HomeMy WebLinkAbout04-28-1980 Regular Meeting171 STATE OF ALABAMA X COUNTY OF BALDWIN x The City Council, City of Fairhope, met in regular session at 7:00 p.m., City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama 36532, on Monday, 28 April 1980. Present were Mayor James P. Nix; Councilmembers David Ed Bishop, Jack A. Stipes, Trisha Nelson, Sam E. Box, Sr., and C.O. McCawley, City Attorney John Duck and City Clerk Evelyn Phillips. Minutes of 14 April regular session and 17 April special session were duly approved. City Engineering Consultant Ack Moore reported on the bid opening held April 25th on storm repairs to the Mmicipal Pier (a rebid as recommended by FEMA) : Ernest Construction, Mobile $229,777.80 Fairhope Paving Co., Fairhope 230,728.90 Valta Construction, Fairhope 235,204.36 Mr. Moore recommended acceptance of the bid by Ernest Construction Co. Councilman Bishop moved to accept Ernest Construction Company's bid provided all specifications are met, we have MIA approval, and a clause is inserted in the contract requiring, the Contractor to be liable for Attorney Fees in case of Court action. Seconded by Councilman Stipes, motion passed unanimously. A Public Hearing was held on the Off Premises Beer License Application by Johnny Lee Chaney, dba J.O. & B, 572 Young Street. No one was present for or against the application. Proof of Publication was not presented. The Police Department recommended the application not be approved.. Councilman McCawley moved to deny the application. Seconded by Councilman Box, motion passed unanimously. Councilman Box moved to advertise for bids on 1,000 feet of 15" pipe to be used at Ingleside & Fairhope Avenues. Seconded by Councilman Bishop, motion passed unanimously. Mrs. Susan Dreading of 462 Satsuma. asked for action on the drainage problem in her area. Mr. Rutherford and Councilman Stipes reported that a rough estimate of some $13,000.00 to $33,000.00 would be needed to correct the drainage, and this did not include cost of labor. A general discussion of drainage problems followed, including a presentation of slides showing damage. Mayor Nix stated it would be better to try to solve all the problems instead of area by area. Councilman Stipes moved to hire an engineer to present a plan for Council to study and act upon. Seconded by Councilwoman Nelson, motion passed unanimously. (Apr. 28,80) 172 Councilman Bishop moved to deny Baldwin. County Electric Membership Corporation's request for a franchise. Seconded by Councilman McCawley, mention passed unanimously. Councilman Box moved to authorize the Mayor to offer a counter proposal to the Board of Education offering sewer service in exchange for the deed to six acres in the area of Fairhope Intermediate School. Seconded by Councilman Bishop, motion passed unanimously. J.B. Converse & Company is,doing a Wastewater Management Facilities Plan for central Baldwin County and asked if the City of Fairhope would accept untreated wastewater from Daphne and Montrose for treatment. Councilman Box moved to.advise then the City would not be interested in this proposition. Seconded by Councilman Bishop, motion passed unanimously. Councilman Stipes moved to have an estimate prepared on what it would cost to lease a vehicle to pull the garbage to the land fill as compared to purchasing a vehicle for this purpose. Seconded by Councilman McCawley motion passed unanimously. . Mayor Nix reported a letter from Mr. John Rudolph asking for a utility bill adjustment had been received and asked Councilman Box to make a rec- ommendation on action to Council at the next meeting. Councilman Box re- ported he had looked into the request from Mr. James Lee of 52 No. Ingleside and would recommend a denial of Mr. Lee's request. Councilman Box so moved, seconded by Councilwoman Nelson. Motion passed unanimmusly. Councilman Box asked that the following letter be included in the minutes: Mr. Sane Box, Sr. 51 N. Summit Street Fairhope, Alabama Dear Mr. Box: Concerning the ac ount of Mr. James lee, who resides at 52 N. Ingleside. Mrs. Lee contacted us on this matter in December after receiving her util- ity bill. She requested we check the gas reading(enclosed is a copy). We at that time read the meter again to find that it had increased 2300 cubic feet of gas. We informed Mrs. lee that the reading was correct; however, she insisted that it was incorrect. At this point we contacted Mr. Gene Fuqua to check the gas meter to see if there was any possibility of a defective meter. He informed us at that time that the meter was in good working order and the meter was only a year old as it had been changed 10/5/78. We agan informed Mrs. Lee of our findings. She once again questioned them and told us she did not believe it, and that it was impossible. At this point, I informed Mrs Lee there was not any- thing I personally could do for her, and the only people who could remove the charges was the council. Upon your request, the gas crew, under Scott Clemens rechecked the meter to find it in good working order. Furthermore, it is the opinion of both the meter department and gas department that this gas did in fact go through the meter. Sincerely, James Gillespie, Meter Department (Apl. 28,80) 173 Mayor Nix reported there is a possibility of our being able to get approval for 49 more units of the Section 8 Housing Assistance Plan. Coun- cilman. McCawley moved to authorize the Mayor to apply for this. Seconded by Councilwoman Nelson, motion passed unanimously. A bid opening was held April 21st on repairs to the Concession Stand at Volanta Street Ball Park(storm damage) with the following results: Crittenden Enterprises $33,000.00 Eastern Shore Builders 37,827.00 Harvison Construction 46,475.00 Councilwoman Nelson moved to accept the low bid provided FEMA approves and all specifications are met. Seconded by Councilman. McCawley, motion passed unanimously. Councilman Box moved to hear the following business not on the Agenda. Seconded by Councilman Bishop, motion passed unanimously: Mayor Nix reported he had been contacted by several people interest- ed in having their streets paved. Councilman Bishop moved to advertise for and hold a public hearing to determine the public interest in an improvements program. Seconded by Councilman Stipes, motion passed unan- imously. Councilman Stipes moved to hear the following business not on the Agenda. Seconded by Councilwoman Nelson, motion passed unanimously: Ms. Sandra Allen stated she was a member of the Civic Center Committee and asked why the newspaper reported information as being part of the Civic Center Committee's report when she had never heard of or seen this particular information. Ms Allen was shown a copy of the report as it was presented to Council. The copy had the information in it which Ms. Allen was question- ing. Mayor Nix advised that he nor Council could answer her question, suggest- ed she contact her Committee Secretary. Councilwoman Nelson moved to approve the Recreation Department's Accounts Payable, and Moore Engineering Company's fees for $9,191.11 on the M micipal Pier project, as presented. Seconded by Councilman McCawley, motion passed unanimously. Councilman Stipes moved that a letter in support of Bills JAM681 and HR813 be sent to Senators Stewart and Heflin and Congressman Jack Edwards. This would allow a part of the City Utility billing to be used as a tax credit by citizens on their Federal Income Tax Return. Seconded by Council- woman Nelson, motion passed unanimously.
