Ltd.'s Cold Spring Harbor project - Cit Administrative Building, 5:00 pm, 6 March 1980 For the purpose of a Public Hearing on a proposed amendment to the Zoning Ordinance - Civic Center, Corner of Church & Morphy Streets, 7:00 pm, 6 March 1980. Councilmember --� ( .61,80) 147 The City Council, City of Fairhope, met in special session at 5:00 p.m. City Administration Building 387 Fairhope Avenue Fairhope Alabama on Thursday, 6 March 1980. The purpose of this session was to discuss the Cold Spring Harbor project. Present were Mayor James P. Nix; Councilmembers Sam E. Box, Sr., Trisha Nelson, C.O. McCawley, and Jack A. Stipes; City Clerk Evelyn Phillips and Attorney Ron Kopesky. Councilman David Ed.Bishop could not attend. Mayor Nix opened the session by reading from the minutes of the January 22, 1979 Planning & Zoning Board meeting wherein a motion was duly passed to the effect that no City Building Permits would be required on the Cold Spring Harbor Project so long as they were constructing a bulIkhead and boat slips - said construction being under the jurisdiction of the U.S. Corps of Engineers. Mayor Nix then asked the Council to join him in a trip to the Project site for an on -site inspection. The Mayor stated he would like the question oflVh ether or not a City Building Permit is required of the Cold Spring Harbor project settled once and for all --and in order to settle that question, he felt a trip to see what is actually being done would be the best way to reach a decision. Councilman Stipes stated he felt this session of the Council was wrong and was usurping the authority of the Plarming & Zoning Board. Mayor Nix stated he, as Mayor, and the Council had been charged with not doing their job and this is the point to be settled. The Council then made a short trip to the Project site behind Fair Harbor Marina on North Section Street. Upon Council's return to City Hall, Mayor Nix asked several times for anyone to speak up if they felt what they had just seen was any more than as represented by the project's spokesman, Mr. Carson Rockett. The Mayor then presented letters from Mr. Don Pruitt, South Alabama Regional Planning Commission, and Mr. Ron Kopesky, Duck & Kopesky, City Attorneys both stating that there appeared to be no construction beyond that covered by the Corps' permits (bulkhead & boatslips). Therefore no City Permits were as yet required. Councilman Stipes asked Mr. Rockett to explain why the Project came before the Board of Adjustments requesting a set -back variance if there was no excavation being done with the construction of buildings in mind. Mr. Rockett explained the Project had sought this variance at this time in order to make adjustments in their plans before paying the architect to draw said plans. Mr. Rockett again stated that no excavation would be done toward the construction of buildings until proper plans were presented to the Planning & Zoning Board and permits obtained. Olar.6'80) 1.48 Councilman Box stated he felt there were several unique problems to be worked out due to the location and scope of the Cold Spring Harbor Project. Councilman Box suggested the City should cooperate with Mr. Rockett as much as possible and, more or less, to take the man's word that he would do as ke kept saying he would .... to seek City Permits at the proper time. Mayor Nix again asked if anyone felt anything was being done that should be stopped by the City. Again no one responded. Meeting was duly adjourned. Mayor City Cr
