The City Council, City of Fairhope, met in regular session at
7:00 p.m., City Administration Building, 387 Fairhope Avenue, Fairhope,
Alabama 36532, on Monday, 24 March 1980.
Present were Mayor James P. Nix; Councilmembers David Ed Bishop,
Jack A. Stipes, Trisha. Nelson, Sam E. Box, Sr., and C.O. McCawley;
Attorney Ron Kopesky and City Clerk Evelyn Phillips.
Minutes of 10 March 1980 regular session were duly approved.
Councilman Stipes moved to approve the issuance of an Off -Premises
Beer License to Walter & Amelia Franklin dba THE CORNER STORE. Seconded
by Councilman Box, motion passed unanimously.
Councilman. Box moved to approve the issuance of a Retail Beer License
to Albert Rodgers dba ROD(MRS PACIaGE STORE. Seconded by Councilman Stipes,
motion passed unanimously.
Councilman Mccawley moved to contribute $2,728.00 to the Baldwin
County Mental Health Center which is half of the amount requested and,
after study of the City's financial status, to contribute, if feasible,
the other half on or before September 30, 1980. Seconded by Councilman
Box, motion passed unanimously.
Attorney Kopesky advised Council a definite action is needed on
the Delta Plumbing Company matter. Mayor Nix asked that the Harbor Board,
City Superintendent Rutherford & City Engineer Ack ''bore meet with Attorney
Kopesky as soon as possible and make a recommendation to the Council as to
what course of action should be taken.
Councilman Bishop moved to advertise for bids on resurfacing several
streets. Seconded by CouncilUxxnan Nelson, motion passed unanimously.
Councilman Stipes moved to advertise for bids on repairing Ronforth
and Spring Drive (Earle Construction Company court settlement) and to
require a 2-year performance and materials bond on the job. Seconded by
Councilman McCawley, motion passed unanimously.
City Engineer Ack Moore reported to Council on the bids received on
repairs to the Municiapl Pier. Mr. Moore recommended the low bid of
$234,043.35 by Eastern Shore Builders and Fairhope Paving Company (a
joint venture) be accepted. Councilman Stipes moved to authorize the Mayor
to execute the contract upon receipt of FEMA approval, provided the bid
complied with all Federal and State Laws and Guidelines. Seconded by
Councilman Bishop, motion passed unanimously.
Chief Herbert Fuqua., Volunteer Fire Department, requested 82,000 to
send 5 men to Fire College. Councilman Box so m ved, seconded by Councilman
McCawley. T,btion passed unanimously.
Councilman Stipes moved to have all contracts let on work for the City

include a clause to the effect that any court actions resulting from
contracted project, such as damages or non -completion, would cause the
Contractor to be liable for payment of Attorney Fees. Seconded by
Councilman Bishop, motion passed unanimously.
The following bids were opened on repairs to five Wooden Piers and
the Pier Street Boat Ramp(Storm Damage):
Evans Construction, Mobile $ 26,629.00
P.E. Pate Construction, $ 31,900.00
Eastern Shore Builders $ 46,682.00
S.W.H. Nelson, Foley $ 66,988.00
Councilman Bishop moved to accept the low bid, with FEMA approval, and
provided all specifications are met. Seconded by Councilman McCawley,
motion passed unanimously.
Mayor Nix nominated Mr. Kevin Boone to fill a vacancy on the Board
of Adjustments & Appeals. There being no other nominations, Councilman
Box moved to close the nominations. Seconded by Councilman Bishop, motion
passed unanimously. Mr. Boone is appointed to the Board.
Councilman Box moved to hear the following business not on the Agenda.
Seconded by Councilwoman Nelson, motion passed unanimously:
Attorney Kopesky said that, due to City Attorney John Duck's illness,
he needed some assistance with City cases and would like to recommend
Attorney Tom Norton, Councilman Stipes moved to approve Attorney Norton.
Seconded by Councilman McCawley, motion passed unanimously.
Under old business, Councilman Box moved to approve payment to
Mr. Arthur Mannich in the amount of $45.00 for the Municipal Pier Buildings
Appraisal. Seconded by Councilman Bishop, motion passed unanimously. _
City Engineer Moore also asked that Council give approval on his
engineering fees which was not discussed earlier when he reported on the
Municipal Pier bids. Councilman Bishop moved to approve payment of this
bill upon receipt of FEMA's approval of the low bid on the Pier repairs.
Seconded by Councilman Box, notion passed unanimously.
Councilman McCawley moved to hear the following business not on the
Agenda. Seconded by Councilman Box, motion passed unanimously:
Councilman Bishop asked if the City was still selling paper and placing
the proceeds in the Fountain Fund. Supt. Rutherford said no paper had been
sold for some time because it was costing too much to haul the papers to
Mobile. The Fund is in a savings account with a present balance of $2,356.00
Councilman Bishop also asked that Mr. Comalander be asked to finish the
roofing work at Fisherman's Wharf.
City Engineer Moore asked to bring up old business regarding the Grand
Hotel Project. He is still waiting on some paperwork from the Grand Hotel.
Point Clear Marina and the Fairhope Special Care Facilities people.
Councilman. Box moved to advise these people their paperwork must be completed
by April 1, 1980. Seconded by Councilman McCawley, motion passed unanimously.
