COUNTY OF BALIXMI X
The City Council, City of Fairhope, met in regular session at
7:00 p.m. City Administration Building, 387 Fairhope Avenue,
Fairhope, Alabama. 36532, on Monday, 10 September 1979.
Present were Councilmembers Sam E. Box, David Ed Bishop, Jack A.
Stipes, Trisha Nelson, and C.O. McCawley; City Attorney John Duck __
and City Clerk Evelyn Phillips. Mayor Nix was unavoidably detained
at another meeting; arriving a few minutes after Councilman Box called
the meeting to order.
Minutes of 27 August 1979 regular session and adjourned session
of 29 August 1979 were duly approved.
A Public Hearing was held on Club Liquor License Application by
Joe and Steve Fran, dba FRANT'S FINE CUISINE & SPIRITS, located on
Murphy Street. A period of discussion was held with Mr. Bob Thomas,
Mr. Bob Hudgens, Mr. Murray Dickerson, and Mr. James Devine speaking
in favor of approving the application. Mr. Osterberger, Mrs. Ann
Gable, Mrs. Marge Hoffren, and the Reverend H.B. Shepherd spoke in ,�►
opposition. Mr. Fram presented proof of publication. Councilman
Stipes moved to deny approval of the application. Seconded by Council-
man Box, motion to deny passed over one Nay vote by Councilwoman
Nelson.
Mayor Nix called for nominations to fill an unexpired term oi'"
the Recreation Board. Councilwoman Nelson nominated Mrs. Rae,Jackson.
Councilman McCawley nominated Mr. Isadore Reynolds. Counci]man.Bok
moved the nominations be closed. Seconded by Councilman Bishop, motion
passed unanimously. Voice vote on the nominees:

Due to the tie vote, the appointment will lay over until next session.
Mr. Bo Eiland, Mr. Jim Reese and Mr. Lohnie Jones of the Baldwin
County Bank requested approval of their recently -located Fairhone
Branch Bank as a City Depository. Councilman McCawley thanked them fori
the Council and explained that, since the City had been using the First
National Bank of Fairhope and the Merchants National Bank of Mobile for
a considerable number of years, and since a number of other Banks are
now located in Fairhope, the Council felt it wA ld be better -to leave
matters as they are since the City is not yet big enough to justify
diversification at this time. Councilman McCawley moved to deny the
,,request, with no reflection on the Baldwin County Bank intended. Second-
ed by Councilman Box, motion passed unanimously.

Councilman Stipes reported that he had contacted Mr. Comalander
regarding the roof at Fisherman's IvTorf and Mr . Comalander will give
a One -Year Guarantee on the roof. Councilman Stipes moved to approve
the bid from Mr. Comalander of $1450 plus $7.50 per hour and materials
at cost plus 1TI. on the Board replacement with the provision that City
Superintendent Rutherford oversee the work to hold the cost-plus
charges to a minimum. Seconded by Councilman Bishop, motion passed
unanimously.
Councilman Stipes asked about the work to be done placing some
pilings in Fly Creek. Mayor Nix and Supt. Rutherford reported that
Mr. Norris Smith can do the work, with the City providing the materials,
for less than $1,000. Councilman Stipes moved to approve this plan,
with Supt. Rutherford supervising the job. Seconded by Councilman Box,
motion passed unanimously.
Councilman Stipes reported that the State Retirement Plan would
cost approximately $90,000 a year as opposed to the approximate cost `f
of 845,000 for the current Retirement Plan under New England Life. ; t
There is a possibility of off -setting the cost of the State Plan by' -�
using monies accrued to the City's credit under the New Englarid Plan.
It was decided to delay action on the Retirement Plan until this possi-
bility can be fully determined. 4
The President of the Art Association asked that the Art Center r. .
be placed on the School Electrical Rate instead of the Commercial Rate. =�
Councilman Bishop is to investigate and make a recommendation to
Council.
Mayor Nix advised Council that the clerical work at the6Police
Department is now being done by two CETA workers. The CEtA manager
has advised that these two positions will be terminated in the very
near future. The Police Chief requests that a clerical position be
approved for his Department so a replacement Clerk can be 'hired upon
termination of the present workers. Councilman Stipes moved to
table this request with a second by Councilman Bishop. After some
discussion, Councilman Stipes withdrew his motion and Councilman McCaw) ey
moved to approve the request. Seconded b;T Councilman Stipes, motion'_'
passed unanimously.
On the recommendation of the Street Department Superintendent and
Superintendent Rutherford, Councilman Bishop moved to set the hours of
8 to 12 am only for the opening of the Landfill on Saturdays. Seconded
by Councilman Box, motion passed unanimously.
Councilman Stipes moved to authorize City`Attorney Duck to begin
necessary procedures to condemn an abandoned house located at 761
Northrop Street due to its being a safety hazard. Seconded by Council-
man Box, motion passed unanimously.

Mayor Nix reported a complaint had been received from Mr. Wade
Rapp of 86 Paddock Drive due to the City's refusal to haul off tree
trimmings from his property after he had hired a contractor to cut
the tree down. It was explained that the City's policy is to haul
away tree trimmings, etc., when they comply with the size and weight
limitations set forth in our Ordinance Book, and when the home -owner
does his awn work. The City does not haul trash when contractors
are hired to do trimming or tree -removal work. The consensus was to
continue with this policy.
Mr. Gary Sandell asked that parking at the football games not
include cars on the baseball field.
Councilman Stipes reported a Mr. Whittaker has offered to give
some of his land if the Tax Colony will also donate some for an access c
road at the lower end of Church Street. Councilman Stipes is to look-
into this.
Councilman Stipes moved to pay bills as presented. Seconded,+ �
by Councilman McCawley, motion passed unanimously. r
