The City Council, City of Fairhope, met in regular session at 6
7:00 p.m. City Administration Building, 387 Fairhope Avenue,
Fairhope, Alabama 36532, on 'Monday, 24 September 1979. ''® �"�-'"'►
Present were Mayor James P. Nix, Councilmembers Trisha Nelson,
C.O. IICCawley, Ed Bishop, and Sam E. Box, Sr; City Attorney John
Duck and City Clerk Evelyn P. Phillips. Councilmember Jack A.
Stipes was absent due to a death in his family.
Minutes of the 10 September regular session and the 17
September special session were duly approved after a correction was
made to show Councilmenber Stipes had voted for Nominee Reynolds and
Councilmember Box had voted for Nominee Jackson on the Recreation
Board Appointee motion which failed due to a tie vote.
Mayor Nix opened the session with a brief word of thanks
to the City Employees and the out-of-town work crews who were all
doing such a fantastic job in the wake of Hurricane Frederic.
Mayor Nix mentioned Dothan, Opelika, Troy, Alexande' City, Evergreen, 1
Scottsboro, Elba, Tuskegee, Enterprise, the Red Cro§s, the•Salvation�
Army, a group of Mennonites, and the U.S. Corps of Engineers -
all of whom are helping to restore Fairhope and the Mayor was also
proud to announce that all electrical service was,' ih operation
in Fairhope.
By request of Council, an appointment to the Recreation Board
will be held over to the next regular session.

Councilman McCawley nominated Mr. Isadore Reynolds to serve
on the 208 Water Quality Management Advisory Cotmiittee. Councilman
Bishop moved the nominations be closed. Seconded by Councilman -Box,
motion passed unanimously. There being no other nominations, Mr:
Reynolds is appointed. r_ n
Councilman Bishop introduced, and roved for the adoption of,
the following Resolution. Seconded by Councilman McCawley, motion
passed unanimously: -

BE IT RESOLVED by the Mayor and Council of the, City of
Fairhope that Evelyn P. Phillips, City'Clerk-Treasurer, is
hereby authorized to execute for an in behalf of the City
of Fairhope, a public entity established under the laws
of the State of Alabama, all matters pertaining to such
disaster assistance applied for under the Disaster"Relief
Act (Public Law 288, 93rd Congress); and is the Designated
Local Agent for the City of Fairhope as required;by the
Federal Emergency Management Agency (FEMA), Department
of Housing and Development (HUD), for all matters pertaining
to such disaster assistance.

Councilman Bishop moved to place the Art Center on School Rates
for electrical service. Seconded by Councilman Box, motion passed
unanimously.
Councilman Box moved to approve all overtime for City Personne
Seconded by Councilwoman Nelson, motion passed unanimously.
Councilman Bishop moved to advertise for a Public Hearing on
the rezoning request of Ms. Olympia C. Dyas. Seconded by Councilman
McCawley, motion passed unanimously.
Councilwoman Nelson asked that Council delay review of the Recre-
ation Board's Bills Payable until next session as the Board had not
yet had a meeting and therefore had not approved any bills at this time.
Councilman Bishop moved to hear a temporary housing request not on
the Agenda.. Seconded by Councilman McCawley, motion passed unanimously.-,
11ayor Nix explained three families needed a place to park house trailers
on a temporary basis, not more than three months, and the Young Street
Recreation Center had been suggested as a location. After some dis
cussion, Councilwoman Nelson moved to approve this request provided'
it worked out to be feasible, and the three-month period would begin "'
from time of hook-up. Seconded by Councilman Bishop, motion passeds'
unanimously.
At the request of the City Clerk,•Councilman Bishop moved to play
a , small number of invoices not received in time f& presentation at`'*the
first September regular session. Seconded by Councilman McCawley, motion
passed unanimously. -•. „
Councilman Box moved to hear a request,frbm the Airport Board'not
on the Agenda. Seconded by Councilwoman Nelson, motion passed,.unani-
mously. Airport Board Chairman Russell Kilgore reported on Hurricane
damages at the Airport, mainly the runway lights and electrical systems,
and requested permission to act as an Independent Agent in dealing with F M
rather than placing the Airport needs in with the City's MIA application
for disaster relief. Councilman McCawley moved to approve the Airport's -
separate application. Seconded by Councilman Box, motion passed ufan.imously.
Councilman Box moved to transact buusiness,relative to the proposed
Waterline Extension not on the Agenda. Seconded by Councilwoman Nelson
motion passed unanimously. ,,
Councilman Box moved to authorize the Mayor to execute agreements
with the Engineers and the City Attorney"bil the,Waterline Extension.''
Seconded by Councilman Ile -Cawley, motion passed unanimously. 0 .-
Councilman Box introduced Ordinance No. 641,_ an,,Ordinance to set
West Baldwin and Out of Town Water Rates to be effective when construction
oT-t—he new waterline is begun. Councilman Box then moved 'to suspend the ,
rules so as to take immediate action on the adoption of this Ordinance.
Seconded by Councilman Bishop, the vote was: AYE - Councilmembers Box,
Bishop, Nelson and McCawley. NAY - none. Motion pS-4sed unanimously.
Councilman Box moved for final adoption of Ordinance '1No.•'641. • Seconded
by Councilwoman Nelson, motion passed unanimously.
