COUNTY OF BALDWIN X
The City Council, City of Fairhope, met in regular session
at 7:00 p.m.., City Administration Building, 387 Fairhope Avenue,
Fairhope, Alabama 36532, on Monday, 26 May 1980.
Present were Mayor James P. Nix; Councilmembers C.O.
McCawley, Sam E. Box, fr., Trisha Nelson, Jack A. Stipes, and
David Ed Bishop; City Attorney John Duck and City Clerk Evelyn
Phillips.
Minutes of 12 May 1980 regular session were duly approved.
Councilman Stipes stated he would like to delay his report on
the widening of Ingleside until next regular session.
Councilman Box moved for final adoption of ORDINANCE NO. 647,
an Ordinance amending the Zoning Ordinance to change Russell Ki gore's
property between Volanta & Miller, fronting on Section from R2
Medium Density Single Family Residential to B4 Business and Profess-
ional. Seconded by Councilman McCawley, motion passed unanimously.
Councilman Box moved for final adoption of ORDINANCE NO. 648,
an Ordinance adopting the Standard Building, Mechanical, Gas, E imin-
ination or Repair of Unsafe Building, Swimming Pool, Fire Prevention,
and National Fire Codes. Seconded by Councilman Bishop, motion passed
unanimously.
A public hearing was held on the Off -Premises Beer License
Application by Mariette Conklin, dba GREENO SELF-SERVICE STATION,
located on Greeno Road. Proof of Publication was presented. No
one present was opposed, however, the Fairhope Police Department rec-
omended the application not be approved. After some discussion,
Councilman Box moved to hold action on the application until next
regular meeting. Seconded by Councilman McCawley, motion passed
unanimously.
Councilman McCawley nominated Mrs. Mae Moss Parker for reappoint-
ment to the Organic School Board, 3-year term. There being no other
nominations, Councilwoman Nelson moved the nominations be closed.
Seconded by Councilman Stipes, motion passed unanimously. Mrs.
Parker is reappointed.
Councilman Box reported only 600-700 persons applied for the water
service on the Waterline Extension South, FHA Project. Since 1000
applications were required, City Engineering consultants Moore Engin-
eering Company is to investigate the possibilities of scaling down the
project and make a report to Council at the next regular session.
Councilman Bishop introduced an Ordinance adopting the 1978
National Electric Code.

The following response was received from property owners
interested in a Public Improvements Project: Paving- Horne Lane,
Blue Island, Mershon, Pomelo, Wisteria;'Curb & Gutter - Volanta
Kirkman Lane, North Ingleside, Pecan; Sewer -Colonial Acres,
Volanta View Subdivision, Unit II. Councilman Stipes moved to
authorize Moore Engineering to prepare an estimate. Seconded by
Councilwoman Nelson, motion passed unanimosuly.
Mayor Nix reported Baldwin County Health Officer Dr. St. Amant
had advised that the present.Health Office facilities were not
adequate and the Office would have to be closed July 1st if larger
premises could not be made available. It was noted this Office
serves people from the whole Eastern Shore, not just in Fairhope.
Mayor Nix asked Councilman McCawley to look into this matter and
bring recommendations back to the next regular session. Councilman
Stipes asked the Mayor to also contact the County Commissioners about
the possibility of County assistance.
Councilman Bishop moved to amend the resurfacing contract with
H.O. Weaver & Sons to allow the City to purchase the materials
direct thereby saving some $4,000.00 in sales taxes. Seconded
by Councilman Stipes, motion passed unanimously.
Councilman Box moved to use this savings or surplus to pave
two small parking areas at Stimpson Field on Morphy Avenue.
Seconded.by Councilman McCawley, motion carried with the follow-
ing vote: AYE-Councilmembers Bos, Nelson, and McCawley. NAY-
Councilmembers Bishop and Stipes.
Mayor Nix advised that County may not be able to spray for
insects and asked if the City would like to take this service
on. Councilman Box moved that this be looked into. Seconded
by Councilman Stipes, motion passed unanimously.
Councilwoman Nelson moved that Wednesday, 28 May 1980,
be proclaimed Jeremiah Denton Day in Fairhope. Seconded'by
Councilman McCawley, motion passed unanimously.
Councilman Box moved that"No Parking Between Signs" signs
be installed on Mershon Street as requested. Seconded by Council-
man'Bishop, motion carried with the following vote: AYE -Council -
members Box, Bishop, Stipes and McCawley, NAY -Councilwoman Nelson.
Councilman Box moved to hear the following item not on the
Agenda. Seconded by Councilman Stipes, motion passed unanimously:
Moore Engineering advertised for bids on a Pump for the Grand
Hotel Sewer Project to be>opened at this Council Session. Only
one bid was received --from Jim House & Associates in the amount
of $27,537.00. Councilman Stipes moved to turn this bid over
to Councilman Box for study and for a recommendation on action at the
next regular session. Seconded by Councilwoman Nelson, motion passed
unanimously.

Councilman McCawley moved to hear the following item not on
the Agenda. Seconded by Councilwoman Nelson, motion passed unani-
mously:
Airport Chairman Russ Kilgore stated several Appraisal Forms
needed to be executed by the Mayor as part of the FAA project now
underway at the Airport. Councilman McCawley moved to authorize the
Mayor to execute the forms. Seconded by Councilwoman Nelson,
motion passed unanimously.
Councilman Box moved to hear the following three items not
on the Agenda. Seconded by Councilman McCawley, motion passed
unanimously:
Councilman Stipes asked a letter be written to Rep. Robinson(Va)
and Rep. Ullman(Ore.) in support of a bill, HR681, to permit
Federal Tax deductions for taxes paid in connection with Utility
Bills.
Councilman Stipes asked that a pipe be repaired at South Summit
and Kirkman Lane.
Councilman Stipes asked City Supt. Rutherford if the truck
that was repaired to haul the garbage to the landfill was still
operating. Rutherford reported it was.
Councilman Box moved to hear the following item not on the
Agenda. Seconded by Councilman McCawley, motion passed unanimously:
Councilwoman Nelson asked if the rusted -out pipe at the Bay
could be replaced. This could be done as part of the proposed
drainage project.
Meeting was duly adjourned.
