously:
Councilman Box moved to advertise for bids on construction of sewer
line from Pecan Street lift station to corner of Chinch and Fels.
Seconded by Councilwoman Nelson, motion passed unanimously.

Mr. Milhacn reported on July 4th Optimist Club plans. 'Councilman
McCawley moved to give permission to hang banners over the street where
"Seasons Greetings" banners are usually placed during Christmas; and
for City crew to do the work. Seconded by Councilman Box, motion
passed unanimously.
Councilman McCawley moved to pay bills as presented. Seconded
by Councilman Bishop, motion passed unanimously.
Meeting was duly adjourned.
