Cotncilmember e ti� P Counci member r 'n mr Councilmember , � � L 9 9: �: �'.' ity Clerk The City Council, City of Fairhope, met in special session at 11:00 a.m., City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama. 36532, on Honda , 17 September 1979, for the purpose of actions necessary to the emergency situation cause by Hurricane Frederic. Present were Mayor James P. Nix; Councilmembers Trisha Nelson C.O. IkCawley, and Jack A. Stipes; and City Clerk Evelyn P. Phillips. Councih-nan. Stipes introduced and moved for the adoption of the following resolution. Seconded by Councilwoman Nelson, motion passed by the following vote: AYE - Mayor Nix and Councilmembers_- Nelson, Stipes, and McCawley. NAY - none: RESOLUTION WHEREAS, an emergency exists which affects public health, safety and convenience due to the devasta- tion wrought by Hurrican Frederic on September 12-13, 1979, and WHEREAS, major problems exist due to debris, restor- ation of facilities, utility services, etc., and WHEREAS, on 13th day of September, 1979, the President of the United States declared a "major disaster" in the State of Alabama under the pro- vitions of Public Law 288, 93rd Congress,:as amended and y.. WHEREAS, the City of Fairhope is a public entity within said State; _ Y. NOW THEREFORE BE IT RESOLVED, by the Mayor and Council of the City of Fairhope that the Federal Emergency Management Agency, Department of Housing and Urban Development be, and the same. hereby is, requested to arrange to have the appropriate Fed- eral Agency perform the following work: clear streets; public & private property of debris This body certifies that, to the best of its knowledge and belief, the requested work is eligible tinder Public e7° Law 288, 93rd Congress, and agree to (a) provide without cost to the United States all lands, easements, and right - of way necessary for accomplishment,of the approved work, and (b) hold and save the United States free from damages due to the approved work and with respect to.debris re- moval shall indemnify the Federal Government against any claim arising from such removal.
